MINUTES OF THE MEETING
April 27, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, April 27, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Brooke Monroe was absent

7:30 PM Richard Taylor, Highview Road, Parcel ID No. 075-000-009-019.  A Request for Determination of Applicability to construct a driveway and related grading in the buffer zone of a cranberry bog.  J. Randolph Parker of LMSI represented the applicant and explained the project in Beaver Dam Ridge.  Plan revised at the table to show driveway to be paved rather than noted gravel.
No public comment.
John Scagliarini motioned to issue a negative determination.  Approved unanimously.

7:35 PM Mildred B. Long, 73 Sea View Drive, Parcel ID No. 049-004-454-000 & 049-004-455-000.  A Request for Determination of Applicability to upgrade a septic system, in the buffer zone of the top of the coastal bank.  J. Randolph Parker of LMSI represented the applicant explained the project.  Cesspool is less than 10 ft. to the bank.  John Scagliarini asked if the cesspool should be removed due to its proximity of the bank.  Randy said bank has a stone revetment and is well vegetated and should not be a concern for erosion.  
No public comment.
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:40 PM Susan Cody, 20 Driftwood Lane, Parcel ID No. 043-000C-010-000.  A Request for Determination of Applicability to upgrade a septic system, in the buffer zone of the top of the coastal bank.  J. Randolph Parker of LMSI represented the applicant and explained the project.  Bank is well vegetated.  Rocky beach is below.  Cesspool sits on edge of bank.
No public comment.
John Scagliarini motioned to issue a negative determination.  Approved unanimously.

7:45 PM Bruce E. & Karen M. Gustafson, 85G Taylor Avenue, Parcel ID No. 045C-000-126-000.  A Request for Determination of Applicability to construct a 2nd floor deck cantilevered over the existing coastal stone revetment.
Mark Flaherty of F& S, Inc. represented the applicant and explained the project.  Mr. Flaherty presented a slightly different project asking for footings rather than cantilevered.  He explained that the previous structural report was incorrect regarding the joist construction in the dwelling.  Although the cantilevered deck could still be accomplished, the expense is much greater.  

Consensus of the Commission was not to support footings.
No public comment.
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:50 PM Paul Bisceglia, Jr., 23 Limerick Way, Parcel ID No. 124-000-006-000.  A Notice of Intent to construct an addition to the existing single family dwelling and construct a detached garage, within the buffer zone of Big Sandy Pond and Isolated Wetlands.
Brad Bertolo of JC Engineering represented the applicant and explained the project.  He explained that the water is very high, possibly the highest its ever been.  Ms. Sullivan asked to have the garage relocated to meet the 25 ft. setback to the IVW.  The applicants agreed.
John Scagliarini motioned to approve the project with conditions.  Approved unanimously.

8:00 PM Robert Stockel Jr. & Brenda Stockel, 201 Sandy Beach Road, Parcel ID No. 120-000-001-257.  A Notice of Intent to construct a single family dwelling and deck with utilities and amenities, in the buffer zone of White Island Pond, including acknowledgement of the existing seasonal dock in the resource of White Island Pond.
Brad Bertolo of JC Engineering represented the applicant and explained the project to rebuild a dwelling due to a fire in the fall of 2009.  Septic variances were approved by the BOH.  Also requesting acknowledgement of a dock.  Discussion ensued over the large deck at the end of the dock.  No changes were made to the dock.
Gerre Hooker motioned to approve with conditions.  Approved unanimously.

Other Business:

MISCELLANEOUS:
The Commission signed off Phoenix and Holmes Conservation Restrictions.

FIELD CHANGE REQUESTS:
>Robert Fortunato, 49 Mayflower Street, SE57-2326.  Requests to add one (1) 4 x 4 ft. landing to the coastal stairway.  John Scagliarini motioned to allow the field change.  Approved unanimously.

>Robert and Elizabeth Spiegel, 28 Livingston Drive, SE57-2429.  Requests to replace the 4 ft. wide walking path with stairway and wooden platforms.  James Aimone motioned to approve the field change subject to approval by NHESP/MESA.  Approved unanimously.

>Linda O’Neill, 34 Scarlett Drive, SE57-2443.  Requests to relocate dwelling further away from wetland and construct a patio in the former “walk-out” area; construct new stairway to join existing steps and reconfiguration of the previously approved farmers porch and gazebo.  John Scagliarini motioned to approve the field change.  Approved unanimously.

>Goodman, Michael, SE57-2067- Partial COC for 25 Bog View Road   Gerre Hooker motioned to approve.  Approved unanimously.
