ZONING BOARD OF ADJUSTMENT
January 27, 2011
The meeting was called to order at 7:00 p.m.
Roll Call: Present were Larry Ordway, Chairman; Julie Matthews, Vice Chairman; and Robert Loeffler. Excused were Roderic Cole, Paul Boniface and Joyce Ingerson, Alternate.
Minutes of December 2, 2010
L. Ordway explained that at the January meeting there were not a sufficient number of members present to approve the minutes, but that tonight there are three members who heard the cases and can vote on the minutes.
There was no discussion and the vote was 3-0-0 U/A.
Minutes of January 6, 2011
L. Ordway stated that because there are only two Board members to vote on the minutes; they will postpone this item until the next meeting.
#11-01 A request from Luchy Hidalgo for a special exception under Article X, all sections, to permit a home occupation, namely a massage therapy business. The property is located at 111 Main Street, Tax Map 40, Lot 80, in the C11/VD District. The applicant is the property owner of record.
Present for the application is Luchy Hildago.
L. Ordway stated that because only three Board members are present, she can opt to postpone the hearing until the next meeting if she would like to. He explained that there needs to be three yes votes to pass and if only one Board member votes no, it will be denied.
The question was asked what the options would be if they went through with the hearing and were denied.
L. Ordway answered none as it would be denied. He explained the appeal process and said that denial for less than a five member board is not grounds for appeal, and there was more discussion on the matter.
L. Hidalgo decided to postpone the hearing until the next meeting.
The hearing is postponed until February 24, 2011.
There was no further business before the Board. The meeting was adjourned at 7:10p.m.
