MINUTES OF THE MEETING
December 7, 2009

The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, December 7, 2009 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

Absent:  Evelyn Strawn, Chairperson and David Foster. Commissioner

7:30 PM Patricia Hennigan, 119 Taylor Avenue, Parcel ID No. 045C-000-159-000.  A Request for Determination of Applicability to upgrade an existing septic system, in the resource of a coastal dune of White Horse Beach.
Darren Michaelis of Foresight Engineering represented the applicant and explained the project for the septic upgrade.  Gave some brief history of the filing in 2005 that never commenced and has now expired.  A new filing and a new plan is now proposed.  All Board of Health approvals have been granted.

Public Comment:
Janet Lucas, 115 Taylor Avenue, asked to see the location of the system.lot.  She was shown the plan and she was satisfied.
John Scagliarini motioned to issue a negative determination.  Approved unanimously.

7:35 PM MFN, LLC, Off Shallow Pond Lane, Parcel ID No. 073-000-007-135A, 073-000-007R-006, 073-000-015-000.  A Request for Determination of Applicability to construct a roadway including an emergency access road, and associated utilities within the buffer zone of Isolated Vegetated Wetlands and Bordering Vegetated Wetlands to Shallow Pond.  This work is proposed as part of the Hillside Estates subdivision plan.

Brad Bertolo or JC Engineering represented the applicant and explained the project for an emegenecy access road for a 12-lot subdivision,  Road will be used for pedestrian access and emergency vehicles only.   IVW and BVW are present on the site.
22 ft. wide paved roadway and only a portion of the roadway is in the buffer zone and is more than 50 ft. from the delineated resource.  

Initially, John Scagliarini had concern that the roadway could be located in a better area with lesser amount of impacts.  After much discussion about the existing pathway and the steep slopes, commissioners agreed that this was the best location for the roadway and least amount of impact and grading to the lot.  Discussion also showed that work was being proposed on a town-owned lot, that may also need to seek approval for its use from the Town.  

Public Comment:
Pete Stearns, concern with the traditional lot layout and the sensitivity of the site.  He hoped for a better layout to be presented to the Planning Board.  

Scott Hokanson of 68 Shallow Pond Lane supported that the proposed area is the best possible place for the layout.

Agent Liz Sullivan supported the proposed location for the roadway.

John Scagliarini motioned to issue a negative determination with the condition that no permission for the use of town of property is being approved.  Approved unanimously.

7:45 PM Pinewoods Camp, Inc., 80 Cornish Field Rd., Parcel ID No. 069-000-087-001.  A Request for an Amended Order of Conditions for DEP File No. SE57-2372 and Plymouth File No. PCC-08-61 requesting to demolish the existing Camp dressing room building and construct a new Camp dressing room building, with an expanded boardwalk and steps, within the buffer zone of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Sam Chapin of Brown and Caldwell represented the applicant.  Judy Savage, executive director of the camp and Brad Holmes, wetlands expert were also present.

Sam explained the project, series of photos were shown. Series of bvw strip exists between the camp building and the pond that is not disturbed.  

Option A and B were proposed and each was explained in detail.  

Option A was demonstrated on the most recently revised proposed site plan, foot print is the same, with entrance on the side.  The concrete back wall and side wings would be removed.  Rubber tired tractor would be use to remove the wall.  An additional retaining wall would need to be constructed that would be a 5 ft. high, masonry block wall.  A bridge addition would allow for access to the new deck above the building.

Option B would move the building a small amount closer to the pond and would be proposed lengthwise.  This option would leave the existing back concrete wall in place

Mr. Chapin supported Option A, although he noted that from an engineering basis, both options could work.

Public Comment:
None made.

Brooke Monroe motioned to approve Option A.  Approved unanimously.

7:55 PM Edward W. Alusow, 37 Abington Avenue, Parcel ID No. 045B-000-001C-000.  A  Notice of Intent to demolish the existing dwelling and construct new dwelling, including utilities and amenities, in the buffer zone of Bordering Vegetated Wetlands of Bartlett Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Mr. Edward W. Alusow was present if questions needed to be answered.
Staff, Elizabeth Sullivan, gave the overview of the project and said that the work would have no impacts.  A brief discussion with DEP confirmed that a Negative Determination could be issued for this project.
James Aimone  motioned to issue a negative determination.  Approved unanimously.

Jean C. Seeto Realty Trust, SE57-1981.  John Scagliarini motioned to issue COC.  Approved unanimously.
Kevin Foley, SE57-1477.  John Scagliarini motioned to issue COC.  Approved unanimously.
William Woodside, PCC-05-46 (Bylaw only).  Staff explained the dwelling was new construction.  Grade was raised and stone wall was built in the 25 ft. buffer zone.  Discussion ensued over the propane tank that was also installed.  Consensus was that the stone wall had no impact and was needed for the increase grade of the back yard.  
John Scagliarini motioned to deny the COC request until the tank is located outside the 25 foot buffer zone.  Approved unanimously.

ORDERS OF CONDITIONS:
Pinewoods Camp, SE57-2372.  John Scagliarini motioned to approve as written.  Approved unanimously.
Edward Alusow, SE57-2460  An Order of Conditions was not issued – no conditions.  A Negative Determination of Applicability will be issued for this project as all structures are beyond 50 from the resource area and no impacts are expected.

The meeting adjourned at 9 PM.
