CONSERVATION COMMISSION
MINUTES OF THE MEETING
April 13, 2010
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, April 13, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson and Commissioners James Aimone, John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Absent: Brooke Monroe and Gerre Hooker.
7:15 PM Mass. Dept. of Transportation-Highway Division/District 5. Route 3 north of Exit 4. A Request for Determination of Applicability for the application of herbicide treatment in sensitive area, including wetland buffer zones. Complete project descriptions are available in the Conservation Office.
Tom Maguire, Mass DOT Highway Division/District 5 represented the applicant and described the project for the MA Highway Management Plan. No herbicide within 10 ft. of a wetland. Herbicides are applied to areas only where there is guardrail present.
No public comment.
John Scagliarini motioned to issue a negative determination. Approved unanimously.
7:20 PM Mass. Dept. of Transportation-Highway Division/District 5. Routes 3, 3A, 80, and Plymouth Plantation Highway. A Request for Determination of Applicability for tree trimming and removal within wetland buffer zones. Complete project descriptions are available in the Conservation Office.
Tom Maguire, Mass DOT Highway Division/District 5 represented the applicant and presented the Highway Management Plan, and explained the project for vegetation and dead tree removal along Route 3.
No public comment.
James Aimone motioned to issue a negative determination. Approved unanimously.
7:30 PM Christopher Cummings, 60 Sandy Pond Road, Parcel ID No. 057-000-060B-001. A Request for Determination of Applicability to upgrade the existing septic system within the buffer zone of the top of an inland bank and Great Herring Pond.
No formal presentation was required for this project.
No public comment.
John Scagliarini motioned to issue a negative determination. Approved unanimously.
7:35 PM Garland Nye Realty Trust, 810 Head of the Bay Road, Plat 129 / Lots 2A-1, 2A-2, 2B-1, 3U, 6, 15Z, 16. An Abbreviated Notice of Resource Area Delineation to confirm state and local wetland boundaries, including Bordering Vegetated and Isolated Vegetated Wetlands.
Mark Maganello of LEC Environmental represented the applicant and explained the project. Keith Mann, bog owner was also present. Revised plans were submitted removing the “non-jurisdictional” label on certain wetlands.
Public Comment:
Lawrence McGrath, 186 Lake Drive, Former VP Buttermilk Bay Association and asked about keeping informed of the progress.
John DiCarlo, abutter. Hoped that this project would not take any water from Honeypot Lake (Mare Pond). Mr. Mann said this project would not affect the water level of the pond.
Public comment was closed.
James Aimone motioned to confirm the wetlands, per the revised plans. Approved unanimously.
7:45 PM Lois Krasilovsky, 75 Ellisville Road, Parcel ID No. 053-000-027-073. A Request to Amend the Order of Conditions for DEP File No. SE57-2434 to allow the construction of stairs with landings on the coastal bank.
Lois Krasilovsky represented herself and explained the project to construct a stairway. She noted that the property is under-agreement to be sold, which is the reason for the request. Ms. Krasilovsky also updated the Commission on the homogenous fill project – and photos were shown.
James Aimone motioned to issue the Amended Order of Conditions. Approved unanimously.
7:55 PM Phillip S. Cronin, Manager for Salvelinus LLC, South Street, Parcel ID No. 027-000-062D-000. A Request for Determination of Applicability for low-impact drainage improvements including infiltration basins and rain gardens, construct roadways, grading, landscaping in the buffer zone of an Isolated Vegetated Wetland associated with the construction of a 10-unit inclusionary housing development project known as “Village at South Street”.
Mark Flaherty of FS represented the applicant and explained the project. DEP labeled the site as a shallow marsh fen. 6 lots will be on the street, 4 in the back, total 10 home sites. Drainage onsite, tree box filters with infiltration basins, and various rain gardens are all proposed.
John Scagliarini asked why the parking was in the rear and houses in the back. Mr. Cronin explained that the site grades controlled the project layout.
Public Comment:
Mr. Elmer Lydoff, 39 Leland Way, concern about runoff to his land and septic system, loss of trees and fences around the property. Asked about the height of the fence - 6 feet high is proposed.
Rita Scott, 35B Leland Way. Concerns with the drainage. Mr. Flaherty said there would be no runoff allowed onto neighboring properties.
Public comment was closed.
John Scagliarini motioned to issue a negative determination. Approved unanimously.
Other Business
CERTIFICATE OF COMPLIANCE:
Jari Squire SE57-2291, PCC-07-55 – 196, 197 Bay Shore Drive – Partial COC for work completed at 16 Bayshore Drive, only.
Discussion ensued over the history of the site.
John Scagliarini motioned to issue the COC. Approved unanimously.

MISCELLANEOUS:
The Minutes of the Meeting for October 19, 2009; November 2, 2009 and December 14, 2009, were reviewed.
James Aimone motioned to approve October 19, 2009, November 2, 2009 and December 14, 2009, as written. Approved unanimously.
The upcoming meeting Calendar was reviewed:
Apr 27, May 4, May 18, June 1, June 15 and June 29 have been scheduled for public hearing dates.
The meeting adjourned at 8:45 PM.
