MINUTES OF THE MEETING
November 2, 2009
The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, November 2, 2009 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Brooke Monroe and David Foster were absent.
7:00 P.M. Administrative Business
7:30 P.M. Public Hearing Begin
7:30 PM Town of Plymouth, DPW, Recreation Department, 158 Hedges Pond Road & 1095 Long Pond Road (Hedges Pond Preserve). Parcel ID Nos. 055-000-032A-000; 055-000-033A-000; 055-000-034-000. A Notice of Intent to prepare the recreation area for public usage including general cleanup, beach improvement with sand nourishment, placement of a seasonal dock, vegetation/tree maintenance, cabin repairs and driveway improvements. Work occurs within the resource, the buffer zone and outside of the buffer zone of Hedges Pond. A complete project description is available in the Conservation Office.
Barry DiBlasio, Recreation Dept. and Ted Bubbins, Parks Dept. represented the applicant and described the project. Most of the project is cleanup of the site. A new seasonal dock (not currently on site) is proposed and would be located adjacent to the boathouse. The town would operate the camp as a day camp.
No public comment.
John Scagliarini motioned to approve the project with conditions. Approved unanimously.

7:40 PM Henry Goodhue, 739 Long Pond Road, Parcel ID No. 069-000-059-015. A Notice of Intent to construct a boathouse; pathway maintenance with proposed handrail and construction of a seasonal dock within the buffer zone and resources of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Mark Casey of South Shore Survey represented the applicant and explained the project. Staff’s comment was that the plan was not complete and resources needed to be properly delineated.
Public Comment:
Sam Chapin, Morgan Road. asked about the 25 ft. buffer zone in the bylaw.
John Scagliarini motioned to continue the hearing to December 7, 2009 at 7:30 PM for additional revisions to the plan to be made. Approved unanimously.

7:50 PM Bruce R. & Love A. Howard, 735 Long Pond Road, Parcel ID No. 069-000-059-016. A Notice of Intent to construct a boathouse, including deck, wooden steps and platforms within an inland beach, bank, BVW and flood zone; construction of a seasonal dock, with amenities, within the resources of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Letter read to continue the hearing to December 7, 2009 at 7:40 PM. Approved unanimously.
8:05 PM Augustino Diodato, 163 Bay Shore Drive, Parcel ID No. 043-000B-056-000Z. A Notice of Intent for the construction of a single family dwelling, including utilities and amenities, in the buffer zone of Bordering Vegetated Wetlands of small unnamed ponds.
William Shaw of Associated Engineers of Plymouth, Inc., and Attorney John Wyman represented the applicant and explained the project.
Mr. Shaw noted that perc tests for the septic system were completed in July 2009 and passed at a perc rate of 3 min or less.
Dwelling is proposed within the upland area of the 2 small ponds.
A revised plan was submitted downsizing the project to a smaller dwelling footprint (replaces Sheet 3). 1600 square foot foundation footprint.
Boulders in the back of the lot would be removed first.
Grading for the septic system and then installation would occur followed by excavation for the foundation.
Mr. Shaw explained the defining flood elevations and did not need a 100-year flood storm to get to that point – but may happen quite frequently.
Jaime Aimone thought the site was tight for the amount of work proposed.
Mr. Shaw explained the dynamics of controlling the rising wetland and its affect on the coastal bank if not controlled.
John Scagliarini was very concerned with the disturbance of the eco system and the impact of the dwelling construction.
Gerre Hooker confirmed that the large boulders needed to be removed from the site and Mr. Shaw confirmed that they would be.
Brad Holmes, consultant for the Commission, said that these are not typical isolated wetlands due to size and the fact that they do not dry up. .
Staff Elizabeth Sullivan asked for the flood calcs to be provided and Mr. Shaw explained how he got to the numbers.
Revisions should be made to the plan to include:
BVW should be noted on the plan
25 ft. no disturb naturally vegetated buffer zone be labeled.
Public Comment:
Attorney Fred Paulsen, represented abutters Sam and Sue Boutin, and other neighbors .
Steve Ivas, wetland scientist, submitted a letter dated November 2, 2009 and commented on several points.
Mr. Paulsen asked about the bordering land subject to flooding (BLSF) and requested time to get the new material peer reviewed.
Public Comment closed.
Gerre Hooker motioned to continue to December 7, 2009 at 8:15 PM for continued consultant review of the new plans. Approved unanimously.
