MINUTES OF THE MEETING
August 31, 2009

The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, 2009 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

7:30 PM 231 Taylor Avenue Realty Trust, 231 Taylor Avenue, Parcel ID No. 045B-000-006-001.  A  Notice of Intent to demolish the existing single family dwelling and construct a new single family dwelling, including amenities and new utilities, in the buffer zone of the top of a coastal bank.
Randy Parker of Land Management Systems, Inc. (LMSI) represented the applicant and explained the project for a complete remodel of the home.  Conceptual sketches were shown.  
No Public Comment was made.
Gerre Hooker motioned to approve the project with conditions.  Approved unanimously.

A Notice of Intent for the stabilization of an eroding coastal bank with the placement of Homogenous Fill (consisting of 1 – 5-ton boulders, cobble, sand and gravel).  Project also includes fill and plantings.  All work is proposed in the resources of a coastal bank and coastal beach.

7:50 PM Mary O’Donnell, 71 Ellisville Road, Parcel ID No. 053-000-027-074.  A Notice of Intent for the stabilization of an eroding coastal bank with the placement of Homogenous Fill (consisting of 1 – 5-ton boulders, cobble, sand and gravel).  Project also includes the reconstruction of the existing coastal stairway, fill and plantings. All work is proposed in the resources of a coastal bank and coastal beach.

7:50 PM Ann R. Rascoe Trust, Ann R. Rascoe Trustee, 79 Ellisville Road, Parcel ID No. 053-000-027-072.  A Notice of Intent for the stabilization of an eroding coastal bank with the placement of Homogenous Fill (consisting of 1 – 5-ton boulders, cobble, sand and gravel).  Project also includes fill and plantings, and construction of a temporary access ramp.  All work is proposed in the resources of a coastal bank and coastal beach.

The chairman, Evelyn Strawn disclosed that although she was not present at the first hearing, she has come into the office and reviewed the tapes and minutes of the past hearing and would take part in these hearings.

Randy Parker of Land Management Systems, Inc. (LMSI) gave a quick update on the project.  He noted that one reason for the continuance was for the neighborhood to begin the formulation of an association.  His knowledge was that this was not accomplished but could form any time and further noted that an association was more a civil issue than a Conservation issue.  The commission agreed.  

All of the work would be done in the winter months with no disturbance to the Landing access.   
There was a small amount of discussion on the ownership of the access, Landing Way, and whether it was private or town-owned.  There was not a clear answer to ownership.

John Scagliarini is not supportive of the hard structures, houses are post 78 and are located approximately 70+ feet back from the back and he believed were not in any imminent danger.  John said that the impacts to the beaches are too great with the loss of sediment to supply them.  

Gerre Hooker was in agreement with Mr. Scagliarini                                   

Public Comment:
Homeowner, Paul Revell of 75 Ellisville Road, spoke about the overflow pipe on his property that takes all of the drainage from 3 surrounding lots and cannot handle it during heavy storms.
 
Dick Driscoll, 76 Ellisville Road, if Town owns the beach and requires a license, he asked if use of the Landing would also need to be licensed for use.  Mr. Parker of  LMSI said that would be the option of the Town.  Staff concurred.  

Homeowner Lois Krasilovsky, 75 Ellisville Road, said they have spent $35K for soft stabilization measures on the bank – all of which have failed.

Kathy McDonough, 56 Ellisville Road, submitted a letter to the Commission on the past storms.

Kevin Feeney, 72 Ellisville Road, town water is available in the area.  Asked about future maintenance trips down the Landing and if this proposal for homogenous fill was a proven method.  Mr. Parker said typically within 10 years stone revetments need repair and that this type of proposal has not been proven to date.  Mr. Parker said that the Landing would need some maintenance for access.

86 Ellisville Road, Maryellen M., confirmed that this was winter work and that no work is allowed between Memorial Day and Labor Day.  The Commission concurred.

Public Comment closed.

John Scagliarini asked Mr. Revell of 75 Ellisville Road why he thought this new method would work as opposed to the softer methods.  Mr. Revell said he hoped that the heavier rock and material would help .

If approved, a condition in the Order for Rascoe and Krasilovsky would be to create a vegetated earthen berm at the top of the bank to control the water runoff over it.

Most of the composition of the bank is sand.

John Scagliarini motioned to deny the project.
Opposed:  Paul Withington, Evelyn Strawn and James Aimone.  
The motion failed.

Paul Withington motioned to approve the project with conditions.  
Opposed:  John Scagliarini and Gerre Hooker.
The motion was approved by a majority.

JO’s:
William Hallisey, 146 Black Cat Road.  Request to pave a driveway.  Discussed ensued.  Consensus was that a filing was required.  
 
James and Paula Banahan, Ryder Way, SE57-2440.  Request to relocate a shed from its present location on the deck and place onto the dune.  Mark Flaherty described the request to move the shed to the dune.  Mr. Flaherty also asked for a compromise that if the deck area that is presently occupied by the shed were to be removed, would the Commission consider that option..   There was no consensus of support on any part of this proposal from the Commission.  Staff did note to Mr. Flaherty that a filing would be required to go forward with the project.  No further action taken.

James Simpson, 196 Black Cat Road, SE57-1476.  John Scagliarini motioned to issue COC.  Approved unanimously.  
Ronald J. Ferioli, 178 Black Cat Road, SE57-2279,  Gerre Hooker motioned to issue partial COC.  Approved unanimously.


EXTENSION PERMIT:
SP Realty Trust, Long Duck Pond Road, SE57-2186.  Gerre Hooker motioned to approve  3-year extension.  Approved unanimously.


ORDERS OF CONDITIONS:
Kathryn Ridder, Saquish Beach, SE57-2444.  Gerre Hooker motioned to approve as written.  Approved unanimously.

231 Taylor Ave. R.T., SE57-.  Gerre Hooker motioned to approve as written.  Approved unanimously.  

Walter Shaw, SE57-2436.  Gerre Hooker motioned to approve as amended with Town license.  Approved unanimously.

Mary O’Donnell, SE57-2437.  Gerre Hooker motioned to approve as amended with Town license,  Approved unanimously.

Lois Krasilovsky, SE57-2434.  Gerre Hooker motioned to approve as amended with berm, with Town llicense.  Approved unanimously.

Ann Rascoe, SE57-2435.  Gerre Hooker motioned to approve as amended with berm, with Town license.  Approved unanimously.
