Public Hearing Minutes
January 5, 2010
1. Call to Order: The Public Hearing was called to order at 7:00 PM.
- Attendance: Members present were, Vice Chair - Dan Peaco, Mike McAllister, Herb Olsen, Recording Secretary - Beth Damon, Alternate - Karen Turino & Alternate – Dave McVety. (Absent – Chair - Stan Brett)
Code Enforcement Officer: Richard St. John
Planning Board Secretary: Tanya Taft
- Quorum: Board had a quorum.
- Opening statement and introductions: Dan Peaco, Planning Board Vice Chairman explained the reason for this Public Hearing, introduced applicant to the public and turned the meeting over to Wayne Robichaud.
- Regarding:
- Wayne Robichaud, DBA Otisfield Auto Sales at 36 Oak Hill Rd. Tax Map R-09 Lot 049. Wayne: Stated he would like to open a used car lot and Dan Peaco asked if any of the public had questions. One abutter asked if it was going to be for repairs and Wayne responded no. Same abutter asked about disposal of waste and said his concern is that it will be a junk yard with a high amount of traffic. Wayne: It will not be a junk yard, and he does not expect high traffic. There will be little to no waste and it will be discarded appropriately. Another abutter at 56 Oak Hill Rd wants to know operating hours. Wayne: 10 – 6 PM, maybe a little later during summer hours. Dan Peaco, told the public that Wayne has complied w/ everything and has a completed application in front of the PB. Wayne: There will be a sign on the
building and a 2‘ x 2’ at the end of the driveway, which will not be lighted. Existing lighting will be used for general lighting of lot area. Expects to have no more then 30 cars. The Public and the PB members have no further questions.
- Current (2009) Shoreland Zoning Map Changes/ Proposed (2009). CEO: Explained that the original change to Shoreland Zoning Map was approved at Town Meeting in June, but he has since been made aware of 3 changes. The swamp in NE corner of map, not near any roads, needed to have a 250’ RPZ (Resource Protection Zone) around it. CEO notified (5) abutters by certified mail. CEO has received one complaint on the Shoreland Zoning Map via telephone from Mary E. Cullinan Map R6, Lot 21. Her forester representive thinks this is a harsh change and suggests a 75’ SPZ (Stream Protection Zone) around it. CEO has contacted Mike Morse, Maine DEP to help answer her concern. Hal Ferguson: is this challenge going to affect anything? CEO: Hopes to have an answer from DEP shortly, but if not resolved by the Special Town
Meeting will place this on hold until a future date. Another change is the swampy section of Saturday Pond, it should be 250’ but it was erroneously written as 75’. Third change, the outlet stream from College Swamp needed to be in a SPZ. After this Public Hearing it will be placed on the January 20th Special Town Meeting. A copy of the proposed changes have been added to public record.
- Town of Otisfield Definitions Ordinance: Changes/ Proposed (2009) In order to get approval in previous Town meeting it was decided to take the definitions out of existing ordinance and place in one specific Definition Ordinance. The Town has done this. There are four definitions to adjust and a few typos to satisfy MDEP. The definitions that need to be changed are: Foundation, Normal High Water Line, Residential Dwelling Unit and Shore Frontage. These changes should satisfy MDEP. A copy of the proposed changes have been added to public record.
- 6. Adjournment of Public Hearing:
With no further business, the meeting was adjourned at 7:25 PM. MM/DP – Unanimous.
