MINUTES OF THE MEETING
October 11, 2011
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, October 12, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe. John Scagliarini and Paul Withington. The secretary, Michelle Turner, was also present.

7:00 P.M. Administrative Business – May include topics not reasonably anticipated by the Chair 48 hours in advance of the meeting.
7:30 PM Gail Dumont and Carl & Susan Dumont, 159R Herring Pond Road, 159 Herring Pond Road, 155 Herring Pond Road, Parcel ID Nos.: 057-000-013-003; 057-000-013-001; 057-000-013-002; respectively. A Request for Determination of Applicability to construct a new shared septic system within the buffer zone of Great Herring Pond and Bordering Vegetated Wetlands.
Mark Flaherty of Flaherty & Stefani, represented the applicant and explained how the shared system would work, he noted the location of the 3 homes to share the system (all family members) the system would be located in the existing lawn area in front of Lot 13-1. Cesspools will be abandoned. He noted that one well would be replaced due to level of the ground water. Legal docs will be drafted dealing with the maintenance of the system and these docs will be recorded with each deed.
No public comment made.
Gerre Hooker motioned to issue a negative determination. Motion was approved unanimously.
7:40 PM Joseph & Denise Landers, 104 Center Hill Road, Parcel ID Nos.052-000-006N-000. A Notice of Intent for the construction of coastal stairway with landings (located within a pedestrian easement that serves four additional lots: 6I, 6K, 6L & 6M) in the resource of a coastal bank.
Mr. Flaherty represented the applicant and explained the project. Typical coastal stair construction. Minimal vegetation clearing, removal bottom for ease of storing through the winter months.
Public Comment:
Mr. and Mrs. Pettinen, owners of Lot 6M (vacant lot owners who will have access to the stairs) had legal concerns: who would pay, who would maintain, who would be liable, etc.
Chairwoman, Evelyn Strawn explained the environmental concerns that the Commission had jurisdiction over. No response was made on these questions other than Mr. Flaherty stating which homeowner retained him and would pay, more than likely, for the stairway construction.
Public comment was closed.
Gerre Hooker motioned to approve the project with conditions. Motion was approved unanimously.

ACTION ITEMS:
Violation Notice – Watercourse Place - tree cutting by R.H. Burpee, on the Conservation owned open space lot. Patrick Farah, Conservation staff aide went onsite on Thursday in response to a complaint about tree cutting on the town-owned Fava Preserve, located off of Watercourse Road within the Watercourse Place subdivision. Patrick reported that he counted that up to 43 trees had been cut. A violation notice was issued to Mr. Robert Burpee of RH Burpee homes who has been cooperative. Mr. Burpee stated that he downed the trees in order to control the off-road vehicle riding that was occurring. In lieu of fines, Mr. Burpee has been asked to purchase signs for the property, to survey a property line and provide the manpower to complete the signage. He has agreed to all terms. The Commission supported
this action and no further action was taken. Mr. Farah will continue to keep the Conservation office updated on progress.

Joseph and Denise Landers, 104 Center Hill Road, SE57-2565. John motioned to approve as amended. Approved unanimously.
CERTIFICATE OF COMPLIANCE:
SP Realty, 44 Paulette Terrace, SE57-2247. Gerre Hooker motioned to issue the COC. Approved unanimously.
