Work Meeting, Tuesday, February 24, 2009


PRESENT:  Adrienne Pfluger, Bob Royce, Bill Parish, Vice-Chairman; Arnold Henson, Chairman; George Christie, Harry Herrick, (Members); Steve Phillips, James Trainor, Jamie Balliett, (Associate Members); and Jennifer Wood, Conservation Administrator.

ABSENT:  Judith Bruce, (Member).

The Meeting opened at 8:30 a.m.                                 

CHAIRMAN’S BUSINESS
Approval of the Minutes from the Hearing/Work Meeting on February 17, 2009.

MOTION:  A motion to approve the Minutes from the Hearing/Work Meeting on February 17, 2009 was made by Bill Parish and seconded by Bob Royce.

VOTE:  6-0-1 Approved (Adrienne Pfluger abstained).

REQUEST TO CHANGE PLANTING PLANS
Martin and Elaine Benante (2008), 121 Lake Drive.  A Planting Plan to improve the resource area was approved as mitigation on this Order for an addition within the ACEC.  A new Planting Plan with a new Landscaper, Peter Due of Estates Landscape and Maintenance, has been proposed. No large trees, other than the large locust removed for the addition, will be removed with the new Plan. Bittersweet, multiflora rose, autumn olive, privet, and ivy will be removed and/or wiped with an herbicide. The new Plan includes removal of ornamentals and invasive species in two additional areas: next to the house and to the west. It also includes a new walkway and the rebuilding of a dog run. Heather is proposed near the dwelling which is not a native species, but does not spread. There are some young oaks, bayberry, and cherries in this area. The new Plan differs from the approved Plan with shrubs, instead of small trees and shrubs on the bank with the revetment. There are also young oaks on this bank, a cherry, and several cedars. 7 red cedars are proposed to the east in the new Plan vs. 13 small trees and 10 shrubs on the approved. The understory will be planted with groundcovers and beach grass on the first bank.  The Conservation Administrator said there are some existing native trees and shrubs that are not shown on the Plan that should remain on site.  Arnold Henson said within the resource area, the existing native species must remain.  Peter Due asked about removing small locusts?  The Commissioners agreed to the removal of small locusts.  There will be an additional Condition with this Planting Plan that the native species must remain.    

MOTION:  A motion to approve these changes to the Planting Plan, conditioned as mentioned previously, was made by Bill Parish and seconded by Bob Royce.

VOTE:  6-0-1 Approved (George Christie abstained).    

Alan and Beverly Grieco (2008), 8 Hayward Lane.  A Planting Plan by Wilkinson Ecological Design was accepted December 9, 2008 to comply with the Enforcement Order for unauthorized clearing in the 100’ buffer and the ACEC. A Contract with Wilkinson Ecological Design and the Applicant has been submitted to the Commission in lieu of a Performance Bond.  Seth Wilkinson, from Wilkinson Ecological Design was present.  Arnold Henson asked about the time frame if replacement plants were required?  A Performance Bond is held for 3 years to cover the replacement of plants that die.  Mr. Wilkinson said the guarantee for plants to be replaced at no cost is 1 year, but he would agree to monitor this site for 3 years and have this written into his Contract.  Mr. Wilkinson said he recommended a temporary irrigation system be installed for the second year.  There is an existing irrigation system for the plants near the dwelling and the new system would be connected into that.  He will speak to the Applicants about including a 3-year Plant Maintenance Program in his Contract.   

ADMINISTRATIVE REVIEW
Town of Orleans, Parks and Beaches Department.  This is a request from Paul Fulcher, the Superintendent of the Parks and Beaches Department, to fill in large holes with sand within the ORV Vehicle Track on Nauset Beach.

MOTION:  A motion to approve this Administrative Review was made by Bill Parish and seconded by George Christie.

VOTE:  Unanimous.

The Site Visit was discussed by the Commissioners.

The Meeting was adjourned at 8:41 a.m.
