MINUTES OF THE MEETING
May 24, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2011 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:00 P.M.       Administrative Business
7:30 P.M.       Public Hearing Begin
        
7:30 PM ADM Agawam Development, LLC,  Off Wareham Road and Agawam Road, Parcel ID Nos. 117-000-000A-003; 118-000-001-001.  A Notice of Intent to install a water main using directional drilling  from Wareham Road to a water supply well within the Agawam Road layout, as part of the River Run development.  Work is within the buffer zone of Bordering Vegetated Wetland and Inland Bank, and within the riverfront area of the Agawam River.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.

Judy Kahn and John Nelson of Beals and Thomas represented the applicant.  
Mr. Nelson described the site:   Explained how the directional drilling over the Agawam river would drill the well.  No physical disturbance to the river or the bordering vegetated wetland.  No impervious surface is proposed.  Trenches may have to be widened for equipment access.  Vegetation cutting and small amount of top soil to be added.  Water lines will continue to be maintained in the future (to insure trees are not growing).
No negative impacts, no impacts on fisheries

No public comment made.
Gerre Hooker motioned to approve the project with conditions and subject also to a response and any/all conditions from NHESP. Approved unanimously.

7:40 PM Laura Smith, 14 King Avenue, Parcel ID No. 096-000-062-090Z.  A Notice of Intent to construct a deck over the existing patio in the buffer zone of Bordering Vegetated Wetland of Kings Pond.
Zack Bezinsky of Bracken Engineering represented the applicant and explained the project to construct a deck over the patio
Sonotube footings will go inside the patio area.  

Pavers may be removed at the discretion of the applicant.
There was no public comment
Gerre Hooker motioned to approve the project subject to conditions.  Approved unanimously.

7:50 PM Margery Duval and Glenn & Linda Gavin, 10 Cleveland Road, Parcel ID No. 056-000-073-014Z.  A Request for an Amended Order of Conditions for DEP File No. 2386 (Margery Duval) to construct an addition and attached deck to the existing dwelling, and construct a walkway, in the buffer zone of an inland bank and in the resource of Island Pond.
Glenn and Linda Gavin represented themselves and described their project for a bedroom addition including an open deck.
There was no public comment.
James Aimone motioned to approve the project,  Approved unanimously.

8:00 PM Joseph Sullivan, 85F Taylor Avenue, Parcel ID No. 045C-000-026-000.  A Request for an Amended Order of Conditions for DEP File No. SE57-2137 to replace an existing deck with a larger deck within the coastal beach and coastal dune system of White Horse Beach.
James Barrett, contractor for the project described the project.  Additional 80 square feet is being added.
David Foster motioned to approve the project with conditions.  Approved unanimously.

ACTION ITEMS:
DEP issued the following Superseding Orders:
Arthur Genova, 17 Smaland Lane, SE57-2536 –for beach management plan.
DEP issued an SOOC approving this Order.

MOLU LLP, Nameloc Road, SE57-2487 – for dwelling construction.
DEP issued SOOC approving this project.  This project was not subject to the Bylaw, therefore no further action to be taken.

Removal of seaweed on Plymouth Beach – request from Barry DiBlasio
Gerre Hooker motioned to support the seaweed removal.  Approved unanimously.


Clear Pond violation, Esta Road
Staff Elizabeth Sullivan described the tree cutting on town owned lot on Esta Road.  Contractor was caught and stopped by Parks Supt. Ted Bubbins.  Area homeowner hired the contractor to remove the trees on the town lot.  Both parties have agreed to make remediation.  Staff will continue to update the Commission on progress.

Joseph Sullivan, SE57-2137 (amended OOC).  Gerre Hooker motioned to approve as written.  Approved unanimously
ADM Makepeace, SE57-2548.  Gerre Hooker motioned to approve as amended.  Approved unanimously.

CERTIFICATE OF COMPLIANCE:

Gerre Hooker motioned to issue the COC.  Approved unanimously.
