Work Meeting, Tuesday, March 23, 2010
PRESENT: Steve Phillips, Adrienne Pfluger, Bob Royce, Judith Bruce, Acting Chairman; James Trainor, (Members); Jamie Balliett, Jim O’Brien, (Associate Members); and Jennifer Wood, Conservation Administrator.
ABSENT: Arnold Henson, Chairman; and Harry Herrick, (Members).
The Meeting opened at 8:30 a.m.
CONTINUATION
Mary Allen Bradley, 4 Etta’s Way by Ryder & Wilcox, Inc. The proposed construction of a detached garage/studio & a flagstone patio & walkway. Work will occur within 100’ of a Coastal Bank. David Lyttle, from Ryder & Wilcox, Greg DeLory, the Architect, Teresa Sprague, from Wilkinson Ecological Design, and Mary Allen Bradley, the Applicant, were present. Mr. Lyttle said the Plan has been revised to show removal of more of the driveway and improvements to the vegetation. The proposed garage will be 1,098 square feet and the pervious flagstone patio and walkway will be 650 square feet. The overall proposed increase in building and structure is 1,748 square feet. As mitigation, 750 square feet of lawn is proposed for naturalization on the eastern side of the dwelling. 870 square feet is proposed for native restoration on the western side of the proposed garage and studio. Mr. Lyttle said 410 square feet of driveway, 144 square feet of a concrete pad, and 180 square feet of a
brick walkway are proposed for removal. This is a total of 2,354 square feet of improvements. Ms. Sprague said the English ivy is the most intense on the western boundary. They will replace the ivy with native groundcovers. A shrub layer will be planted underneath the existing canopy. They are going to add 2 understory trees in the western portion of the lot. On the eastern side, they are proposing to take up existing lawn, and replace it with groundcovers with an understory layer of native shrubs. Ms. Sprague said they are also going to remove other invasive shrubs—honeysuckle and the bittersweet on the bank.
MOTION: A motion to approve this project was made by Jim O’Brien and seconded by James Trainor.

CERTIFICATES OF COMPLIANCE
Haskell (Quinn) 2005, 10 Locust Road. This is a Certificate of Compliance request for an Order for a dwelling that was conditioned on a Mitigation Planting Plan and also to remove debris from a wetland. An As-Built Plan has been submitted showing a slightly larger deck and 3 air-conditioning units. The debris has been removed from the wetland but only a grassy buffer has been put in, not a shrub border. An open area has been left in the plantings around the culvert for the Highway Department to service the culvert. The heavy growth within the buffer zone is grasses, not shrubs. The Owners understand the wetland cannot
be mowed. There will be a Continuing Condition on the Certificate of Compliance to reflect the No-Mow Zone adjacent to the wetland.
MOTION: A motion to release this Certificate of Compliance was made by Jamie Balliett and seconded by Adrienne Pfluger.

Peedin (Scott) 1995, 40 Gibson Road. This is a Certificate of Compliance request for an Order for a dwelling. An As-Built Plan has been submitted showing the current configuration of the shell driveway, an additional stonewall off the northeast side of the dwelling, and that the existing shed and propane tank have been removed. They have filed a Notice of Intent to be heard on April 6, 2010 for additional work.
MOTION: A motion to release this Certificate of Compliance was made by Bob Royce and seconded by James Trainor.

Michael Schumaecker (2005), 161 Monument Road. This is a Certificate of Compliance request for an Order for vegetation restoration, an addition, two decks, and a stairway. The addition and one of the decks were not built. They have filed a Notice of Intent to be heard April 6, 2010 for the addition. The plantings are doing well.
MOTION: A motion to release this Certificate of Compliance was made by Bob Royce and seconded by James Trainor.
VOTE: Unanimous.
ADMINISTRATIVE REVIEWS
Pochet Property Owners Association, Pochet Road. This is a request to realign and level 20’ of existing raised bridge and the entire span of walkway without a railing. This Application includes introducing 4 pairs of 6” x 6” supports at the start of the walkway that are much longer than the existing pilings for stabilization. The work will be done by Anchor Marine. There has been a great deal of damage due to the recent storms. This is a repair. The walkway and the bridge have become twisted and the Applicants want to stabilize the bridge with longer posts, as the original pilings are too short. Jamie Balliett asked if the height will be increased? The Conservation Administrator said it was not requested. James Trainor said this is a safety issue.
MOTION: A motion to approve this Administrative Review was made by Jamie Balliett and seconded by Adrienne Pfluger.

Richard Beaulieu, 33 Herring Brook Road. This is a request to replace a pier, including the pilings, according to the License. The work will be done by Ames Marine and is a repair.
MOTION: A motion to approve this Administrative Review was made by Jim O’Brien and seconded by Adrienne Pfluger.
VOTE: Unanimous.
Tom Heiser, 27 Carlton Road
Clifford Hampton, 40 Carlton Road
This is a request to reinstall the top row of gabions displaced by a recent storm to its original height and contour, not to exceed the original elevation. The gabions on the beach will be picked up and reinstalled. Gabions that have lost their rocks will be replaced with larger rocks. Replenishment of the lost portion of the toe will be with compatible sand fill, approximately 20 cubic yards. The area will be replanted with native grasses such as beach grass and stiff-leaf quack grass. No regrading or contouring of the hillside or removal of any other vegetation will take place. Access will be via the East Egg project 19, 21 Little Bay Road during the construction of their gabions. The work will be done by Anchor Marine. Steve Phillips asked if there were stairs to the beach? James Trainor said yes, and they are damaged. A
filing should be submitted in the future to repair the stairs. Judith Bruce asked that a note be added to this Administrative Review to replace the gabion baskets if they are broken.

Robert Payne, 71 Towhee Lane. This is a request to replenish the toe of the bank with clean compatible sand fill and plant beach grass. Approximately 100 cubic yards of fill will be used. Access will be via the adjacent level lot owned by the Applicant’s brother. Sand fill will be dumped at that lot and transported with a rubber tire front end loader and placed on the toe of the bank. The work will be done by Anchor Marine.

Town of Orleans Parks & Beaches Department, Nauset Beach. This is a request to build a 12’ x 25’8” addition to the Park Department office building at Nauset Beach. The addition will be located over existing pavement. Dave Lyttle, from Ryder & Wilcox, said this will provide additional office space for the Sticker Program at the beach. The addition will be constructed over existing asphalt pavement. It will be one-story, and elevation views drawn by Rich Morongell, the Architect, have been submitted. The addition will be constructed on a concrete slab that was previously an impervious surface.

William Garner, 176 Namequoit Road. This is a request to upgrade the septic system. The limit of work extends within the 100’ buffer from the top of a coastal bank for piping, and for filling and abandoning the old system. The limit of work is also slightly within 100’ to an old bog that is a Certified vernal pool.

Robert Campbell, 76 Freeman Lane. This is a request to remove one red cedar that is ready to fall over at the bottom of the coastal bank. The work will be done by Bruce McCutcheon.

VOTE: Unanimous.
CHAIRMAN’S BUSINESS
Judith Bruce requested a Discussion on our Regulations pertaining to changes in the structure qualifying the building as new construction. She would like to include information from the State Building Code. James Trainor said the formula used in the Building Department determines what should be upgraded. If a footprint is not being expanded, what difference does it make? Ms. Bruce was also concerned about sump-pumps discharging directly into water bodies, and oil burners below the flood elevation.
Approval of the Minutes from the Hearing/ Work Meeting on March 16, 2010.
MOTION: A motion to approve the Minutes from the Hearing/Work Meeting on March 16, 2010 was made by James Trainor and seconded by Jim O’Brien.
VOTE: 5-0-2 Approved (Adrienne Pfluger and Jamie Balliett abstained).
The Site Visits were discussed by the Commissioners.
