The meeting was called to order at 6:33 p.m.
Roll Call: Steve Ranlett; Barry Weymouth; and Michelle Curran, Selectmen Ex-Officio. Tim Moore, Chairman; Robert Zukas Vice-Chairman were excused
Also present: Leigh G. Komornick, Planning Coordinator and P. Michael Dorman, Building Inspector/Code Enforcement Officer.
Minutes of June 7, 2006, Planning Board Meeting
M. Curran moved, second by B. Weymouth, to approve the minutes of the June 7, 2006, meeting. There was no discussion on the motion. The vote was 3-0-0 U/A.
Minor Site Plan Review for “Hot Tubs and More”
It was noted there was no representation for this application. It was confirmed that they were informed that the Board wanted to be able to ask questions that were not clear in the application.
S. Ranlett direction L. Komornick to send “Hot Tubs and More” a letter stating that, due to their lack of response regarding the Board’s request, they would have to re-apply. He also requested that a cease and desist order be sent to discontinue any activities that are not in line with the Planning Board approved site plan.
Continuation of a Public Hearing on a Preliminary Design Review Application for the
redevelopment, redesign and renovations to the Stateline Plaza including the demolition and construction of buildings, drainage, parking and utility improvements and associated landscaping. The property is located at 4 Plaistow Road, Tax Map 24, Lots 44, 45, 46, and 47 totaling 14.96 acres and the frontage is 2,358 (+/-) feet. The owner of record is Plaistow Project, LLC.
At the request of the applicant this hearing was continued to July 19, 2006
Continuation of a Public Hearing on a Lot Line Adjustment and an Amendment to 5 lots of a 15-Lot residential subdivision approved by the Planning Board on August 20, 2003, 64 Sweet Hill Road, Tax Map 62, Lots 40, 41-1, 41-2, 41-3, 41-15 by Ronald Brown. The owner(s) of record is Ron Brown Investments, LLC.
Terry Trudel, SEC Associates, Ron Brown, property owner and Attorney Thomas MacMillan, attorney for Mr. Brown, were present for the application.
L. Komornick reported that she had spoken with T. Trudel regarding the amended site specific permit from the State of New Hampshire, Department of Environmental Services (NHDES), and they had not yet received the approval. She added that Mr. Brown had made it known to her that he wanted to discuss other issues.
T. Trudel explained that he would like to talk about the features of the amended plan and ask the Board to take jurisdiction of the plan.
L. Komornick noted that the application was complete. She added that it would start the sixty-day clock (note: NHRSAs call for a 65-day clock) for the Board to take action on the application.
S. Ranlett read a letter from Phil MacDonald, Underwood Engineers, Inc. (UEI) that stated that the issues the he had with the plan had been resolved with the exception of Shirley Sayewich’s, 66 Sweet Hill Road, driveway. The question was the placement of Mrs. Sayewich’s driveway and whether it would be on Sweet Hill Road, as shown on the amended plan, or in the new Gunstock Road as shown on the original plan.
S Sayewiich said that she would prefer her driveway remain on Sweet Hill Road.
M. Dorman offered that since the house faced Sweet Hill Road that he felt the Fire Department would prefer the house kept the Sweet Hill Road address.
T. Trudel asked that the Board take jurisdiction of the plan, noting they had a request to waiver the road grade requirement.
M. Dorman noted that there was a letter from P. MacDonald offering no problem with the request. He added that Dan Garlington, Plaistow Highway Supervisor, had no issue with the request either.
M. Curran inquired if the waiver request had anything to do with the New Hampshire Department of Transportation (NHDOT) driveway permit.
M. Dorman explained the waiver request was from the Town’s regulation that no road shall exceed a 3% slope. He noted that P. MacDonald’s letter compared Gunstock Road to the existing Greenfield Drive.
M. Curran questioned if the slope would affect the drainage plan.
T. Trudel answered that a new drainage plan had been done and included with the requested amended site plan approval.
M. Dorman noted that P. MacDonald’s comments asked for the NHDOT permit to be resubmitted, questioning whether or not the new driveway permit would all for a decel lane.
L. Komornick explained that if the Board was going to accept jurisdiction of the plan then a full presentation should be done. She added that she didn’t have any information regarding the amended site specific permit but the application was technically complete and could be accepted.
S. Ranlett offered that he was okay with accepting jurisdiction, but he would prefer that the full board be in attendance to address the waiver request and the NHDES issues.
There was discussion of the efforts that have been made by staff and the applicant regarding the “Stop Work” order as well as the submission of the amended site specific permit application.
M. Curran moved, second by B. Weymouth, to accept the lot line adjustment and amended subdivision plan for Brown Hill Estates, Sweet Hill and Gunstock roads, as complete. There was no discussion on the motion. The vote was 3-0-0 U/A.
S. Ranlett read a letter from Attorney Sharon Somers, Donahue, Tucker and Ciandella, PPLC, representing the Greenfield Homeowners Association, suggesting conditions that they would like to see part of any Board approval of the Brown Hill Estates plan.
S. Somers reiterated for the Board that the requested conditions were considered health and safety issues by the Greenfield Homeowners Association.
T. MacMillan, Esquire, attorney for R. Brown, offered that he had discussed the homeowners association’s concerns with Attorney Somers and he felt that the issues could and would be addressed.
S. Ranlett stated that the public hearing was continued to July 19. 2006.
Continuation of a Public Hearing on a Preliminary Design Review application by Fairway Oaks, LLC who proposes to combine Tax Map 58, Lot 6 with a portion of Tax Map 65, Lot 2, and Tax Map 58, Lot 4 and Tax Map 66, Lot 3 for the construction of a 56 unit senior housing condominium complex. Access to this complex will be through the extension of Hillcrest Avenue in Plaistow and a roadway in Haverhill, MA. The total acreage is 23.1 acres and the owners of record are Fairway Oaks, LLC and Richard Riley and Janet Biggart.
S. Ranlett referred to a request from the applicant and stated that this public hearing would be continued to July 19, 2006.
Preliminary Hearing on the consolidation of 4 existing lots and subsequent 8-lot general/light industrial subdivision off of a proposed new road located at 214 Plaistow Road, Tax Map, 45, Lots 1, 2, 3 and 4 totaling 40.5 +/- acres. The owner of record is Fred Miller, Trustee of 214 Plaistow Road Realty Trust.
Ron Pica, RJ Pica Engineering was present for the application.
R. Pica explained the features of the four-lot consolidation to be subdivided to an eight-lot industrial park. He noted that the Board had previously seen preliminary plans for this project, but that there have been issues with soil levels and the backland area that had been formerly used as a gravel pit. R. Pica reported that they had hired a hydro-geologist to review the plan and he understood that the Board would require a peer review.
There was discussion regarding how the engineering review of the plan and the peer review of the hydro-geological study would be handled. It was decided that all engineering review would be done by CLD as this plan was being handled as a new application. It was also decided that due to a previous pledge to use Exeter Environmental Services to do the hydro-geological peer review, they would still be used instead of CLD.
M. Dorman questioned why CLD wasn’t being used for the peer review. He reminded the Board that one of their stated reasons for making the change from Underwood Engineers, Inc., to CLD was that they would be able to provide “one-stop shopping” and be able to review all aspects of a plan.
L. Komornick stated that R. Pica hired the agent to do his study based on the knowledge that it would be reviewed by Exeter Environmental Services.
There was additional discussion as to which firm to go with regarding the peer review.
S. Ranlett suggested that it could be important for the Board to know who would be going in at the site as part of determining the best way to proceed.
Paul Quinn, one of the owners of the property, replied that they didn’t have any specific tenants in mind at this time but the intent was for a light industrial use.
M. Curran moved, second by B. Weymouth, that the peer review of the hydro-geological study for 214 Plaistow Road is done by Exeter Environmental Services with any necessary follow-up be done by CLD. There was no discussion on the motion. The vote was 3-0-0 U/A.
M. Curran asked if the study reviewed all the environmental impacts to the site, reminding that there were issues with the wells on Old County Road.
R. Pica replied that they were testing for all environmental hazards.
L. Komornick added that they had information available from the monitoring wells.
M. Curran stressed that it would be important for any potential tenant to have all that information.
R. Pica noted that the traffic study had been reviewed with the NHDOT and a copy would be submitted to the Board.
L. Komornick offered that it would be sent to CLD for review.
S. Ranlett asked if there were any abutters with questions or concerns. There was no one and the hearing was closed.
Other Business
Copies of a number of correspondences sent by the Department of Building Safety were noted.
Other Business – Atlantic Biodiesel
L. Komornick noted a letter from Atlantic Biodiesel regarding possible occupation of part of the Chart Building at 144 Main Street as part of the Windfield Alloy plan.
Other Business – Zoning Changes
L. Komornick noted a memo regarding upcoming zoning changes that could be considered in the fall.
Other Business – Jay Davey Request for Extension of Approval
S. Ranlett read a letter from Jay Davey, requesting a six-month extension of the deadline by which he must start implementing the approved site plan for 69-71 Plaistow Road.
M. Curran moved, second by B. Weymouth, to extend the deadline by six-months, as requested, for implementation to begin for the site plan at 69-71 Plaistow Road. There was no discussion of the motion. The vote was 3-0-0 U/A.
Other Business
L. Komornick noted that Franklin Realty (Dalton and Barker Streets) had received Attorney General approval of their condominium conversation plan. She added the approval had happened without prior approval by NHDES of the subdivision plan, which requires an alternate water supply, but that Franklin Realty was being cooperative with making that happen.
B. Weymouth offered frustration with not being able to have off-site real estate signs. He noted that he would be suggesting a change of that ordinance in the fall.
M. Dorman noted that off-site signs, in violation of zoning, were currently being picked up and taken to the highway garage for disposal.
M. Curran moved, second by B. Weymouth, to adjourn the meeting at 7:29 p.m. There was no discussion on the motion. The vote was 3-0-0 U/A.
