Conservation Commission Meeting Minutes March 17, 2008
The Plymouth Conservation Commission held its regularly scheduled meeting on Monday, March 17, 2008 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, William Wennerberg, III, Vice chairman and commissioners Christopher Brink, Gerre Hooker, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.
Christine Reardon and John Scagliarini were absent.

7:30 PM Peter Brennan, Environmental Pools, Inc. 36 Rocky Hill Road, Parcel ID No. 043-000-005B-003.  A Notice of Intent for the construction of an in-ground swimming pool, including a spa and other amenities and the construction of coastal stairs, in the buffer zone and on the resource of a coastal bank.  

Attorney for
Gunite- sprayed concrete pool
Cartridge system, no back washing.  Sanitize with salt, that is recycled back into the pool.  Evelyn noted that the apron will be as close as 14 feet.  Discussion ensued over the location of the structure and the requirement for 25 ft setback.
Grass clippings are dumped over the back and the vegetation that has been cut on the bank.
Landings are 4 x 4, final .  An aluminum ladder will be added to the final bottom deck.
Public Comment:
Peter Boucher, 24 Rocky Hill Road, metal pipe drilled into the bank, water irrigates the bank.  No other comments.
Bill motioned to approve the project with conditions.  Approved unanimously.
OOC – move pool to get 25 ft. setback.

7:40 PM Edward O’Connor, 211 and 217 Manomet Avenue, Parcel ID No. 046-000H-009-000 & 046-000H-010-000.  A Notice of Intent for a coastal bank management plan that includes prune, thin, plant and fertilize the bank as needed and maintenance of the stone revetment, as needed, in the resource of a coastal bank.

Bill Shaw of Associated Engineers represented the applicant and explained the project for this ongoing project.  Bill first filed for this in 2000.  
Public Comment:
J. Randolph Parker, 311 Hardy Road of Wareham, MA, and of Manomet Avenue.  Asked about the concrete wall.  Mr. Shaw said it was approved in the 90’s.
William Wennerberg motioned to approve the project with conditions.  Approved unanimously.

Joseph Morse, 134 Stage Point Road, asked if the well and septic were properly spaced from his well.  There is more than 100 ft.
William Wennerberg motioned to approve with conditions.  Approved unanimously.

7:50 PM Hugh Platt, Jr., 128 Stage Point Road, Parcel ID No. 046-000-035A-000.  A Notice of Intent for the reconstruction of a dwelling, including additions and other amenities, utilities, driveway, loam, seed and stabilize the area, in the buffer zone of a Bordering Vegetated Wetland of Scoke’s Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.

ACTION ITEMS:
Great Island residents  re: The Order of Conditions as a result of the cutting violation.  Jack and Diane Merrill came before the PCC and explained that the why they cannot complete the planting plan based on the OOC as written.  They asked the Commission to consider revising their conditions.  The chair, Evelyn Strawn, said that the owner of the property had accepted the Order by its recording on the deed.  Mr. Wennerberg explained that the planting plan could be completed and not to the amount of $$ that the homeowners expected to pay.  The Commission reminded that Merrill’s that this was a violation.  No further action was taken and the Order stands as written.
MISCELLANEOUS:
Duggan, Massasoit Avenue, SE57-2330.  Revised plan per OOC showing no structures within 35 feet of the top of the coastal bank.

Topics for Discussion on new Policies and Regulation changes
Plymouth Wetlands Regulations to the Wetlands Bylaw
March 17, 2008


The purpose of this meeting is to have a brainstorming discussion on which changes the Commission would like to focus on.  Some of the items listed below are merely housekeeping while others are actual changes to the regulations.  The list is not in any certain order.


Ø       Changes to the abutter’s list requirements:  300 ft. vs. 100 ft.
Septic systems require.
Ø       Permit extensions:  case by case or

Ø       Eliminate Policies and add to bylaw.  

Ø       Alternate Conservation Commission members.  Consensus was that it was not needed..

Ø       Beach Nourishment Policy – setting a minimum where erosion rate is zero or accretion

Ø       Increasing the 25-foot buffer zone setback for existing conditions and new development
Discussion to increase to 50 feet.  Get a waiver for a set-back.

Ø       Creating a Vernal Pool buffer zone setback.

Ø       Miscellaneous changes as outlined in the Summary of changes by Wetland Strategies dated 9/20/06.

When  are engineered site plans needed.  Can a plan be recorded on the deed.
Ø       Increase entire fee schedule.   

Ø       Fees for post-facto construction to be doubled
        
Ø       Project Narratives for all projects should be required to be submitted by the applicant
Required for all projects.

Ø       Revised plans should not be accepted the night of a public hearing, unless staff has reviewed and asked for the plan changes.  Revisions to the plan without the staffs review should be an automatically continuance.

Does Zoning need to be submitted before conservation filing.
