Board of Selectmen Meeting Minutes
August 18, 2010
1. CALL TO ORDER: The regular meeting was called to order at 7:00 PM.
Hal Ferguson, Chairman; Rick Micklon and Lenny Adler were present.
2. FLAG SALUTE
Audience and Board members saluted the flag.
3. SECRETARY’S REPORT:
A. Meeting minutes from August 4, 2010. *Motion to accept minutes. HF/LA– Unanimous.
4. SPECIAL EVENTS
A. Community Hall Construction bids: *For background: RM developed the bidding and specification sheet. There was a motion at a prior meeting to use the funds that were appropriated at town meeting for the Community Hall "upgrades" while safety and maintenance issues will come from Building and Grounds Accounts. *LA rescued himself from discussion @ 7:16PM because one of the bids was from his son. He returned at 8:15PM. *Bids were opened @ 7:15pm. Two (2) bids were received
JL Adler Carpentry: Bid $6,295.00 & Dyer’s Camp & Cottage Service: Bid $14,714.64 - With the understanding that $1,000 can be deducted for Lead testing.
RM asked both if they were lead certified. Jim Adler: Not at this time. Sent in for the certification and is signed up for next Friday’s class, but does not believe he needs to be lead certified for this job. Garry Dyer is certified, but he did not test to see if there was lead. *All board members agree that the town will pay someone to come in and do the lead testing and if it’s deemed positive JL Adler will get certified or will contract someone else to do it.
*Garry Dyer has withdrawn his bid as he feels that some items were lacking in details or vague.
*Motion to approve and accept JL Adler Carpentry of Andover, Maine for $6,294.00 not to include the testing for lead and asbestos nor asbestos abatement. RM/HF – Unanimous. *Bids were closed at 8:15PM.
5. COMMITTEE REPORTS:
A. None.
6. DEPARTMENT HEADS:
A. Dan Peaco – Town Sexton: Updating the Cemetery portion of web site and would like Cemetery to have its own Tab. BOS agreed. TT will update on site. New Policies, Rules and Regulations that were in Town Report need to be added. In new policies, there are some definitions that should be written out and placed in the Definitions for the ordinances or placed on the new policy for clarification. Home burial Ordinance was not in Town Report – New Policy did not take the place of and Dan would like to see that this goes back in. *TT & DP will work together to update this part of web site.
7. QUESTIONS/COMMENTS FROM THE PUBLIC:
A. Pat Hines who resides on Moosewa trail, which is listed as a T/P (Town/Private) Road, wants to know if it’s possible to have her road plowed by the Town? LA: The State of Maine prohibits the use of town vehicles on private property, only exceptions are: if it’s damaging natural resources, if the FD needs a road plowed to get in quickly or an emergency vehicle needs to get in.
B. William Kennedy, who resides at 36 Bow Street: Believes he has a safety hazard with the culvert in front of his driveway. Culvert needs to be replaced as it is above ground several inches and the bolts are exposed. Called Richard Bean last fall, but has had no further discussions. BOS will ask Richard Bean to have this resolved.
8. ADMINISTRATIVE ASSISTANT ITEMS:
A. Heniger Park Lease extension; Peach, Lot 3B Lease expires 08/01/2020. Verbiage about leasing will be added “The Town of Otisfield makes no representation that the lease will be extended beyond the expiration date”. *Motion to sign the 4th and final extension. LA/RM – Unanimous.
B. DEP permit received for Garrett & Eileen Klingler DBA Mooseledge Camp Map R8 Lots 034E & 035, Map R9 lot 43 - Residential Wilderness Camp. The PB made a Motion to allow construction of driveway with two conditions 1) They have written approval from DEP and 2) CEO would oversee construction of driveway.
9. ADJUSTMENTS TO AGENDA:
A. None.
10. UNFINISHED /SCHEDULED BUSINESS:
A. Fee Schedule annual review. *Tabled until next meeting. *PB suggestion Re: dropping RBB application fee submitted into public record for next meeting.
B. E.O / Community Hall well discussion: Harley Johnson has recommended that we change to put in a larger
reserve water tank at Fire Station and the BOS approved this.
C. Town Office Annex (former class room) Radon update: Air and Water Quality gave the original 2009 radon mitigation quote , and were asked to resubmit a price and timeline The blocks behind the building will be removed and the crawl space will be cleaned out. When that is done the price from a year ago will be honored.
D. Scribner's Mill Bridge update.*Tabled until inspection comes in.
E. Robinson Dam Update: HF and Dan Peaco are the Otisfield town members on the Committee and will be attending the initial meeting in Oxford on 8/23rd. No site walk scheduled at this time. Ross Cudlitz, P.E has already provided his report. More information to come at a later date.
11. SELECTMEN’S ITEMS TO BE DISCUSSED & VOTED ON:
A. *Motion to sign Warrant # 3 to pay the town bills. HF/LA – Unanimous.
B. Oxford County Commissioners Budget Committee discussion.
12. QUESTIONS OR COMMENTS FROM THE BOARD
A. Capital investment plan- John Maloney said he could wait.
B. Performance appraisal review & executive session will be scheduled for next meeting.
C. Signatures: HF has researched weather or not MIM can sign checks for investment purposes. He found that either she can sign everything or nothing at all. *Motion to add MIM’s name to be a signature for the Town of Otisfield.
D. Additional items for calendar will be sent to TT from RM so that it can be updated and brought to next
meeting.
E. Jared Jacobs: RM would like the town to recognize and send Jared a letter of congratulations. Rick informed public that there was an article in the paper for receiving a Good Citizen Award last week and Jared was student of the year. RM will draft a letter.
