MINUTES OF THE MEETING
February 23, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, February 23, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.     
James Aimone was absent.

7:30 P.M.       Public Hearing Begin

7:30 PM Rosemont Realty Trust  Manomet Point Road & Bancroft’s Landing, Parcel ID Nos. 046-000A-042-000, 046-000A-000B-000, 046-000A-000A-001.  A Notice of Intent for the post-facto removal of trees, vegetation, and disturbance and for the planting of new vegetation, within the buffer zone of Bordering Vegetated Wetlands.
Randy Parker and Brad Holmes represented the applicant and explained the project.  He explained that shortly after Mr. Howard purchased the property he began cutting the vegetation down within the buffer zone, unknowingly, without approvals.  Berms are proposed to control runoff into the overgrown cranberry bog and eventually will drain to Scookes Pond, debris will be removed and the area replanted.  Brad explained the reasons for the choice of plant materials.  Several applications of seed mix might be required.  

Public Comment:
Lance Arnold, 17 Victoria Avenue.  Talked about the beach access area not being a problem.  Concern with the cedar trees and the split rail fence that was conditioned by the Planning Board to control dirt bike access is not shown on the plan.  PCC will require a new plan showing the fence.  Concern with the dirt mounds that will be graded and requested permanent boundary markers be in place.  Mr. Parker agreed to pipe-type boundary markers .
Laurel Wilson, Arnold Trust Member and Steve Wilson, Arnold Trust Member, supported the boundary markers.
Closed public comment.

Gerre Hooker motioned to approve the project with conditions.  Motion approved unanimously.

7:45 PM Town of Plymouth –  Gary Maestas, School Department, 41 Obery Street, Parcel ID No. 027-000-059-000.   A Notice of Intent for the demolition of the existing Plymouth North High School building and associated utilities, pavement and concrete and for the construction of a new high school, Council-on-Aging building and Half-time Facility including all associated parking lots, roadways, athletic facilities and other site features.  The portion of construction affecting the Bordering Vegetated buffer zone includes the emergency access road, tennis court and east-side of the proposed school.  


Tom Finnegan of Architectural Involution, LLC and Kerri Parker of Pare Corporation represented the applicant and explained the project.

Kerri Parker began the discussion and gave a brief overview of the entire project. Pare Corp. believes the 2 wetlands to be manmade as there are pipes with drainage easements running to them.  Wetlands were flagged in June of 2009.  All drainage will be contained onsite.  
Minor grading, roadway work and small portion of tennis courts are the only work in the buffer zone.  Erosion control measures will be in place..  

Public Comment:
Richard Tavares, 49 Nook Road, concern with the entrance off Nook Road and the amount of water that comes down the driveway and puddles in the roadway.  Ms. Parker noted more catch basin proposed in the driveway and said there should be an improvement.  Staff advised Mr. Tavares that DPW would be responsible for cleanout of the roadway manholes. He also asked about the location of the Senior Center.

David Lunetta, Obery Street, asked if worked was proposed in the resource areas.  Ms. Parker noted that no work is proposed.

No further public comment.

Gerre Hooker motioned to approve the project with conditions.  Motion approved unanimously.

John Scagliarini would like to see the Landscaping Plan submitted.

Woods, Joseph and Jeanne Marie, 65F Taylor Avenue, SE57-2466

Due to one incorrect abutter notification, the applicant requests that the Commission rescind the Approval of their NOI and a new public hearing has been scheduled for March 9, 2010.
John Scagliarini motioned to rescind the approved Order of Conditions, SE57-2466.  Motion was approved unanimously.
CERTIFICATE OF COMPLIANCE:
Costas Vasilopoulos, SE57-2136, 101 Sea View Drive.  John Scagliarini motioned to issue COC.  Approved unanimously.

William Woodside, PCC-05-46, 39 Scarlet Drive.  Gerre Hooker motioned to approve COC.  John opposed.  Brooke Monroe abstained.  Motion was approved by a majority.

Tidmarsh Farms, SE57-505 Partial COC for 149 Bartlett Road.  John Scagliarini motioned to issue COC.  Approved unanimously.

Michael Goodman, SE57-2067, Partial COC for 18 Bog View Road, John Scagliarini motioned to issue COC.  Approved unanimously.

JO Request:
Cassie Gosselin, Saquish.  Requesting permission to enclose the bottom portion of dwelling.   Gerre Hooker motioned to require an RDA filing, at minimum with a plan showing.  Approved unanimously.

EXTENSION PERMIT:
Kevin Donovan, 20 Nameloc Road, SE57-2243.  John Scagliarini motioned to issue the 3-year extension.  Gerre Hooker abstained. Approved by a majority vote.


ORDERS OF CONDITIONS:
Town of Plymouth-School Dept, 41 Obery Street, SE57-2467.  Gerre Hooker motioned to approved the draft Order, as amended.  Approved unanimously.

Commission was informed of the DEP Appeal Hearing – Bruce and Love Howard, Thursday, March 18, 2010 at 10 AM.

March calendar was reviewed.

March 09 – Public Hearing
March 23 – Public Hearing

Continued discussion of Bylaw Rules and Regulations on March 9, 2010 with the possibility of a public hearing scheduled for March 31.

The meeting adjourned at 9:15 PM.
