SPECIAL PLANNING BOARD MEETING
October 19, 2007
The meeting was called to order at 1:03 p.m.
Roll Call: Tim Moore, Chairman; Michelle Curran, Selectman Ex-Officio were present. Alternates Neal Morin and Merilyn Senter were also present.
Also present: Leigh G. Komornick, Planning Coordinator.
T. Moore appointed Neal Morin in place of Robert Zukas and Merilyn Senter in place of Steve Ranlett who were unable to attend the meeting.
Consideration for filing of a Request for Rehearing of the decision of the ZBA, (Case
#07-13), that granted the appeal by the Board of Selectmen for an appeal of the
administrative decision of the Plaistow Planning Board regarding the interpretation of
“accept for consideration” in reference to when a plan is protected from zoning
changes. This appeal supported the Board of Selectmen’s interpretation that the
units should be deducted from the unit cap of the elderly housing ordinance at the
time of the preliminary hearing (first legal noticing).
T. Moore reviewed the options discussed with their attorney Wednesday night (10/17/07). Tim explained that due to the possible violation of the RSA’s, and that this represents what should constitute new information, the most logical action would be for the Planning Board to request a rehearing of the ZBA’s decision.
M. Senter made a motion, N. Morin seconded, to proceed with the following:
“To file a request for rehearing by the Plaistow Planning Board of a Notice of Decision on Number 07-13, a request from the Board of Selectmen regarding the interpretation of Ordinance 220-55, Building Cap.”
SO VOTED. All voted in favor except M. Curran who abstained.
Adjournment.
M. Senter made a motion, M. Curran seconded, to adjourn the special meeting at 1:14 p.m.
