Heniger Park Reassessment Committee
April 25th 2013
7:00 PM  


1. CALL TO ORDER:  The committee was called to order at 7:00 PM.

2. ATTENDANCE:  Members present were Selectmen Hal Ferguson, Rick Micklon and Lenny Adler. The additional committee members included Karen Turino, Judy Hall, Craig Turner, Anne Pastore and Kyle Jordan. Absent were Administrative Assistant Marianne Izzo-Morin and Recording Secretary Tanya Taft.
NOTE: Six members of the public / Heniger Park lease owners also attended.    

3. SECRETARY’S REPORT:
A.  Meeting Minutes from the March 21, 2013 meeting were approved at the April 3, 2013 Board of Selectmen Meeting.

4. NEW BUSINESS:
A. Karen Turino and Craig Turner reported that they had contacted two realtors, for a market analysis of Heniger Park lots, and had done a site walk with each of them.  
 
1) Caldwell Banker - Lakes Region Properties - Sara Dolan Goodwill.
Estimated that the less desirable lake front lots would bring $185,000 to $200,000 and that the better ones should bring up to $245,000. Back lots would be in the $30,000 to $40,000 with the value being somewhat higher with lake views and sandy beach access.
2) The Maine Real Estate Network - Michael C. Quinn
Estimated the lake front lots at $180,000 and the back lots with deeded access to the two beaches at $60,000.

B. Hal Ferguson reported his conversations with Geoff Hole the Town Attorney. Geoff had discussions with several other attorneys within the firm and it is their belief that it would not be wise to pursue the sale of any of Heniger Park based upon the wording of the will of Jacob Heniger. This includes the lot/parcel across from Jacobs Way & Route 121, the land referred to as Heniger Park (recreational trails, etc.) and the leased lots. Legal advice is to not read the recorded will as this land being “saleable” by the Town of Otisfield.

C. After considerable discussions the committee agreed that:
1) Sale of lots would not be an option
2) To develop a lease agreement that would be used for the 37 lots including the one not currently leased.
3) To include the use of the two beaches in the applicable leases.
4) We should use whatever the full assessed value of each lot as the starting point from which the value of each lease will be determined. This amount will be updated to reflect any changes in the mill rate, plus an additional amount to be determined (at a future meeting).

D. Committee Members agreed to be prepared to discuss the length of future leases and the dollar amount to be added to the assessed value of each lot, at the next meeting.

E. Hal Ferguson will obtain the assessed value of the remaining twenty-six lots from the town assessor for the next meeting. (Eleven were previously done)

5. UPCOMING DATES:
A. Heniger Park Reassessment Committee Meeting: Thursday, July 18, 2013 at 7:00 PM in the Annex.
