MINUTES OF THE MEETING
June 28, 2011
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, June 28, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM Holbrook Realty Trust, Peter R. Holbrook, Sr., 67 Old Beach Road, Parcel ID Nos. 048-049-007-000, 048-049-000B-001. A Request for an Amended Order of Conditions for DEP File No. SE57-2401 to construct stone steps down the stone ramp at the landing and for the post-facto construction of a set of wooden beach stairs, within the resource of a coastal beach and coastal bank. Project also includes a new set of coastal stairs for the southerly dwelling of Lot 49-7.
J. Randolph Parker of LMSI represented the applicant Also present was Barry Pike, President of Churchill’s Landing Association (CLA), Ellen Nix and Cam McVane, Treasurer.
Mr. Parker explained the several projects requested in this proposal. First, on the property of (CLA), there is a request to mortar a portion of the landing access to the beach due to complaints from CLA members that the area is icy and slippery during the winter months. Mortar is proposed as a leveling course and maintenance would be ongoing. Mr. Parker said that the mortar was requested as a safety issue. The second project in the NOI was for existing stairway maintenance . Randy noted that recently the stairway was storm damaged so the homeowner went and rebuilt the stairway in nearly the same footprint. The third project is to construct another coastal stairway that would service the 2nd dwelling existing on the Holbrook property.
Discussion began by the chair, Evelyn Strawn, stating the Commission’s position regarding mortaring on coastal bank. Mr. Parker hoped that the Commission applied a case-by-case reasoning to this position and stated, again, that this is a safety concern.
John Scagliarini is concerned with heavy equipment going over the steps and making them unsafe. Discussion continued over the use of mortar. Barry Pike asked for an explanation of why mortaring is not allowed by the Commission and what was the position of Coastal Zone Management. The applicant agreed to continue to explore other options.
Due to the mortaring concern by the Commission, Gerre Hooker motioned to continued to July 26, 2011 at 7:30 PM. Approved unanimously.
7:40 PM Janet Synnott & Rosemary MacKay, 49 Central Avenue, Parcel ID No. 121-000-020-000. A Request for Determination of Applicability to construct a new septic system in the buffer zone of the inland bank of Big Sandy Pond.
Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project. Janet Synnott and Rosemary MacKay were also present.
Because they are 80 ft. to a surrounding well, they will also need a variance hearing with the Board of Health. Dwelling has been sold and there is no other work is associated with this project.
No public comment was made.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:45 PM Joseph E. & Ann M. Brady, 25 Langford Road, Parcel ID No. 047-000-017-009. A Request for Determination of Applicability to construct a new septic system in the buffer zone of Shallow Marsh Meadow Fen.
Mark Flaherty of Flaherty & Stefani, Inc. and explained the marsh fen area.
No Public Comment made.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:50 PM Peter & Barbara Palfrey, Saquish Head – Burgess Avenue, Parcel ID No. 132-000H-004-000. A Request for Determination of Applicability to construct a new septic system, construct two new decks, reconstruct roof, install new windows and reside dwelling, in the buffer zone of the top of a coastal bank to Cape Cod Bay.
Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project.
No Public Comment made.
John Scagliarini motioned to issue a negative determination. Approved unanimously.
8:00 PM Richard G. Weidmann & Carol Lydon, 80 West Pond Road, Parcel ID No. 095-000-017B-000. A Notice of Intent for the post-facto construction and relocation of a 14’ x 14’ shed, within the buffer zone of an inland bank of Big West Pond. This project is subject to review by Natural Heritage, but, may be exempt from MESA review.
Mark Flaherty of Flaherty & Stefani, Inc. represented the applicant and explained the project.
Brief history: Applicants were issued a Violation Notice for the shed construction in the buffer zone with no approvals. Goal was to move the shed outside of the 35 ft. buffer zone.
Public Comment:
Christopher Hogan, 51 West Pond Road, concerned with losing view of the pond. Mr. Flaherty showed aerials of the site and the abutters seemed satisfied.
Public Comment was closed.
Gerre Hooker motioned to approve the project with conditions. Approved unanimously.

Violation Notice – 185 Taylor Avenue, Frank Lopriore,
Parcel ID No’s: 045B-000-014-034 and 045B-000-014A-000
Excavation around dwelling and dumping of debris (bricks & asphalt) on coastal dune and coastal Beach. Staff gave an update on this violation and noted that a Violation Notice was issued and await response from the applicant.
Enforcement Order – 50 Center Hill Road, David McCarthy
Staff member gave an update on the Violation Notice that was issued in July 2010 and that there has been minor response from the property owner.
John Scagliarini motioned to issue the Enforcement Order to remove the deck constructed on the stone revetment. Approved unanimously.
