MINUTES OF THE MEETING
February 23, 2009

The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, February 23, 2009 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners David Foster, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Christopher Brink was absent.

7:00 PM Gunter Erdmann, 102 Shore Drive, Parcel ID No. 050-001-050A-000.  A Request for Determination of Applicability to construct a new Title V septic system, relocate the water line and stabilize area with loam and seed, in the buffer zone of the top of  a coastal bank.
J. Randolph Parker of LMSI represented the applicant and explained the septic system project.
No. public comment.
Gerre Hooker motioned to issue a negative determination.   The motion was approved unanimously.

7:05 PM GP Pines, LLC, 66 Five Lanterns, Parcel ID No. 078C-194A-066-00FL, formerly 078C-000-000A-168.  A Notice of Intent to construct a new single family dwelling, including amenities and utilities, in the buffer zone of Bordering Vegetated Wetlands.
Matthew Varrell, Sr. Environmental Engineer and Kevin Swett, both from VHB represented the applicant and explained the project.  Alan Greene and Dan Greene of the Greene Co. were also present.
Matt Varrell gave brief history of the 5-Lanterns neighborhood that was approved recently.  This is the 3rd home to be built in the neighborhood.  Closest work to the buffer zone involves only grading.  Discussion on the amount of fill to be brought in.
Staff, Liz Sullivan asked if retaining walls were proposed and Kevin Swett said no walls were proposed within the 25 ft. buffer zone.  He did however explain that poured concrete “wing” walls were proposed in the 25 ft. buffer.    Discussion ensued over relocating the dwelling to pull all work outside of the buffer zone.  Dan Greene explained there would be more negative impact to the environment if the dwelling needed to be moved.  He also explained the proximity of the golf course lot line to the dwelling.
Dave Foster asked if footprints for the driveway, decks, patios, etc. were all shown on the plans.  Discussion ensued that the plans did not show all of the work proposed.  Consensus was that revised plans would be required.  Liz Sullivan said because there was so much lacking from the plans, she would suggest a continuance to see revised plans, rather than conditioning these revisions.
Ms. Sullivan also explained the 25 ft. and up to 35 ft. no-build buffer zone for new construction.
Discussion ensued to continue the hearing for a revised plan.  The applicant agreed to the continuance.
No public comment was made.

Gerre Hooker motioned to continue the hearing to March 16 at 7:30 PM.  The motion was approved unanimously.

7:15 PM GP Pines, LLC, Old Sandwich Road, Parcel ID Nos. 078D-000-000A-164 and 078D-000-000A-167.  A Notice of Intent to install a seasonal dock on Clam Pudding Pond including clearing vegetation for a pathway, and a sitting area, in the buffer zone.
Matthew Varrell, Sr. Environmental Engineer and Kevin Swett, both from VHB represented the applicant and explained the project.  Alan Greene and Dan Greene of the Greene Co. were also present.

Matt Varrell began the project review:  Four trees to come down, post type footings for the dock.  They believe minor shading would be created but no mitigation is proposed.  Matt said he believed no chapter 91 was needed because clam pudding was not a great pond.
Evelyn also spoke about the 50 ft. no-work zone.  Discussion over this area.  Consensus was that a natural pathway would be allowable, but the wooden platform sitting area and the dock was a concern.   There was discussion that others on the pond would also want a dock, especially the Great Island Community.
John Scagliarini asked about using the already degraded beach area on the opposite side of the pond.  This location did not seem suitable for the applicants.  

Public Comment:
Reid Blute, VP of the Great Island Homeowners Association asked if this dock would be private to Rebecca’s Landing only.  He also said the pond was small and not conducive to a dock system.  He had always had the understanding that this pond was to remain in its natural state and he stated opposition to this proposal.    

Public Comment was closed.
Gerre Hooker motioned to approve the project with conditions.  
Paul Withington asked for discussion about moving work outside the 50 ft. buffer zone.
Opposed:  Paul, John, Brooke and Gerre opposed.
Evelyn and Dave approved.
The motion did not pass.
Gerre Hooker motioned to deny the project.
Evelyn opposed.
The motion passed.  The project is denied.

7:20 PM MA DCR, Office of Water Resources, Fearing Pond @ Myles Standish State Forest.  A Notice of Intent for the repair of erosion damage and for the construction of steps and paths, in the buffer zone of an inland bank of Fearing Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.

Victor Walker, of the Walker-Kluesing Design Group represented the applicant and explained the
project to control the erosion concerns along Fearing Pond.

Prior to discussion, Chair Evelyn Strawn disclosed that she is a board member of the “Friends of Myles Standish State Forest”, but could still make a fair unbiased decision in this hearing.  The commission agreed.
Victor Walker described the erosion control measures to be undertaken.  Many low-bush blueberries would be planted along the shoreline.
No Public Comment:  
Gerre Hooker motioned to approve the project with conditions.
Approved unanimously.

Continued from January 26, 2009
7:30 PM Jeffrey Fischer, 176 Sandwich Street, Parcel ID Nos. 024-000-010C-000, 024-000-010D-000.  A Notice of Intent to construct a total of five residential buildings, (2 duplex-buildings and 3 single- family buildings for a total of 7 residential condominium homes).  Project also includes construction of utilities and amenities.  Work is proposed within the riverfront area and buffer zone of Wellingsley Brook, within the buffer zone of Bordering Vegetated Wetlands and within the buffer zone of the top of a coastal bank.  Mitigation for the project will include the recording of a Conservation Restriction that will allow the Town of Plymouth access rights and rights to make restoration/mitigation improvements within Wellingsley Brook (to be permitted separately).
Chairman Evelyn Strawn read a letter, dated February 19, 2009 from Gregory Morse, Project Manager, McKenzie Engineering Group into the record requesting a continuance.
Gerre Hooker motioned to accept the request for a continuance to March 16, 2009 at 7:45 PM.  The motion was approved unanimously.

8:00 PM David M. Crawley, 208 ½ Sandwich Street, Parcel ID No. 024-000-008-000.  A Notice of Intent to demolish the existing dwelling and garage and construct new single family dwelling and garage, including amenities and utilities, in the buffer zone of Bordering Vegetated Wetlands.
David Crawley Jr. represented the applicant and explained the project.
Revised plans were submitted by John Farren, PLS.  Brooke Monroe confirmed she had gone onsite with Mr. Farren and also was in agreement with the wetland flags.
No Public Comment was given.
Gerre Hooker motioned to approve the project with conditions.  Motion approved unanimously.
