1. Call to Order: The meeting was called to order at 5:35 PM.
2. Attendance: Members present were: Chair- Anne Pastore, Vice Chair - Marianne Izzo-Morin, Recording Secretary/Alternate – Don Mixer, Janet Douglas and Don Verrill. (Absent - Sharon Matthews)
Richard St. John – Code Enforcement Officer
Tanya Taft – Secretary
BOS Present: Chairman -Hal Ferguson, Rick Micklon and Lenny Adler
3. Quorum: Board had a quorum.
4. Secretary’s Report:
A. Meeting Minutes from July 10, 2012. *Motion to accept minutes. MIM/JD – Unanimous.
B. Meeting Minutes from May 29, 2012. *Motion to accept minutes. MIM/DV – Unanimous.
C. Meeting Minutes from November 12, 2012. *Motion to accept minutes. MIM/DV – Unanimous.
D. Meeting Minutes from Public Hearing Nov. 15, 2012. *Motion to accept minutes. MIM/DV Unanimous.
5. Administrative Appeal
A. None.
6. Appeal for a variance
A. None.
7. Discussion and comments from Board:
A. There has been a Request for Reconsideration of the Board of Appeals decision from November 15, 2012, Board of Appeals Mtg. regarding the Cell Tower. It is coming from Kristen Roy on behalf of The Friends of Scribner Hill. BOA Chair Anne Pastore requested this be placed on this agenda.
MIM: Threshold matter before us is the timeliness of this request for reconsideration which was submitted on Nov. 29 with an amended request submitted on Dec. 3rd.
Discussion: MIM: Title30-A subchapter 5 § 2691 Board of Appeals paragraph #3 Procedure,subparagraph F- A request to the board to reconsider MUST be filed within 10 days of the decision that is to be reconsidered.
The public hearing on the FOF of the PB was on Nov.15th and the decision was given that night.
*Motion that the board finds that the request was made more than 10days after the decision therefore the Appeals Board cannot consider the request. MIM/DV – Unanimous.
Anne Went down the Board members: DM – Agrees, JD - Agrees, AP – Agrees, MIM - Agrees, DV - Agrees.
AP: Thank you FOSH, this shall be sent back to the court, anything further will be settled in court.
