MINUTES OF THE MEETING
November 9, 2010
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, November 9, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Brooke Monroe was absent.
7:30 PM Alexander M. Smith, 7 Diane Avenue, Parcel ID No. 096-000-070-016. A Request for Determination of Applicability to demolish and reconstruct a single family dwelling in the buffer zone of Saby’s Pond.
Greg Tansey of Hardy Engineering, Inc., represented the applicant and explained the project to demolish the existing dwelling and construct a new dwelling on substantially the same footprint. Erosion control barriers will be in place. The septic system has already been upgraded and does not require any work at this time. It is a Title V mounded system and is located outside of the buffer zone.
Edge of pond was determined by instrument survey and the small block retaining wall is considering the edge (where measurements were taken).
Public Comment:
David Selgada, 11 Diane Avenue. Wanted a confirmation that the dwelling would be demolished and reconstructed. This was confirmed.
Public comment closed.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:40 PM Jerry & Linda Riccio, 75 Sandy Beach Road, Parcel ID No. 120-000-001-117. A Request for Determination of Applicability to construct a second story addition to the existing dwelling in the buffer zone of White Island Pond.
Jeffrey Metcalfe, RA, represented the applicant and explained the project for a second story addition. Septic system was upgraded in the past – no new work proposed at this time. Bedroom count remains at 4.
Gerre Hooker motioned to issue a negative determination. Approved unanimously.
7:50 PM Center Hill Limited Partnership, 74 Center Hill Road, Parcel ID No. 052-000-004A-002. A Notice of Intent to stabilize an eroding area of a coastal bank (approx. 150 ft.) including placement of fill, stone and vegetation.
Carlos Quintal of CAQ Engineering represented the applicant and explained the project. This project is similar to a project approved in 2005, on this property
The Commission accepted a revised plan submitted showing the delineated top of coastal bank.
Gerre Hooker suggested a berm at the top of the bank to control runoff over it. The representative will consider this.
No public comment made.
Gerre Hooker motioned to approve the project with conditions. Approved unanimously.
8:00 PM Margaret Carver, et al, 49 West Long Pond Road, Parcel ID No. 069-000-044C-000. A Notice of Intent to construct an addition to the existing dwelling including amenities and utilities and construct a seasonal dock and float, within the buffer zone of Bordering Vegetated Wetland and resource area of Round Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
J. Randolph Parker of LMSI represented the applicant and explained the project for an addition on the dwelling. Project also includes a landscape plan, pathway to the pond, seasonal dock/float system, including a 6 x 8 deck attached to the dock.
Jeanine Furrer explained the landscape plan and described the trees to be removed in the buffer zone. Opening the space would allow more sunlight in to control a mold issue.
Pruning of trees in the 35 ft. buffer zone is also requested. Baltic ivy is suffocating tree growth in the 35 ft. buffer zone and is requesting to be removed. Native ground cover will replace the ivy. Approval is requested to perform work in this area.
No Public Comment made.
Gerre Hooker motioned to approve the project with conditions. Approved unanimously.
8:10 PM John Donahue, 2 Massasoit Avenue, Parcel ID No. 049-001-012A-001. A Notice of Intent to extend the existing coastal stone revetment including the placement of approx. 100 ft. of steel sheeting into the coastal bank for the protection from ongoing erosion from adjacent property.
Bill Shaw of Associated Engineers represented the applicant and explained the project.
He gave some history of work done. He submitted photos of the site. He noted the erosion during the latest spring/summer.
Bank and wall is continuing to recede. Steel sheeting is proposed which is to be advanced 60-70 percent into the ground than what will be visible. If erosion continues, sheeting will become exposed and the repair to occur will be to install cross braces and soil nails into the bank. Hydraulic mechanism is used (called a silent advance). Continual maintenance will be needed as erosion occurs.
Staff and board members confirmed that stones were being proposed to the property line and sheeting was proposed within 4 feet of the property line. Evelyn Strawn wanted to confirm that sheeting would prevent end scour
Gerre Hooker questioned the superseding order issued from the DEP and the ongoing conditions. Discussion ensued over keeping the stones 30 ft. in from the neighboring lot lines. Consensus of the Commission was to get some feedback from DEP
Commission also questioned if abutters have been involved in discussion to allow work on the association property.
Public Comment:
Randy Parker of Land Management Systems was present and asked about the cost of this project. Mr. Shaw said about $100K, and Mr. Parker suggested that the Association work with the applicants to allow some work on their property with compensation of placing beach sand on the Assoc. lot.
Eileen Collins gave some history of the project and some history of their association negotiating with this property owner and stated that the Donahue’s have reneged on past neighborhood negotiation. She is leery to commence negotiations again.
Bill Shaw suggested a continuance to open communications with neighbors and to schedule a meeting with DEP.
Abutter to the south asked if her lot would be affected. Mr. Shaw said it would not.
James Aimone agreed that both properties need to have protection.
Gerre Hooker motioned to continue to January 7, 2011 at 7:40 PM. Approved unanimously.

Ronald Ferioli, 178 Black Cat Road, SE57-2279 – completed Ch. 91 License for dock. Gerre Hooker motioned to issue the COC. Approved unanimously.
Edward Simpson, 1510R State Road, SE57-1248 – no work completed under this Order
(work was done under a different Order and COC has been issued)
John Scagliarini motioned to issue the COC. Approved unanimously.
PACOR,, SE57-2088 – partial COC for this lot only, 39 Highview Road . Gerre Hooker motioned to issue the COC releasing this lot from the Order. Approved unanimously.
ORDERS OF CONDITIONS:
John Donahue, 2 Massasoit Avenue, SE57-2513. No action taken at this time.
Center Hill Ltd. Partnership, SE57-2515. Gerre Hooker motioned to approve as written. Approved unanimously.
Margaret Carver, et al, SE57-2516. Gerre Hooker motioned to approve as amended. Approved unanimously.
FIELD CHANGE:

Request to relocate the dressing room farther away from the pond. Letter from Sam Chapin of Brown and Caldwell was read into the record with the request to relocate the dressing room cabin farther away from the pond.
John Scagliarini motioned to approve the field change request. Approved unanimously.
The calendar of upcoming meetings and events was reviewed.
