Hearing, Tuesday, September 15, 2009


PRESENT:  Steve Phillips, Bob Royce, Judith Bruce, Acting Chairman; Harry Herrick, James Trainor, (Members); Jamie Balliett, and Jim O’Brien, (Associate Members).

ABSENT:  Adrienne Pfluger, Arnold Henson, Chairman; (Members); and Jennifer Wood, Conservation Administrator.                                   

The Meeting opened at 8:30 a.m.

NOTICE OF INTENT
Kenneth & Diane Hrobsky, 42 Willie Atwood Road by J.M. O’Reilly & Associates, Inc.  The proposed construction of a screened-in porch addition & front entry roof overhang. Work will occur within 100’ of an Intermittent Stream. Matt Farrell, from J.M. O’Reilly, said there is a bog to the northeast.  An underground pipe runs northwest to the intermittent stream.  Mr. Farrell said this proposal is for a screened-in porch constructed on 8 sonotubes and a 7’ x 3’ covered entryway added to the front of the dwelling.  The proposed work will be within existing lawn areas with no removal of vegetation for this project.  Judith Bruce asked about the delineation for the area of the wetland plants to the northwest?  Mr. Farrell said he did a soil boring in that area but he did not submit any data.  There was groundwater at 25” in the observation pit, with mottling, but but Mr. Farrell said this is not a wetland.  He will submit his documentation on the observation pit for the file.  Steve Phillips asked if there were 2 sets of stairs?  Mr. Farrell said there is an existing set of stairs off the existing deck. 1 set of stairs will be removed. Mr. Phillips asked if the deck was going to be altered?  Mr. Farrell said they will cut into the deck to fit the new addition.  The only set of steps will be coming off the front of the new screened-in porch on the south side to the ground.  James Trainor asked if the steps off the new addition were within the 25’ property line setback?  Mr. Farrell said yes, but there is no roof and the steps are less than 3’ in height so there are no Building Code problems.  Judith Bruce asked about the septic system?  Mr. Farrell said there is only an old I & M Inspection Report showing a septic tank in the Health Department.  He said he didn’t know about the leaching field, but the Owner said it is to the northeast, behind the dwelling, close to where the tank is located.  Water was found 2’ below grade in the lowest part of the yard, at elevation 32. Judith Bruce said she is concerned this lot may need a new leaching field.  Mr. Farrell said the only available room for a leaching field is within the southwest corner of the lot outside the buffer zone, but the property is lower over there.  The system would have to be elevated, with a pump chamber from the tank up to the field.  Judith Bruce asked for the total square footage of the addition?  Mr. Farrell said 441 square feet, with the roof overhang over the porch, the steps, and the entry way that is 24.5 square feet.  Ms. Bruce asked if the porch would be a 3-season porch?  Mr. Farrell said no, just screened in.  Steve Phillips said on the Site Plan the new addition is referenced as a sunroom.  Mr. Farrell said that is an error.  Mr. Phillips asked about dry wells directed to downspouts?  Mr. Farrell said that could be a Condition on the Order.  Judith Bruce asked if the large patch of English ivy could be removed?  Mr. Farrell said he would mention this to his Client.  Judith Bruce said this is a difficult lot as it is very wet.  Mr. Farrell will confirm his figures for the square footage of the proposal and submit them for the record.  Steve Phillips said the existing deck needs repair.  Mr. Farrell said there is no proposal for that now.  

MOTION:  A motion to approve this project, conditioned on dry wells directed to downspouts to catch the runoff from the new addition, and the Commission’s recommendation to remove the large patch of English ivy, was made by Steve Phillips and seconded by Harry Herrick.

VOTE:  Unanimous.

REQUEST TO USE CONSERVATION PROPERTY
Sea Call Farm, Cooking Show, Thursday, September 17, 2009.  Judy Welch, Channel 17 Public Access TV, has requested to film a cooking show in the Sea Call Farm House with several of the Sea Call Supporters. Ms. Welch carries her own insurance. The cooking and service of food is not open to the public so that a Temporary Food Service Permit is not required.  JoAnna Keeley and John Faulkner, Sea Call Farm Supporters, were present.

MOTION:  A motion to approve this activity at the Sea Call Farmhouse was made by Steve Phillips and seconded by Harry Herrick.

VOTE:  Unanimous.   

CERTIFICATE OF COMPLIANCE
Joseph White (2007), 46 Arey’s Lane.  This Certificate of Compliance request is for an Order for restoration work at the Commission’s request. The area has been replanted and is doing well.  There is a bond for $15,000 that will be released with the Certificate of Compliance.

MOTION:  A motion to release this Certificate of Compliance was made by Jamie Balliett and seconded by Steve Phillips.

VOTE:  Unanimous.

MOTION:  A motion to release the Performance Bond for the above-referenced property was made by Bob Royce and seconded by Harry Herrick.

VOTE:  Unanimous.

REVISION TO THE PLAN
Jeanne and Richard Berdik (2009), 150 Quanset Road.  This Order for vegetation restoration and to repair the foundation of the barn has requested a revision to the work on the barn foundation. Instead of foundation piers, they propose to build a concrete block wall to support the barn. Bob Royce asked if there would be a change in the drainage around the barn?  Steve Phillips requested more information on the drainage issues.  This request will be placed on hold for the Builder to come in next week and answer the Commission’s questions.   

ADMINISTRATIVE REVIEWS
Nancy Durie, 64 Freeman Lane.  This is a request to prune tree branches that are overhanging the dwelling and the powerline along the driveway. This dwelling is between two high coastal banks.  This is a maintenance pruning.

MOTION:  A motion to approve this Administrative Review was made by Jamie Balliett and seconded by Harry Herrick.

VOTE:  Unanimous.   

Orleans Conservation Trust (OCT) &Timothy Earle, Tar Kiln Road.  This is the second year of a 3-year request to hand remove phragmites in the creek leading out of Uncle Seth’s Pond. Plant material will be composted on the upland property of Timothy Earle. The work will be done by volunteers, including members of the OCT, the Hook Fisherman’s Association, and the Americorps.

MOTION:  A motion to approve this Administrative Review was made by Harry Herrick and seconded by Bob Royce.

VOTE:  Unanimous.
