MINUTES OF THE MEETING
September 14, 2009
The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, September 14, 2009 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360. Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington. The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
David Foster was absent.
7:30 PM Henry Goodhue, 739 Long Pond Road, Parcel ID No. 069-000-059-015. A Notice of Intent to construct a boathouse; pathway maintenance with proposed handrail and construction of a seasonal dock within the buffer zone and resources of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
An Email from Mark Casey of South Shore Survey was read into the record requesting a continuance to October 5, 2009 at 7:30 PM. Gerre Hooker motioned to accept the continuance to October 5, 2009 at 7:30 PM. Approved unanimously.
7:40 PM Bruce R. & Love A. Howard, 735 Long Pond Road, Parcel ID No. 069-000-059-016. A Notice of Intent to construct a boathouse, including deck, wooden steps and platforms within an inland beach, bank, BVW and flood zone; construction of a seasonal dock, with amenities, within the resources of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
John Scagliarini recused himself from the hearing as he has had professional dealings with the applicant..
J. Randolph Parker of LMSI represented the applicant and explained the project. Mr. Parker noted that comments from NHESP had not been received to date. Concrete bounds existed in the field located at the 100 ft. conservation buffer. Slope is quite steep. To get from dwelling to beach is a switch-back pathway down the slope. A small inland beach is present when water is at its lowest.
Randy discussed the difficulty in keeping with the 25 ft. setback and dealing with the steep slope. The location was chosen so that ample water would move under the structure, no vegetation would be destroyed. Mr. Parker also suggested that the project might be able to be treated as a limited project. Staff noted that the NOI was not reviewed as a limited project and said that the 25 ft. setback would still be required. Mr. Parker further said that the project could be performed in the winter for minimal disturbance to the site. A dry-set retaining wall is also proposed.
Discussion ensued over maintaining the 25 ft. setback. Consensus from the commission was that the 25 ft. setback is required to be maintained. Staff noted that the bylaw could require a 50 ft. setback due to the NHESP mapping of this area.
Public comment:
Ed Russell and Charlotte Russell of 725 Long Pond Road confirmed the steep slope on the bank and asked for discretion be made by the Commission to allow the boathouse. They stated their support of the project. He also noted that the property owners were very sensitive to the site.
Sam Chapin, property owner Long Pond – supported the project stating that site constraints were considerable and were the reason that the 25 ft. buffer zone could not be maintained. He said that mitigation would be pursued seriously and vigorously by the applicant.
Charlotte Charlotte, 725 Long Pond Road are in agreement with the project.
Gerre Hooker motioned to continue to October 5, 2009 at 7:50 PM. Approved unanimously.
7:50 PM William Trueheart, Gurnet Point, Parcel ID Nos. 132-000G-274A-002; 132-000G-274A-003. A Notice of Intent for the post-facto stabilization of an eroding coastal bank which included the placement of compatible fill, stone and vegetation. No representatives were present. Staff member, Elizabeth Sullivan gave an overview of the project. She noted that the filing was a follow-up to an Emergency Permit issued in May, 2009 and that all work was completed at this time and no new work was project. An Order would allow maintenance to continue for the next 3 years. Ms Sullivan also noted that only 2 property owners took part in the filing and the abutting properties would also need to file a Notice of Intent to complete necessary maintenance to their
banks when required.
Gerre Hooker motioned to approve the project with conditions. Approved unanimously.
8:00 PM Henry Larsen, 90 College Pond Road, Parcel ID No. 086-000-011-000. A Notice of Intent for the post-facto construction of a deck addition including stairs in the buffer zone of Hoyts Pond. The project also includes the construction of a seasonal dock on Hoyts Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Brooke Monroe recused herself from the hearing stating that she had professional dealings with the applicant.
Robert Rego of Prime Engineering represented the applicant and gave the history of the project and the improvements that were made. He noted that the work done do date was done without conservation permits. The only work that occurred under the Commission’s jurisdiction is the construction of the deck on the main dwelling, the stairway to the pond and the construction of a deck/pier out over the pond. Discussion ensued over the pier construction and consensus was that the applicant should present photos of a prior desk in that location or to eliminate it from the plan. It was noted that a DEP file number and a response from Natural Heritage was forthcoming.
There was no public comment made.
Gerre Hooker motioned to continue to October 19, 2009 at 7:30 PM. Approved unanimously.
