Conservation Commission Meeting Minutes January 5, 2010
MINUTES OF THE MEETING
January 5, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, January 5, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
David Foster was called to active military service and will be gone for approximately one year.  Commission will go forward as a 6-member board until the seat is filled.

7:15 PM The Plymouth Conservation Commission will hold a Public Hearing to recommend changes to the Plymouth Wetland Bylaw, Section III Wetlands and Section IV Jurisdiction as they relate to the Flood Zone references in the Wetland Bylaw.  

Liz explained the new FEMA designations.
Public comment:
J. Randolph Parker, precinct 3 town meeting member.  Noted that this change needed to be made to the regulations which the board can approve on its own.
Public comment closed.
Jaime Aimone motioned to support the town meeting change for flood zone designations.
Approved unanimously.

7:30  PM        Al Smith, 114 Warren Avenue, Parcel ID No. 039-000-008-000.  A  Request for Determination of Applicability to demolish an existing covered porch and construct a new one story addition to the existing dwelling with an attached deck and roof deck, in the buffer zone of Eel River.

Marion Angley, 121 Warren Avenue, was concerned that the public notice did not indicate the filing was post-facto.  Staff took responsibility for the error.
Public comment closed.
Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:35 PM Alistair Findlay, 30 Evergreen Drive, Parcel ID No. 050-000-039-731.  A Request for Determination of Applicability to install a new Title V septic system, loam, seed and stabilize the area, in the buffer zone to Bordering Vegetated Wetlands of Lily Pond.  
J. Randolph Parker of LMSI was present for questions.  No presentation was required.
No public comment.
Brooke Monroe motioned to issue a negative determination.  Approved unanimously.

7:40 PM  Holbrook Realty Trust, 67 Old Beach Road, Parcel ID No. 048-049-007-000.  A  Request for Determination of Applicability to install a new Title V septic system, construct dry set retaining wall, loam, seed and stabilize the area, in the buffer zone of the top of coastal bank and coastal beach.
J. Randolph Parker of LMSI was present for questions, although no professional presentation was required.

Public Comment:
Mira Jackson, 10 Foxglove Drive, representing Churchills Landing Association believed that work needed to be 100 ft. from mean high water.  Staff explained the regulations.  

Mike McVane, 90 Beach Avenue.  Asked if the 4-bedroom system could be used if the property was 2-family.  Mr. Parker stated as long as the total bedroom count did not exceed 4.

Gerre Hooker motioned to issue a negative determination.  Approved unanimously.

7:45PM  Kevin Seward, 70 Wareham Road, Parcel ID No. 111-000-035-000U.  A Request for Determination of Applicability to construct a deck, attached to the existing dwelling and to construct a shed, in the buffer zone of an Isolated Vegetated Wetland (cranberry bog).
Zach Bezinski represented the applicant.  No professional presentation was required.
Gerre Hooker motioned to issue a negative determination.   Approved unanimously.

7:50 PM Ronald & Diane Souza, 20 Fuller Farm Road, Parcel ID No. 087-000-057C-000.  A Notice of Intent for the construction of a single family dwelling, including driveway, utilities, and amenities including an in-ground swimming pool, in the buffer zone of an inland bank of Great South Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Zach Bezinski of Bracken Engineering represented the applicant and explained the project.  Work is within Natural Heritage Endangered Species area.  Most of the work is outside of the 100 ft. buffer zone.
No public comment.
Gerre Hooker motioned to approve with conditions.  Approved unanimously.

  • Closed hearing, WPH Nominee Trust, Black Cat Road– A vote needs to be taken.  Gerre Hooker motioned to issue a negative determination.  Approved unanimously.
  • Vote and sign proposed revised floodplain designation to Wetlands Bylaw – to be done following the public hearing.
