Board of Appeal Minutes
July 22, 2010
Meeting

1.      Call to order:  The meeting was called to order at 7:01 PM.

2.      Attendance:  Members present were Don Verrill - Chair, Marianne Izzo-Morin - Vice Chair, Annie Pastore - Recording Secretary, Sharon Matthews & Janet Douglass. (Absent – Beth Clark)

3.      Quorum:  Board had a quorum.

4.      Secretary’s Report: None.

5.      Discussion & Comments from public:
A.      None.

6.      Administrative Appeal:
A.      None.

7.      Appeal for a Variance:
A.      Richard Negus, Map U8, Lot 4, Appeal for a variance, for reduction in Shore line setback. Darryl Brown, Maine Land Dev. Consultants, Inc. and Richard Dunton, Engineer from Maine Land are representing Richard Negus. Lot was created in 1956 and applicant became the owner on May 12, 1999.  The lot is small; approximately 150 feet long by 100 feet wide and has shore frontage on Thompson Lake.  DEP has already approved a Permit by Rule. (PBR).  Submittal package has been provided into public record. CEO: as far as the septic system is concerned, it’s good to go as designed on a adjacent lot with deeded access rights. AP: how many trees will be removed? Darryl Brown: Drive way is already there, the buffer will be left as is. Cannot say for sure how many trees will be cut. CEO: it will be a very small foot print around the building, for the Planning Board will need to approve how small. They do not have permission to go any further then what they have already been approved for. Worst case is no cutting allowed within 25’ of shoreline except to remove hazard trees. Erosion sediment control plan should be provided to the CEO.   A 4’ wide meandering path is what applicant may create to get to water. Road set back concern - land is now considered to have a driveway, and per our ordinance there are no set backs for driveways. This is why he is not applying for a road set back. Ken Bartow: Abutter to the south side of property: Ken is in favor of this application, it’s going to be handled properly and he has confidence in the Town to over- see this. Good drainage soil, but it will be a challenge. Only concerns: a well was intended, but there is a line in the ground anticipating a future well. Placement of septic tank on that property, may help to have it sealed. No indications of a drilled well at this time. The minimum required setback distance between tank and well is 60 feet. A one piece septic tank is another level of protection. CEO: Monolythic tank is what is needed. Septic pump line will go under the existing driveway.  Site walk is requested by board members. Thursday, July 29, 2010 @ 6:30 PM. The Board will address the 4 Hardship Criteria at the next meeting following the site walk: *Tabled until next meeting.
