MINUTES OF THE MEETING
April 19, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, April 19, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
David Foster was absent

Continued from April 12, 2011
7:30 PM Michael Vogel, 14 Winter Street, Parcel ID No. 023-000-005B-000.  A Notice of Intent to extend the existing stone rip-rap revetment on an eroding coastal bank including a stairway; construct a patio and deck, landscape improvements including replacement of retaining walls, in the buffer zone of the top of the coastal bank.

Richard Tabazinski of Atlantic Design Engineers and the applicant Michael Vogel were present.  Also contractor Michael Travis was present.
Mr. Tabazinski began discussion with the existed conditions on the site, including abutting property north of site and further north by the Town of Plymouth MA (Stephen’s Field).  Flood zones were reviewed and a small bordering vegetated wetland (bvw) exists in the front of the lot.  

Approximately 150 linear feet of coastal stone revetment including stairway to access the beach is proposed, along with drainage, landscaping and decks and patios associated with the single family dwelling on the site.  The northerly return of the wall is being held on the applicant lot to prevent an erosion occurring on neighboring lot. Return is proposed 5 feet from the lot line. Extension of the patio is proposed including new decking and landscaping improvements.  Drainage pipes that currently exist in the bank will be improved by extending them to daylight.  No stockpiling on the beach or salt marsh is proposed.  

Evelyn Strawn commented on the work proposed within the no-build 35 foot buffer zone.  Ms. Strawn would like to see confirmation that the dwelling was constructed prior to 1978.   Discussion ensued over the construction.  
Mr. Tabazinski commented that softer measures have been pursued with some erosion continues. He further stated that the bank is not a source of sand nourishment.

Public Comment
•John Shaw, northerly abutter, 39 Fortune Drive in Plymouth, concern with water being deflected
into his property, due to past grade changes.  He maintains a boat/storage building on his lot.
•Maggie Tavares, 7 Winter Street, concern with water that runs off the street
The contractor Mike Travis said that  drywells would also be installed.
•Merland Ladd, 138 Sandwich Street, spoke about the potential for wave action n this area.  He said that he has observed severe storms in this area.
Public Comment closed.

Paul Withington asked about the PVC pipe on Winter Street and asked about the town sewer system.  He also confirmed the type of stairs to be construction.

Discussion ensued that the Commission had many concerns with some portions of the this project.  All existing structures could be improved.  Suggested the applicants explore some options for the seawall.  The applicant agreed to continue.
Gerre Hooker motioned to continue this hearing until May 10, 2011 at 8 PM.
Approved unanimously.

Continued from April 12, 2011
7:40 PM John A. & Karen E. Marshall, 92 John Alden Road, Parcel ID No. 044-006-420-000.  A Notice of Intent to remove debris, brush and invasive plants and stabilize area with new plantings in the buffer zone of the top of the coastal bank and reconstruct/repair the coastal stone revetment including new stone steps.
J. Randolph Parker  represented the applicant and explained the project.  Gave some history of the house construction and the long appeal process.  Project is predominantly a landscape plan and resetting the revetment stones.  Mr. Parker suggested that if the stones meander differently, a softer slope ratio could be obtained for an easier walk to the beach.  Vegetation plan was presented.  Additional stones may be brought in to make the wall more attractive.
Public Comment:
John Reardon, 23 Wellington Road, supported the project, concern with town work that will be occurring soon and also concern with the Association’s work that will occur to clear the cobble from their walkways.  Mr. Parker said that no disturbance is expected.
Public Comment is closed.  
John Scagliarini motioned to approve the project with conditions.  Approved unanimously.

Other Business:

ACTION
Mark Flaherty of Flaherty & Stefani, Inc., for the American Legion, 199 Federal Furnace Road, SE57-2528.  Accept a planting plan, per Condition No. 20.  Gerre Hooker motioned to approve the planting plan to satisfy Condition No. 20 of the Order.  Approved unanimously.

ORDERS OF CONDITIONS:
John & Karen Marshall, SE57-2541.  Gerre Hooker motioned to approve as written.  Approved unanimously.


CERTIFICATE OF COMPLIANCE:
•SE57-2163, Pacor Inc., Lot 9-29, Hollis Road & Beaver Dam Road, (no work ever commenced).  John Scagliarini motioned to issue the COC.  Approved unanimously.
•SE57-2088, Pacor, Inc., Lot 9-29, Hollis Road & Beaver Dam Road (Partial COC for this lot only).  John Scagliarini motioned to issue the COC.  Approved unanimously.
•SE57-2088, Pacor, Inc., Lot 9-22, Edgewater Drive (Partial COC for this lot only).  John Scagliarini motioned to issue COC.  Approved unanimously.
•SE57-1975, Penelope Farley, 129 Manomet Avenue (for seawall reconstruction).  Gerre Hooker motioned to issue the COC.  Approved unanimously.
