ZONING BOARD OF ADJUSTMENT
March 26, 2009
The meeting was called to order at 7:05 p.m.
Roll Call: Present were Julie Matthews, Vice-Chairman; Robert Loeffler; Peter Bealo; Roderic Cole; and Dan Lloyd, Alternate. Larry Ordway, Chairman, was absent.
D. Lloyd was appointed as voting members for this meeting.
Minutes of February 26, 2009 Meeting
R. Cole moved, second by D. Lloyd, to approve the minutes of the February 26, 2009, meeting. There was no discussion and the vote was 3-2-0 (Loeffler and Bealo abstaining).
#09-03: A request from William Dennis for a special exception under Article X, all sections, to permit a home occupation, namely an office for a wood flooring contractor. The property is located at 333 Main Street, Tax Map 10, Lot 10 in the LDR District.
William Dennis was present for the application. He explained that he would like an office in his home for his wood flooring business, which wouldn’t be much more than a room with a computer in it.
R. Loeffler asked how many employees Mr. Dennis has.
W. Dennis replied that he employees three (3) or four (4) people depending on the workload; half of them meeting at the job site and half at his home.
J. Matthews asked if there was adequate parking for employees who would meet him at his home.
W. Dennis answered there was.
R. Loeffler inquired how long Mr. Dennis had been in this line of work.
W. Dennis responded eleven (11) years.
R. Loeffler asked if there were any materials stored at the home.
W. Dennis replied that he only purchased what as needed for a specific job and it was delivered to the job site.
The Board reviewed the requirements for the granting of a special exception with the following findings:
The business use would be secondary to the residential use of the property
- The business is permitted under §220-66C
- There are no noxious uses by way of noise, odor, dust, fumes or electrical fluctuations, painting equipment is not to be cleaned on the property
- The use of the building has always been residential
- The business will be conducted within the residential dwelling using +/- 7% of the living space
- There will be no indoor storage.
- The business will not change the residential character of the dwelling
- There is no current request for a sign, but the applicant is allowed up to three (3) sq. ft.
- There will be no exterior merchandize displays
- There is sufficient off-street parking; no customers come to the home. There is also a fence to hide the business vehicles said to be two lettered trucks
- There would be no storage of flammable materials in the home
- There are no covenants in the deed that would prevent there from being a home occupation
J. Matthews asked if the Board had any additional questions, there were none. She asked if there was anyone speaking in favor of or in opposition to the application. There was no one and the matter was closed.
DELIBERATIONS:
#09-03: A request from William Dennis for a special exception under Article X, all sections, to permit a home occupation, namely an office for a wood flooring contractor. The property is located at 333 Main Street, Tax Map 10, Lot 10 in the LDR District.
R. Loeffler moved, second by R. Cole, to approve the request for a special exception to allow a home office for a wood flooring business at 333 Main Street.
J. Matthews offered that this was a classic example of a home occupation.
There was no further discussion on the motion. The vote was 5-0-0 U/A.
OTHER BUSINESS – Spring Planning and Zoning Conference
It was noted that the budget only allowed for four (4)) members to attend the OEP (Office of Energy and Planning) Spring Conference in Manchester. The four (4) members who will be attending are L. Ordway, J. Matthews, D. Lloyd and P. Boniface.
There was no further business before the Board and the meeting was adjourned at 7:23 p.m.
