OLD LYME ZONING COMMISSION
SPECIAL MEETING
November 3, 2010, 6:00 P.M.
Memorial Town Hall
52 Lyme Street
Convene Meeting; present and voting were regular members, Jane Cable, Chairman, Jane Marsh, Secretary (who arrived at 6:09 p.m.), Tom Risom, Vice Chairman, Pat Looney and John Johnson
Also present: Ann Brown, Zoning Enforcement Officer, Kim Barrows, Zoning Assistant, and counsel for the Zoning Commission Mark Branse and Eric Knapp
Absent: Ted Kiritsis (alternate), Beth Sullivan (alternate) and Joan Bozek (alternate)
The Chairman stated that all of the members of the Commission present will be voting. If any members come in after a proposed Executive Session, if one is called, they will be admitted as well.
Chairman Cable then called the meeting to order and asked for a motion to go into Executive Session to discuss pending litigation, including more than one written notice to the Commission in which demand has been set forth for legal relief or which asserts a legal right stating the intention to institute an action before a court if such relief or right is not granted by the Commission.
The Chairman then invited the Board of Selectmen to join the meeting and be a part of the Executive Session. The following members of the Board of Selectmen were present: Tim Griswold, Bonnie Reemsnyder and Skip Sibley.
The Chairman, then asked for a motion to go into Executive Session. The following motion was made:
A Motion was made by J. Johnson, seconded by T. Risom to go into Executive Session at 6:07 p.m. and to allow those seated at the table to be included in the Executive Session. A vote was taken: In favor: J. Cable, T. Risom, J. Johnson, P. Looney In Opposition: None Abstaining The Motion passed unanimously.
The Zoning Commission members and those invited to attend went into Executive Session at 6:07 p.m.
Regular member, Jane Marsh, arrived at 6:09 p.m. and was a part of the Executive Session.
The following vote was taken to come out of Executive Session at 7:26 p.m.:
A Motion was made by J. Johnson, seconded by T. Risom, to leave the Executive Session at 7:26 p.m. A vote was taken and those present came out of Executive Session.
Chairman Cable stated that during the Executive Session those present made no decisions, took no votes, and no action was taken.
First Selectman, Tim Griswold asked counsel present that if a routine matter came up between the Board of Selectmen and the Zoning Commission if one attorney could handle the matter. Counsel responded yes, as long as it was a routine matter.
John Johnson asked if the matter discussed tonight could be put on the agenda for the November 8th meeting for discussion. The consensus was yes, that it could be placed on the November 8th agenda.
The Chairman asked for a motion to adjourn. A Motion to adjourn was made by J. Johnson, seconded by T. Risom to adjourn the November 3, 2010 Special Meeting. The motion passed and the Special Meeting was adjourned at 7:30 p.m.
