Work Meeting, Tuesday, January 26, 2010


PRESENT:    Steve Phillips, Adrienne Pfluger, Bob Royce, Arnold Henson, Chairman; Judith Bruce, Vice-Chairman; Harry Herrick, James Trainor, (Members); Jamie Balliett, (Associate Member); and Jennifer Wood, Conservation Administrator.

ABSENT:  Jim O’Brien, (Associate Member).

The Meeting opened at 8:30 a.m.                                 

CONTINUATIONS
Edward & Anne Ghory, 19 Brick Hill Road by Ryder & Wilcox, Inc.  The proposed construction of a second-story addition & patio onto an existing dwelling. Work will occur within 100’ of the Edge of a Freshwater Wetland.  Russell Holden, from Ryder & Wilcox, and Patricia Crow, from Hadley Crow Studio, were present. Mr. Holden said the Site Plan has been revised, January 20, 2010, to show a proposed step on the western side, a landing and step off the southern side of the garage, and a shed, bulkhead, and entry deck to the north. The deck on the southeast wing will be removed.  The landing and step is for a slider in that location. There will be 2 steps down to the patio. Arnold Henson asked for the increase in square footage?  Mr. Holden said the increase in structures within 50’ would include the step on the western side with 12 square feet and the landing with 24 square feet, making a total of 36 square feet of increased coverage.  An existing deck totaling 30’ is being removed from the 50’-buffer, and if the patio is included it would be 95’ of new coverage.  Within the 75’-buffer is an additional step, shed, and bulkhead with 78’ square feet of coverage.  Ms. Crow said 1,650 square feet of vegetation mitigation is proposed.  On the east side a number of native shrubs are proposed for an area that will no longer be mowed, creating a 25’-buffer from the edge of the water. On the west, the vegetated buffer would increase by 10’.  Ms. Crow said she has added a Narrative for the removal of invasive species.  There are so many they would need to be replaced with natives.  Ms. Crow said this area is partially underwater at times during the year. Arnold Henson asked why lawn is shown within the wetland?  Judith Bruce said they cannot continue to mow into the wetland.  They don’t need to plant large trees, but they should stop mowing in the wetland.  She asked if they could limit the mowing to 10’ from the dwelling?  Ms. Crow asked if they could plant sedges? Ms. Bruce said that would be a start.  James Trainor asked if the new slider goes out to the new landing? Mr. Holden said yes, they are going to convert part of the garage to storage space.  The garage is going from a 2-car garage to a 1-car garage.  Ms. Crow said summer furniture will be stored in that area, and the slider is for easy access.  Arnold Henson asked that the planting in and within the buffer to the wetland be expanded.  Adrienne Pfluger asked about a proposed path to the pond? Ms. Crow said she would consider adding one.  Mr. Holden said he would rather have the distance off the edge of the wetland rather than the dwelling.  Judith Bruce suggested a 15’-wide increased buffer from the edge of the wetland, with a pathway through it.  Jenny Wood said the Site Plan only shows a small piece of the wetland, however the wetland continues to the street and should be shown in its entirety on the Site Plan.  

MOTION:  A motion to continue this Hearing to the Meeting on February 9, 2010 was made by Judith Bruce and seconded by Adrienne Pfluger.

VOTE:  Unanimous.   

Richard & Jo Ann Hinckley, 5 Sparrowhawk Road by Ryder & Wilcox, Inc.  The proposed construction of an addition onto an existing dwelling. Work will occur within 100’ of the Edge of a Freshwater Wetland. Russell Holden, from Ryder & Wilcox, passed out a Narrative for invasive species removal to go with the Landscaping Plan by Wilkinson Ecological Design.  There is a mixture of native shrubs, grasses and wildflowers proposed for a buffer to the edge of the wetland.  Arnold Henson asked for the square footage increase within 75’?  Mr. Holden said 260 square feet.  Judith Bruce asked where they were going to relocate the hot tub?  Mr. Holden said he is not positive.  The Commissioners asked that the hot tub be relocated at least 75’ from the wetland.  Arnold Henson said the lawn area is not shown on the Site Plan.  Mr. Holden said the bordering vegetated wetland comes to within 1’ or 2’ of the lawn.  Jenny Wood asked how near to the dwelling the buffer planting would come?  Mr. Holden said about 15’ to the proposed deck. They are adding 20’ of vegetation from the bordering vegetated wetland.  Steve Phillips asked if all the stairs were shown on the Site Plan?  Mr. Holden said there are 2 proposed steps from the deck.  Jenny Wood said meadow areas are not easy to establish.  She asked if the existing grass would be pulled out?  She said she needs a Narrative with a timetable on how they are going to accomplish this meadow planting?  She asked who would do this work?  Mr. Holden said the Applicants have not hired a Landscaper yet. Steve Phillips said he would like to see a line delineating the buffer planting on the Site Plan.  To release the Order a new Site Plan must be submitted showing the edge of the buffer planting.  The Order will be conditioned that the hot tub be completely removed or relocated outside the 75’ buffer.  

MOTION:  A motion to approve this project, conditioned as mentioned above, was made by Judith Bruce and seconded by Steve Phillips.

VOTE:  Unanimous.   

REVISED PLAN
Richard Cryer (2009), 52 Willie Atwood Road.  This is a request to revise an Order for an addition to include a 1-kilowatt wind turbine on the ridge of the main dwelling. The windmill will extend 10’ above ridge height. Timothy Holmes, from Sun Wind, LLC, said the mast pipe will stick up from the taller gable on the existing dwelling.  Arnold Henson said this will look similar to a TV antenna. Judith Bruce said although there is a view from a public beach, this will not be a problem.  The Abutters have been notified by the Zoning Board of Appeals. James Trainor asked if, at minimum, the turbine could be 2’ above the peak of the house?  Mr. Holmes said the Manufacturer requires 2’ at minimum for clearance, and a maximum of 3’.  This turbine will have a 3’ space and will be
7’-tall for 10’.

MOTION:  A motion to accept this Revised Plan was made by Judith Bruce and seconded by Harry Herrick.

VOTE:  Unanimous.   
 
ADMINISTRATIVE REVIEWS
Betty Dee Kling, 168 Quanset Road.  This request to remove 1 large cherry tree was held from last week to see if a replacement tree could be planted. The Applicant is willing to replant a tree.

MOTION:  A motion to approve this Administrative Review was made by Judith Bruce and seconded by Bob Royce.

VOTE:  Unanimous.   

Ed and Lisa Guariglia, 9 Herring Brook Way.  This request was held from last week for more information. The request is to dig and remove pachysandra, and install drywells for drainage from the roof greater than 50’ from the top of a coastal bank. The Applicants also want to prune 3 limbs on a large oak that are growing over the building next to the top of the coastal bank.  

MOTION:  A motion to approve this Administrative Review was made by Steve Phillips and seconded by Harry Herrick.

VOTE:  Unanimous.   

Richard Thompson, 24 Priscilla Road.  This is a request to remodel an existing carriage house, including a full dormer on the south side within 32’ to a freshwater wetland. There is already a dormer on the north side which may also be changed. A deck is proposed on the north side within 55’ to the wetland. A
3-story tower is proposed on the west side with tool storage on the first floor, a closet on the second floor, and an observation room on the third floor over an existing foundation within 57’ of the wetland. 1 to 2 cedars are proposed to be removed on the north.  Jenny Wood said the Site Plan submitted with this Application is an older delineation. There are 2 wetlands on this property and it does not show a buffer to the Isolated Land Subject to Flooding.  There is also an Order without a Certificate of Compliance at this location.

MOTION:  A motion to approve this Administrative Review was made by Judith Bruce and seconded by Adrienne Pfluger.

VOTE:  0-7-0 Denied.  The Applicant must file a Notice of Intent.   

Bill Risko, 46 Locust Road.  This is a request to remove 3 trees and prune one limb of an oak approximately 60’ from the edge of a bordering vegetated wetland.  

MOTION:  A motion to approve this Administrative Review was made by Bob Royce and seconded by Harry Herrick.

VOTE:  Unanimous.   

Judith Bruce, 26 Towhee Lane.  This is a request to cut down 2 out of 5 dead pitch pines 60’ from the edge of the bordering vegetated wetland along Shoal Pond. The Applicant also wants to remove 10 to 15 bush honeysuckles and multiflora roses and replace those shrubs with virburnum, shad bush, and swamp azalea in the buffer to Shoal Pond east of the dwelling.  (Judith Bruce recused herself from this Application.)  

MOTION:  A motion to approve this Administrative Review was made by James Trainor and seconded by Adrienne Pfluger.

VOTE:  6-0-1 Approved (Judith Bruce abstained).   

CHAIRMAN’S BUSINESS
Approval of the Minutes from the Hearing/Work Meeting on January 19, 2010.

MOTION:  A motion to approve the Minutes from the Hearing/Work Meeting on January 19, 2010 was made by Adrienne Pfluger and seconded by Bob Royce.

VOTE:  Unanimous.  

The Site Visits were discussed by the Commissioners.

The Meeting was adjourned at 9:15 a.m.
