MINUTES OF THE MEETING
March 23, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM Aphrodite V. Briggs Revocable Living Trust, 115A Taylor Avenue, Parcel ID No. 045C-000-112-000.  A Notice of Intent to upgrade the existing septic system within the resource of the coastal dune system of White Horse Beach.  
J. Randolph Parker of LMSI represented the applicant and explained the project for the septic upgrade.  The Board of Health approved of the septic system.  System is a raised system.

Public Comment:
Jean Clinton, 111A Taylor Avenue, concern with the existing underground waterline in the area.  They were told that the water line could be capped and moved but she is concerned the new line would be too close to her property.  Concern for drainage changes.

Janet Lucas, 119R Taylor Avenue, concern with an old system in the area.

Dennis Sullivan 115D Taylor Avenue, would the access to the beach be disturbed.  Randy Parker explained the shift of the boardwalk location.

Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:35 PM Graffam Family Realty Trust,  Darby Station Rd. & Graffam Rd., Parcel ID Nos. 107-000-063-006; 107-000-066-001.   A Request for Determination of Applicability to incorporate pollution preventative sediment forbays for the unpaved Graffam Road, in the buffer zone of a resource area.
Seth Dufour, Outback Engineering represented the applicant and explained the project for the installation of four- bays to collect the runoff from Darby Station Road.  There is no drainage in place, currently.

No public comment.
Gerre Hooker motioned to issue a negative determination subject to MESA review.  Approved unanimously.

7:45 PM James & Virginia Graham, 28 Silent Spring Way, Parcel ID No. 059-000-029-003  A Notice of Intent to construct a 2-story addition to the existing dwelling including deck and retaining wall and for the post-facto construction of a retaining wall with steps.  All work is within the buffer zone of a Bordering Vegetated Wetland of Island Pond.
Mark Flaherty of Flaherty & Stefani represented the applicant.  He gave some brief history of past filings and their pending request for Certificate of Compliance, which remains open..  New filing includes small amount of post facto landscaping work

No public comment.      
Gerre Hooker motioned to approve the project, with conditions.  Approved unanimously.

7:55 PM Charles and Donna Natale, 10 Priscilla Beach Road, Parcel ID No. 044-006-005-000Z.  A Request for Determination of Applicability to demolish the existing open deck and construct a new enlarged deck and for the construction of 2 patio areas, within the buffer zone of the top of the coastal bank.
Charles and Donna Natale represented themselves and explained their project to construct a new enlarged open deck, attached to the existing dwelling.

No public comment.
Gerre Hooker motioned to issue negative determination.  Approved unanimously.

8:05 PM James Matthews, 27 King Philip Road, Parcel ID No. 053-000-020-022.  A Request for Determination of Applicability to upgrade a septic system within the buffer zone of the top of the coastal bank.
Mark Flaherty of Flaherty & Stefani represented the applicant and explained the project.

No public comment.
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

ACTION ITEMS:

> Planning Technician Patrick Farah gave an update regarding the placement of a gate on the Taylor Avenue dunes on White Horse Beach, in order to prohibit vehicle access to the beach.  Only foot traffic would be allowed.  The Commission supported the plan for the construction of the fence at the access point.

> 7:00 – Bill Shaw of Associated Engineers of Plymouth and Joe Balboni to review a potential project in the industrial park (abandoned cranberry bog).  Bill Shaw explained that the 25 ft. buffer zone would be impacted if development went forward.

Dominic Rizzitano, 77 Sanderson Drive.  Requests permission for a row of boulders in front of his coastal bank with a follow-up NOI filing.  He is requesting permission to place a row of large boulders in front of his coastal bank.  Contractors are on the beach working on the Fossile property at 75 Sanderson Drive   Discussion ensued.

Paul Withington motioned to allow a row of boulders including beach nourishment.  Gerre Hooker opposed.  Approved by a majority.

Grant support letter was signed for NOAA/GOMC – Wellingsley Brook project

FIELD CHANGE REQUESTS:
Town of Plymouth, SE57-2462, Nelson Park.  Re: drainage changes.  Approved unanimously.

CERTIFICATE OF COMPLIANCE:
James and Virginia Graham, SE57-1599, 28 Silent Spring Way, SFH.
Gerre Hooker motioned to issue COC.  Approved unanimously.

Judith Varricchione, SE57-1728, Darby Station Road – septic upgrade.
Gerre Hooker motioned to issue COC.  Approved unanimously.

EXTENSION PERMIT:
Eastport Bayside LLC, SE57-2255, 31 Caswell Lane, Plat 12/Lot 62.  Brooke Monroe motioned to issue a 3-year extension.  Approved unanimously.

Mill Pond Realty LLC, SE57-2227.  Order was expired – no action taken.

White Cliffs, SE57-1999, State Road.  James Aimone motioned to issue a 3-year extension.  Approved unanimously.

ORDERS OF CONDITIONS:
James and Virginia Graham, SE57-2472, 28 Silent Spring Way  Gerre Hooker motioned to approve OOC as written.  Approved unanimously.
Aphrodite Briggs Rev. Living Trust, SE57-2473, 115A Taylor Avenue.  Gerre Hooker motioned to approve OOC as written.  Approved unanimously.

MISCELLANEOUS:
Leonard and Janice King, 22 Burgess Road, SE57-2469.  Revised plans per condition. No. 20.  Commission accepted the new plans.

Town of Plymouth, Obery Street, SE57- 2467.  Submission of Landscape Plans, per condition No. 23.  Commission accepted the new plans.

Saquish Beach, Plat 132/Lot 54.  Request to place sand on an empty lot.  Consensus was to take no action and invite the property owner into a meeting.

March 30 – Administrative Meeting – No meeting to be scheduled.
April 13 – Public Hearings scheduled.
April 27 – Public Hearings scheduled.
May 11 – Public Hearings scheduled.
