Notices of Intent
Herbert Gullquist 24 Indian Fort Hill Lane
by Ryder & Wilcox, Inc. Assessor’s Map 76, Parcel 44. The proposed construction of an addition to an existing deck. Work will occur within 100’ of the Top of a Coastal Bank & within the Pleasant Bay ACEC.
Eleanor Fischer 62 Barley Neck Road
by Ryder & Wilcox, Inc. Assessor’s Map 43, Parcel 101. The proposed installation of a septic system to serve an existing dwelling; & the removal of the existing system. Work will occur within 100’ of a Bordering Vegetated Wetland.
Leo Morrissey 3 Longstreet Lane
by Ryder & Wilcox, Inc. Assessor’s Map 16, Parcel 11. The proposed installation of a septic system & relocation of a water service to serve an existing dwelling; the pumping & removal or filling with sand of the existing system. Work will occur within 100’ of an Inland Bank & within Land Subject to Coastal Storm Flowage.

William Reiher (2005) 7 Richwood Farm Lane
Order for a single-family dwelling that was built as shown on a revised Plan greater than 75’ to a freshwater wetland. There has been no vegetation work beyond the limit of work toward the wetland. There are air-conditioning units next to the house and there are open mulched areas that haven’t been planted. One area was planted with Rosa rugosa.
Marion Kaiser (2008) 46 Gibson Road
Order for landscaping and stairs down the coastal bank, a portion of which is elevated. Near the front of the dwelling the low fieldstone wall and picket fence were not built. This Order is conditioned on the plants surviving on their own after 3 years which would be 2011. It was also conditioned on native species and erosion control fabric used on the coastal bank if necessary. No erosion control fabric was used on the steep bank. Grass is coming up on the bank but it is a Contractor’s mix of rye grass and fescue, not a native mix.
Nauset Marine East (2003) 235 Main Street and 37 High Tide Lane
This Order was to repair existing piers and pilings, a concrete boat launching ramp, and a low timber retaining wall. A section of the pier supporting the gas pump was raised to be above the water level. This is a commercial dock and the piers and floats remain in the water all year. The Applicant requested Continuing Conditions for the Zone of Reconfiguration and maintenance of the pier. Maintenance of the pier should be consistent with the current Regulations. As for the Zone of Reconfiguration, a Condition the same as the one on Arey’s Pond Boat Yard’s docks could be added--“The reconfiguration may be proposed by a Revised Plan however, should the Conservation Commission not approve a proposed reconfiguration by way of a Revised Plan, and the Applicant chooses to proceed with the reconfiguration, than the Applicant
must file a Notice of Intent for formal review and approval.”
Neal Cotton/McHugh (1976) 68 Keziah’s Lane
Order for second dwelling is built as shown with later additions and decks to both the main dwelling and the second dwelling built under RDs. The flood elevation on the old site plan is shown at 8’ and it is now 13’. The 100’ buffer is shown from the marsh and would now be extended to the coastal bank near both the dwellings. We do not have a current delineation. Under the old delineation two sheds, a patio, and changes from a large deck to steps on both the main dwelling and the second dwelling would be greater than 100 feet to the marsh even if they are now within the Commission’s jurisdiction. There are several stairways and 3 decks that were built within the Commission’s jurisdiction under the old delineation. One deck has a post on the beach and in over the marsh, another is very near the beach and the
3rd is near the house. I did not find any filings for these decks. There is also a boat rack. There are invasive species planted on this site including myrtle, ivy and bamboo.
Neal Cotton/McHugh (1994) 68 Keziah’s Lane
Order for a dock is built as shown on the License except for the two floats are one long one. On-Going Conditions for Docks will remain on the COC.
George Najarian (2004) 115,123 Freeman Lane
Order for vegetation restoration filed at our request under an Enforcement Order for clearing. There are native rushes coming in along the pond shore and groundsel shrubs. The plantings that were put in, including red maples and shrubs, are sparse but surviving in the large area that was cleared along the road. No work including pruning or weed whipping should go forward in this area without further filing. The vegetation is very dense further along the drive. A Plan by Wilkinson Ecological Design cleared around the new plantings in 2006 and planted several other areas nearer the house. The request to release the Bond for this project is below.

George Najarian 123 & 115 Freeman Lane
Bond of $7,000 was held for the restoration of a cleared area (See request for a COC above).
William and Shelly Conway Municipal Road Layout/Skaket Beach Road
Bond of $2500.00 was held for the removal of invasive species and replacement of native species. Work within 25’+ of the wetland has been completed. Other trees have been tagged within the buffer and not removed. The Tree Warden intends to continue working in this area if permitted under a new AR at a later date.

Proposed regular road maintenance-- filling in pot holes and regrading the road from Ellerslie Road to the fork in the road by the Brier Driveway. Work by AMA Excavating.
Elliot Johnson 85 Brick Hill Road
Proposed drilling of a well next to the garage slightly greater than 50’ to a ditch. Work by Desmond Well Drilling, Inc.
Norma Sullivan Trust 142 Namequoit Road
Proposed construction of a 3 to 4’-wide footpath through naturalized vegetation inside a 10’-wide right-of-way on10 Viking Road. It does not look like a path was ever in this area. There is a path near the water that is partly on the right-of- way and partly on 136 Namequoit.Road. 10 Viking Road has an in-ground stairway. Some steps may be needed on the right-of-way. There is no letter in the file from the Owner of this property--10 Viking Way. There is no record in the file of any attempt to share part of an existing pathway. Neighbors should be notified of this work. This property is for sale.
Pleasant Bay Narrows Trust Davis Road and Bart’s Way
Proposed installation of underground electric, telephone, and cable TV. The trench excavation would be 2’-wide and 2½’-deep along the edge of the existing dirt road and paved road and would include the installation of 2-4” PVC pipes, the trench would be immediately back-filled. This work is within 50’ of the resource area and would require a variance unless it is a replacement. Mike Lasordo is the supervisor. We still have not received the requested information for the 4 outstanding Orders on this property. Ryder & Wilcox offered an As-Built with profiles of the revetment area and stated that they understood that the old Orders must be cleared up before any new filings. On December 2, 2008, Mr. Emerson was asked for a written statement of the work that went forward on these Orders which has
not been submitted. A 3-Year Profile in September 2009 is necessary to release the newest Order on the gabions.
Town of Orleans Kent’s Point
Removal of 5-10 invasive trees from the old house site at Kent’s Point by the Parks and Beaches Department.
Request for a Revised Plan
John Laurino (2008) 27 Blue Heron Way
Request for a Revised Plan and Variance showing a12’ x 6’ entranceway addition within 50 feet of the top of the coastal bank. The Order was filed at our request for vegetation alteration.
Request for Revision to the Site Plan
Jack and Marcia Sortor (2006) 30 Pershing Lane
Order to remove and build a single-family dwelling has presented a Landscaping Plan for greater than 100’ to the top of a coastal bank that includes a more gradual driveway. They have proposed to eliminate the catch basins that had been approved for the driveway. All of this work is greater than 100’ to the wetland except for the removal of some pavement. No trees will be removed within the 100’ buffer for this Landscaping Plan. The Order is conditioned for more trees if necessary and this revision to the plan will not change that Condition.
