MINUTES OF THE MEETING
October 19, 2010
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, October 19, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe and John Scagliarini. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM Michael and Andrea Carey, 73 Lookout Point Road, Parcel ID No. 053-000-021-007. A Request for Determination of Applicability to upgrade a septic system in the buffer zone of the top of the coastal bank.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.

7:35 PM Paul Corsini, 149 Herring Pond Road, Parcel ID No. 057-000-014-002. A Request for Determination of Applicability to acknowledge the existing seasonal dock in the resource of Great Herring Pond.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:40 PM Eagle Hill Realty Trust, Marie L. Feeney, Trustee, 32 Eagle Hill Drive, Parcel ID No. 056-000-001-032. A Request for Determination of Applicability to upgrade a septic system, loam and seed to stabilize the area, in the buffer zone of an inland bank of Great Herring Pond.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:45 PM Terence Harte, 600 State Road, Parcel ID No. 045-000-020C-000. A Request for Determination of Applicability to upgrade a septic system with associated site work, in the buffer zone of Bordering Vegetated Wetlands and Riverfront of Beaver Dam Brook.
Minor trees will need to be removed.. Silt sock will be used.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
Other Business:
7:00 PM - Tony Bosari of 16 Nameloc Road came before the Commission to discuss the construction sequence for the Earth Rib Module seawall construction, SE57-2105, as part of a special condition.
Mr. Bosari explained how he would lower the grade 3 feet ocean side of the house) for equipment access to place the material over the bank, via 32000 lb. winch, lowered one at a time, over the bank. Each module weighs 2000 lbs. Temporary ramp will be built and the area will be stabilized and replanted when done. The grade may not be brought back up.
Gerre Hooker asked about the necessary fill and Mr. Bosari said that approx. 20 feet was lost at the base of the bluff, but he will not be replacing that fill. At the top of the bank approximately 23 feet has been lost over the last 4 years. The ERM’s will be placed at the new bottom of bank. Staging will take 2 or 3 days and the project should take approximately one week.
The Commission accepted the outline of the construction sequence project. Work may commence with a phone call to the office when work commences.
7:15 PM - Atty. Adam Brodsky represents GFJ Realty Trust, 18 Priscilla Beach Road, SE57-2318– Violation of Order of Conditions
Atty. Adam Brodsky was present, J. Randolph Parker of Land Management Systems, Inc., was present and property owner, Richard Joyal was present.
Mr. Brodsky stated that the contractor made the decision in the field himself to mortar the seawall. It will be very difficult to remove the concrete. Mr. Brodsky said that although DEP/CZM do not like to see mortaring of the seawall but there is no policy or ordinance in place.
Mr. Parker said that additional offerings could be made. And he believes that the wetland interests were not compromised.
Atty. Brodsky also said that additional wetland plantings or an offsite project could be a compromise.
Chairman Strawn stated the commission’s position and stands behind the Enforcement Order.
Mr. Parker explained the process if the wall was removed- equipment on the beach, jack-hammering, laborers, etc. Mr. Parker asked if a NOI would be required to complete the work. Mitigation would be allowed under the Enforcement Order.
Mr. Scagliarini asked if the wall was built to spec, if in fact, the contractor made the decision to place concrete. Mr. Parker said that the wall does conform.
Mr. Joyal said that the work was not premeditated. But they are here to come to the best solution.
No further action was taken.
James Aimone would like the Commission informed of court action and ongoing communication.
