MINUTES OF THE MEETING
FEBRUARY 8, 2011

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, and Commissioners James Aimone, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

Brooke Monroe and Gerre Hooker were absent

7:30 PM Michael Jenness, 12 Diane Avenue, Parcel ID No. 096-000-070-019; 1 Carol Blvd, Parcel ID No: 096-000-070-020; 096-000-074-000.  A Request for Determination of Applicability to upgrade a septic system and construct a detached garage and driveway, in the buffer zone of Little Saby’s Pond.
Steve Rumba of Collins Engineering represented the applicant and explained the project.  Existing septic consists of several pits.  Leaching field is proposed outside of the buffer zone.  Closest point to wetland is 53 ft. to the pond.
There was no public comment.
John Scagliarini motioned to issue a negative determination.  Approved unanimously.


7:35 PM J. Kevin Donovan, 20 Nameloc Road, Parcel ID No. 054-005-005-007A, 054-005-005-005A, 054-005-006A-001.  A Request for an Amended Order of Conditions for DEP File No. SE57-2243 to extend the existing gabion revetment approximately 125 linear feet south, in the resource of an eroding coastal bank.

Kevin Donovan represented himself and explained his project to construct a new gabion basket seawall in an area that is experiencing a great amount of erosion.  He reported that the wall on his property also experienced erosion on the ends and hoped to control that erosion with the new construction. He noted that the Board of Selectmen approved of the filing of the NOI because this is town-owned property.
Public comment:
Clinton Ross, 49 Nameloc, supported the project to tie in the wall to form a connection.
Joe Galant, 29 Janet Street, supported the project.
Randy Parker, 81 Manomet Avenue, supported the project to fill in the gap.
Letter from Monty Lund was read into the record in support of the project.

David Foster motioned to approve the request for an Amended Order of Conditions, with conditions.  Approved unanimously.

7:40 PM John Donahue, 2 Massasoit Avenue, Parcel ID No. 049-001-012A-001.  A Notice of Intent to extend the existing coastal stone revetment including the placement of approx. 100 ft. of steel sheeting into the coastal bank for the protection from ongoing erosion from adjacent property.
Bill Shaw of Associated Engineers represented the applicant and explained the project.  He noted that an agreement is in the works with the Association and they will abide by this agreement.  He noted, however, that if erosion is occurring and the dwelling is in jeopardy, then details will be submitted to install the steel sheeting.
Elizabeth Sullivan, Commission staff, noted that she did not support the steel sheeting on the coastal bank.

Randy Parker- hoped to see a revised plan showing the return   Discussion ensued between Mr. Parker and Mr. Shaw and signing the Memorandum of Agreement.  
He does not believe a bulkhead will be created unless it is exposed.  Sheeting is driven into the bank, no sand is removed.
Mr. Parker does not support the structure in the velocity zone and looks for the agreement to the signed.
Bill Shaw requested a continuance to March 1, 2011.
James Aimone motioned to approve a continuance to March 1, 2011, time TBD.  Approved unanimously.

7:50 PM Town of Plymouth, Environmental Management, 158 & 168 Sandwich Street, Parcel ID Nos.  024-000-013-000, 024-000-013A-000.  A Notice of Intent for the restoration of Wellingsley Brook to include the removal of three (3) concrete weirs and associated stream channel and stream bank restoration work including the construction of pools and riffles, and the installation of woody debris and native plantings, in the resource of Wellingsley Brook.  A complete project description is available in the Conservation Office.

Alex Hackman of the MA Resource Management/Dept Fish and Gamer. Hackman began
Mr. Nelson explained that the best science was used to design the ultimate fish passage for this brook restoration.
Currently 2 channels exist and now a single channel is proposed.  The left channel is chosen to be the main channel.  (longer, lower slope, more fish passage, floodplain habitat, easy access for construction)
Right channel: newer channel, steep banks, bank erosion, no floodplain, hard access, step pool system, undercut banks.  These are the reasons to choose the left channel.
All 3 dams to be removed, sediment that has piled up will be removed.  
Channel restoration schematic was shown.
Culvert & Constructed Riffle: 108 ft. long, riffle crest higher than bottom of culvert, create backwater for approx. 15 ft. in culvert, prevent fish passage at mouth of culvert, no flood impacts upstream.

Right channel Riffle: 10 yr. flood and greater will pass into right channel, groundwater flowed to remain,
Construction sequence:  use upper dam to control water flow, remove lower 2 dams, restore lower left channel, build the energy dissipator, riffle, removed upper dam and rest. Upper channel.  
Commence after June 30, 1-2 weeks.

John Scagliarini asked if the southerly channel will be cleaned. Whatever can be removed by hand.

She confirmed that all land is privately own but grants will be sought and an easement will be obtained and deeded to the town to maintain the site.
Plant species list will be put together, per david gould.
The resources as identified on the original plan are being used on this plan, per david gould.

Alex commented the Town in its grant efforts and said that this was a priority project established by the state.  He commended David’s efforts for river restoration, as a leader in the state.

John Scagliarini motioned to approve the project.  Approved unanimously
Other Business:

CERTIFICATE OF COMPLIANCE:
OOC, SE57-994 (with a notation that seawall construction under this Order is not in compliance and the Order was no longer valid, hence repairs to the seawall will occur under the newly issued OOC, SE57-????
James Aimone motioned to deny the request for a partial COC and follow staff’s recommendation as noted above.
