ZONING BOARD OF ADJUSTMENT MINUTES
January 31, 2013
Call to Order: 7:00 P.M.
Item One:
ROLL CALL: Present was Joyce Ingerson, James Allen and Tim Fisher; Alternate. Roderick Cole and Chairman; Larry Ordway were excused. Paul Boniface was absent.
J. Ingerson sat in for Chairman L. Ordway. She appointed T. Fisher a voting member for the meeting.
Minutes of October 25, 2012
J. Allen motioned to accept the minutes of the October 25, 2012 meeting, second by T. Fisher.
There was no discussion on the motion and the vote was 1-0-2; J. Allen and T. Fisher abstained.
J. Ingerson explained to the applicant that there are only three members sitting on the Board and all cases heard need three affirmative votes to be granted. She explained that the applicant has the right to ask for a postponement until there are five voting members sitting on the Board. If the applicant chooses to continue with the hearing and it is denied they cannot use lack of a full Board as grounds for a rehearing. She added that if continued, the hearing would be continued to the February 28, 2013 meeting and that no further notifications would be sent. She asked the applicant to tell the Board if they would like to postpone the hearing when the case is called before the Board.
#13-01: A request from Barlo Signs on behalf of IParty for a variance from Article IX, §220-59.A.(2). The request is for a 26 sq ft sign, where 1.57 sq ft is the maximum allowed calculating 5% of the building façade. The property is located at 4 Plaistow Rd, Tax Map 24, Lot 44 in the CI District. The property owner of record is Plaistow Project, LLC.
Present for the hearing was Tim Sullivan, Barlo Signs. He requested the hearing be continued until the February 28, 2013 meeting.
J. Allen motioned to accept the request for a continuation, second by T. Fisher.
There was no discussion on the motion and the vote was 3-0-0 U/A.

There was no other business before the Board; the meeting was adjourned at 7:05 P.M.
