MINUTES OF THE MEETING
July 27, 2010
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, July 27, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Gerre Hooker, Vice-Chairman and Commissioners Brooke Monroe. John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Absent: Chairperson Evelyn Strawn and Commissioner James Aimone.
Gerre Hooker chaired the meeting.
7:15 PM Paula Doisneau, 123 Manomet Avenue, Parcel ID No. 048-049-232-000. A Notice of Intent to repair an existing coastal stone revetment back to its original condition, including beach nourishment, in the resource of a coastal bank and coastal beach.
Paula Doisneau was present and explained the project to repair her seawall.
Public Comment:
Donna Johnson, 25 Pond Avenue questioned how much sand would be replenished. Liz explained how the calculation is done.
Public comment closed.
John Scagliarini motioned to approve the project with conditions. Approved unanimously
7:20 PM Robert J. Ankstitus, 125G Taylor Avenue, Parcel ID No. 045C-000-012-000. A Request for Determination of Applicability to construct a cantilevered extension of an existing deck and to construct a new cantilevered deck, within the coastal dune system of White Horse Beach.
Discussion ensued on the decks constructed without permits.
Hassan Afzali, 123G Taylor Avenue. Concern with the size of the deck and does not feel there should be an expansion of it .
Cheryl Damiano, 125D Taylor Avenue. Concern with right of way and construction within the right of way.
Discussion ensued over the lack of a Zoning approval or a Certificate of Compliance for the reconstruction of the dwelling.
Paul Withington motioned to continue to September 28, 2010 at 7:30 PM, so that the applicants can apply for a COC and seek zoning approval. The motion was approved unanimously.
7:30 PM Bruce R. & Love A. Howard, 735 Long Pond Road, Parcel ID No. 069-000-059-016. A Remand from Superior Court under the Town of Plymouth Wetlands Bylaw to act on A Notice of Intent to construct a boathouse, including deck, wooden steps and platforms within an inland beach, bank, BVW and flood zone; construction of a seasonal dock, with amenities, within the resources of Long Pond.
Brooke Monroe motioned to continue to September 28, 2010 at 7:30 PM. Approved unanimously.
7:45 PM John and Patricia Duggan, 36 Old Beach Road, Parcel ID No. 048-049-050A-000. A Notice of Intent to construct a parking area, grading and retaining wall, patio and tree clearing, within the buffer zone of Rabbit Pond, associated with the construction of a single family dwelling with attached 1 car garage and septic system that is proposed outside of the buffer zone.
Mark Flaherty of Flaherty & Stefani represented the applicant and explained the project. Property fronts Old Beach Road and backs up to Pond Avenue. House is outside of the buffer zone and backs up to Pond Avenue. Only clearing and guest parking area is proposed in the buffer zone. A gravel parking lot is proposed and the driveway should be able to handle the water leaching into the ground. Mr. Flaherty said that he is aware of the drainage concerns in the area. Roof drains will go into hollow drywells. Soil conditions are medium to coarse sands. Ground water flows to the east.

>Lynne Harvey, 57 Pond Avenue, lots slopes 3 to 4 feet to Pond Avenue and feels the tree removal will be detrimental and cause more runoff. Said that water runs into the street currently.
>John Project, Old Beach Road concern with impact into the buffer zone. There is already too much runoff in the area.
>Mr. Gerald of 41 Pond Avenue said there are many species of vegetation and animals in the area.
He said that the Town has just placed a catch basin on Foxglove and he feels it will be compromised.
>Donna Johnson, 25 Pond Avenue. How many trees would be removed.
>Olga Marganelli concern with a driveway cut and possible removal of trees on her lot.
Discussion ensued over the buffer zone work and staff Liz Sullivan asked if the applicant was willing to make additional drainage improvements to control the runoff.
>Brian Harvey, 57 Pond Avenue. Asked if elevation plans were available.
>Lynne Harvey, 57 Pond Avenue trees have died along the pond’s edge due to the amount of water/
>Donna Johnson, 25 Pond Avenue Wants assurances that runoff will not affect Pond Avenues.
>Virginia Johnson, 50 Old Beach Road, talked about catch basins being installed.
Public comment closed.
The applicant agreed to eliminate the gravel driveway on the Pond Avenue side of the property and construct a planted strip berm located at the top of the lot near Pond Avenue.
John Scagliarini motioned to approve the project as amended, with conditions. Approved unanimously.
7:55 PM The Fox Family Trust/Louis W. Fox, 18 Marscot Way, Parcel ID No. 095-000-002-027. A Notice of Intent to reconstruct and elevate the existing paved driveway in the buffer zone of Big West Pond and Grassy West Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Mark Flaherty of Flaherty & Stefani represented the applicant and explained the project to raise the driveway to avoid any future flooding in this area. No tree removal, fill will be added. The existing gravel parking area will not be touched.
No public comment was made.
John Scagliarini motioned to approve the project with conditions, including Natural Heritage and MESA. Approved unanimously.
8:05 PM Linda S. Rudnick, 21 West Ridge Trail, Parcel ID No. 095-000-052-000. A Notice of Intent to relocate the existing single family dwelling and construct a one--story addition to the existing dwelling in the buffer zone of a wetland resource of Big West Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Mr. Flaherty of Flaherty & Stefani began some opening statements on the status of the flooded site. It was brought to the attention through a notation on the plan that Commission Brooke Monroe delineated the wetlands on this site. Therefore, she recused herself from the hearing. As agreed to by the applicant, Paul Withington motioned to continue the hearing to August 24, 2010 at 7:30 PM. Approved unanimously.
8:10 PM Estate of Chloee Atkinson/Odin and Kerstin Anderson, 49 Black Pond Lane, Parcel ID No. 052-000-014-000. A Notice of Intent to demolish the existing single family dwelling and construct a new single family dwelling with amenities and utilities including porches, deck, septic and grading in the buffer zone of the top of a coastal bank.
Mr. Kedian had concern with the well which is shared between the two properties. He would like the Atkinson property to have its own well. The PCC stated that this was a civil issue between the two properties.
Paul Withington motioned to approve the project with conditions. Approved unanimously.

Michael Flaherty, SE57-2263. John Scagliarini motioned to issue a 3 year extension. Approved unanimously.

*Note: staff recommends denYING this extension request because property owner has not fulfilled a condition of her land swap agreement to relocate her driveway off of town land.
Motioned approved unanimously to deny the request until the driveway is relocated.
