MINUTES OF THE MEETING
January 26, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, January 26, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 P.M.       Public Hearing Begin

7:30 PM Ann Briand, 5 Reedville Road, Parcel ID No. 049-003-234-000.  A Request for Determination of Applicability to upgrade the septic system and to construct an addition to the existing dwelling, in buffer zone of a Bordering Vegetated Wetland of Indian Brook.

Steve Rumba of Collins Engineering represented the applicant and explained the project.
The wetland (BVW) is across the street from the project.
4 trees should need to be removed.
No public comment.
Gerre Hooker motioned to issue a negative determination.
Approved unanimously.

7:35 PM Bruce R. & Love A. Howard, 735 Long Pond Road, Parcel ID No. 069-000-059-016.  A Notice of Intent to construct a boathouse, including deck, wooden steps and platforms within an inland beach, bank, BVW and flood zone; construction of a seasonal dock, with amenities, within the resources of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
J. Randolph Parker of LMSI; Adam Brodsky atty. and Brad Holmes of ECR represented the applicant and explained the project.  

John Scagliarini recused himself from the hearing.

Paul Withington gave disclosure that Mr. Brodsky represented family.  Atty. Brodsky confirmed this and agreed that he did not feel it would interfere with Mr. Withington’s judgment in this matter.

Mr. Parker submitted a revised plan in a 20 scale for demonstration purposes.  
He noted that the boathouse remained pile supported for water to pass under and sunlight to filter through.  NHESP response noted that the boathouse would not have habitat impacts and the existing fallen trees could be used by turtles.


New plan showed alternative locations for the boathouse but would require more disturbance to the site.

Comparisons were shown versus the neighboring boathouses, photos and detail plans were also provided.
Ten cubic feet of soil will be removed if the boathouse is constructed as proposed.
If approved, a suggested special condition was provided by the applicant’s representative, Mr. Parker.

Brad Holmes of ECR noted establishment of habitat improvement area will continue to be discussed with NHESP.

Adam Brodsky spoke about the performance standards under WPA and bylaw.
Land under water – perf. Standards met
Inland Bank- perf. Standards met
BVW – replication can be done but healthy vegetation would be destroyed
BLSF – bylaw is no more stringent than WPA
Limited project status is all met
Buffer Zone – need not be followed.


James Aimone supported the buffer zone protection and Conservation staff, Elizabeth Sullivan reminded the Commission that the project was not buffer zone, but was within resource areas.

Discussion ensued over replication.  Liz noted that the applicants say replication is not reasonable and she does agree, but why then should construction of a building be reasonable  
Basking trees for habitat would be the trees that need to be taken down

Public Comment:
None offered.

Bruce Howard, 735 Long Pond Road  - house will be constructed outside the buffer zone and they plan to make this their permanent home.  He stated their intention to work with the Commission but also want to continue to enjoy the pond.

Mr. Parker noted that the applicants have 7 water vessels to protect.

Public comment was closed.
Discussion back to the commission.

Gerre Hooker motioned to approve the seasonal dock, the pathway and one set of stairs and does not approve the boathouse.  John Scagliarini abstained.  Approved by a majority vote.


Other Business:
Evelyn reported the Open Space meeting held last Tuesday evening.  Good turnout.
