Planning Board Meeting Minutes
February 12, 2013
1. Call to Order: The regular meeting was called to order at 7:02 PM.
2. Attendance: Members present were, Chair- Dan Peaco, Vice Chair - David McVety, Beth Damon, Alternate - Rick Jackson & Alternate - Stan Brett. (Absent Recording Secretary - Karen Turino & Herb -Olsen) *Motion to move Rick Jackson & Stan Brett up as voting members.

3. Announcement of Quorum: Board had a quorum
4. Approve Secretary’s Report:
A. Regular Meeting Minutes from January 15, 2013 *Motion to accept Sandy’s minutes w/ amendments. BD/DM – Unanimous.
5. Discussion & Comments from public:
A. Kristen Roy: Would like to know if PB will be going through Town Ordinances this evening. DP says after regular business, the ordinances will be discussed if time allows. Kristen asked if she can have input then? DP: Yes, comments are always welcome and taken into consideration.
6. Residence Based Business Applications:
A. Jeremy S. Reynolds, Map R-12, Lot 4¸ Reynolds Repair Service - Auto and Equipment Repair. DP read through application (submitted into public record) BD: if he is not storing anything, how often is he removing liquid waste from premises? How is he heating his building? CEO: not sure, but will ask applicant and report back to PB at next meeting. *Tabled until an upcoming meeting.
B. Sean McGuire, Map R9, Lot 64, McGuire’s Custom Business and Awning - Retail & Service. DP read through application (submitted into public record) BD concerns about boxes being used to store waste, indoor or outdoor? DP questions the sign size dimensions and lighting, and would like CEO to invite applicant to next meeting (March 19th) to be more specific on sign and lighting information.
7. Shoreland Zoning Applications:
A. None.
8. Site Plan Applications:
A. None.
9. Subdivision Application:
A. Russell Ouellette, Represented by Rick Rhea - Tax Map R-5, Lot 033-18 off Evergreen Drive,
Sketch Plan Major Subdivision for 6 lots. This is a 12+ acre lot. All the lots will utilize the existing Evergreen Drive, a private road. Proposing to cross lot 8 for lots to share ROW to the shore. Russell Ouellette also owns lot 8. USGS topo provided and soil boundaries from Conservation Service. Wetlands have been mapped. Moose Pond Shores subdivision was created in 1998. SB: was this property part of the original subdivision? CEO: No, it was part of land remaining after the creation of Moose Pond Shores. From what he can tell from the record file, during the 98 approval, at the last meeting, they agreed to hold some land back that will be common land and will not be developed in exchange for not building stormwater control ponds for phosphorus calculations. They agreed upon 18.13 acres. Lots shown on page 3 labeled A,
B&C total the 18.13 acres. The land shown as remaining has since been transferred. This remaining land of original subdivision is not part of the 18.13 acres that was set aside for the phosphorus to the best of his knowledge. SB: Lot w/ proposed path to the shore is 1.63 acres would that make lot 8 unbuildable? DP will this be deeded into the 6 lots he is proposing. CEO An email to DEP, Mike Morse states this can be buildable. They will be allowed one path to the water for all 7 lots. As long as there is only (1) 6 foot meandering path to the water. They recommend only one dock system. DP suggests Ross Cutlitz or Scott Williams be hired to review this. Do you see any deed covenants on this? Rick Rhea: A restriction against mobile homes is what he thinks will be added, but says it will likely mirror the covenants that is in the rest of the original subdivision. PB reviewed original files. BD noted multiple common driveways were used in original approval. CEO concerned about
phosphorous numbers and how they will work out w/ original Moose Pond Shores subdivision. Rick: Only lots will be sold, the buildings will not be on the lot.. DP: meandering path will need to be addressed w/ engineer as well. CEO: this is just a pre-application. One of the things to think about before engineering work is being done, what level of contour lines you are going to require? *A site walk was scheduled for April 16th @ 5:30 PM. Regular meeting to follow. TT will post Site Walk, but PB members agreed public notification and abutters do not need to be notified for the pre-application site walk. *Tabled until April 16th.
10. Miscellaneous: (WORKSHOP)
Planning Board members considered any ordinances to see if any updates are needed, so they can be put to a Public Hearing before the Annual Town Mtg.
A. BD would like to remove ALL definitions from the ordinances, except for the Definition Ordinance*. We need to physically remove all fees*. DP says PB members would like all updated ordinances printed for their files. *These do not need to go before Town meeting, because it has already been voted upon.
B. Shoreland Zoning Ordinance - under section 15 paragraph O, timber harvesting, delete all current language and insert See Maine Forest Service. *This does need to go before town meeting vote. Discussion about wading bird wetlands not required anymore by MDEP to be designated RP district. KRoy suggested asking the opinion of the conservation committee. DP & TT will bring before BOS at next meeting.

A. Planning Board Meeting March 19, 2013 at 7:00 PM.

13. Discussion & comments from Board:
A. When does a subdivision Sunset: Subdivision Ordinance, Page 17 –section 8.3: Final Approval and Filing
(F) Except in the case of a phased development plan, failure to complete substantial construction of the subdivision within five years of the date of approval and signing of the plan shall render the plan null and void. Upon determining that a subdivision's approval has expired under this paragraph, the Board shall have a notice placed in the Oxford County Registry of Deeds to that effect.
Discussion: A few meetings ago, an old subdivision on Hidden Lake Rd, across from McAllister Rd was shown to the board. Should the Town now file notice at Registry of Deeds and make this subdivision null and void under this section? Any other old subdivisions and/or what is considered a reasonable substantial start? No clear consensus reached.
