MINUTES OF THE MEETING
March 9, 2010
The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
7:30 PM Gayle Senter, 38 Taylor Avenue, Parcel ID No. 046-000-007A-009. A Notice of Intent to upgrade the existing septic system in the buffer zone of Bordering Vegetated Wetlands.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Sandy Keese of McKinnon and Keese Engineering represented the applicant and explained the project. It was approved unanimously.
7:35 PM Gail Wheeler, 28 Nameloc Road, Parcel ID No. 054-005-005-005A. A Notice of Intent for the post-facto filing for the repair of the existing gabion basket seawall in the resource of the coastal bank.
No presentation. Staff Elizabeth Sullivan explained the project in which staff authorized the repairs to be made during the Monty Lund project at 36 Nameloc Road.
John Scagliarini motioned to approve with conditions. Gerre Hooker abstained. Approved unanimously.
REOPENED HEARING FOR:
7:45 PM Joseph & Jeanne-Marie Woods, 65F Taylor Avenue, Parcel ID No. 045C-000-035-000. A Notice of Intent to demolish a portion of the existing cottage (currently located within the R.O.W) and to reconstruct a new 3-story dwelling, including amenities and utilities within the property boundaries, in the resource of a coastal dune system of White Horse Beach.
Mark Flaherty of Flaherty & Stefani represented the applicant and explained the project.
Public Comment
Joe Webby represented abutters Finnegans and supported the revised plans.
John Scagliarini motioned to approve the project with conditions. Approved unanimously.
7:55 PM Leonard & Janice King, 22 Burgess Road, Parcel ID No. 100-000-037-014. A Notice of Intent to demolish the existing dwelling and construct a new dwelling, including utilities and amenities-of which only a small portion is within the buffer zone. The project also includes re-construction of a free-standing deck at the water’s edge and the demolition and reconstruction of the
retaining wall within the buffer zone of Little Pond and the placement of a seasonal dock within the resource of Little Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Mark Flaherty of Flaherty & Stefani represented the applicant and explained the project. Most of the work is outside of the Conservation buffer zone. There is an existing deck (in disrepair) currently located in the 25 ft. setback zone that the applicant is requesting to rebuild.
Discussion ensued to relocate this deck that is on the shoreline.
Mark Flaherty withdrew the deck reconstruction proposal from the project.
OOC conditions: Plan will be revised to show drainage concerns and details on the retaining walls and dock will be turned to create a “T“ shaped dock.
No public comment.
John Scagliarini motioned to approve the project with conditions, Approved unanimously.

Mark Flaherty of Flaherty & Stefani represented the applicant and explained the change for a larger home. Field change approved.
MISCELLANEOUS:
85G Taylor Avenue, Map 45C/Lot 126 – Discuss exemption under the bylaw for work within the 25 ft. setback for Gustafson. Commission agreed that property was subject to the exemption and recommended a filing of a Request for Determination of Applicability.

John Scagliarini motioned to approve minutes as drafted. Approved unanimously. Motion was withdrawn
Jaime motioned to approve minutes as amended for the 2/23/10 (correction: extension permit for Kevin Donovan approved by a majority – not unanimous). All other Minutes approved unanimously.
CALENDAR:
March 18 - DEP Appeal Onsite – 10AM Bruce and Love Howard, 7:35 Long Pond Road
March 23 – Public Hearing
Commission continued discussion on changes to the Wetland Rules and Regulations, i.e.,
Section 12 Exemptions is proposed to be eliminated
Create the first 50 ft. buffer zone as a Resource area
The first 25 is no touch, no disturb.
25 to 50 ft. area some things can be allowed, decks, sheds, patios to be determined
0-50 ft. existing structure cannot be enlarged
Vernal pools – create a buffer zone and no build area around certifiable vernal pools
Discussion ensued over the no-touch zones.
35 ft. no build, next 15 ft. will be some allowances.
The meeting adjourned at 10:00 PM.
