SPECIAL MEETING
October 18, 2010, 6:00 P.M.

I. Convene Meeting; present and voting were regular members, Jane Cable, Chairman, Jane Marsh, Secretary, Tom Risom, Vice Chairman, Pat Looney, John Johnson, Beth Sullivan (alternate, not voting) and Joan Bozek (alternate who arrived at 6:37 p.m. not seated to vote)
Also present: Ann Brown, Zoning Enforcement Officer, Kim Barrows Zoning Assistant
Absent: Ted Kiritsis (alternate)
II. Introduction of attendees and announcement of who will be admitted into an Executive Session to discuss threatened litigation.
A Motion was made by J. Johnson, seconded by T. Risom to allow those seated at the table to be included in the Executive Session. Discussion: J. Cable asked that those seated at the table announce their names for the record: Ann Brown, Zoning and Wetlands Enforcement Officer, Michael Cronin, Esquire, Town Counsel for the Town of Old Saybrook, Dave Royston, Esquire, counsel for the Zoning Board of Appeals, Skip Sibley, Selectman, Eric Knapp, Esquire, counsel to the ZEO and the Zoning Commission, Mark Branse, Esquire, same, Tom Risom, regular Zoning Commission member, Pat Looney, regular Zoning Commission member, Beth Sullivan, alternate, Zoning Commission, Jane Cable, Chairman of the Zoning Commission, John Johnson, regular Zoning Commission member, Jane
Marsh, regular Zoning Commission member, Kim Barrows, Zoning Assistant, Marylin Clarke, Esquire, Town Counsel for Old Lyme, Bonnie Reemsnyder, Selectman and Tim Griswold, First Selectman. Further discussion: J. Cable stated that J. Bozek thought that having Attorney Mike Cronin present would conflict with the attorney/client relationship since he is Town Counsel for Old Saybrook and not affiliated with Old Lyme. J. Cable stated that she did not agree and the other members agreed with her. A vote was taken: In favor: J. Cable, T. Risom, J. Marsh, J. Johnson, P. Looney In Opposition: None Abstaining The Motion passed unanimously.
III. Executive Session to discuss threatened litigation regarding the seasonal dwelling registry.
Those present attempted to go into Executive Session, but was interrupted by a Mr. Jay Ranelli who stated that the Commission could not go into Executive Session since the agenda stated “threatened” litigation not pending litigation in accordance with Connecticut General Statutes 1-208.
Those present went into Executive Session at 6:10 p.m.
A Motion was made by J. Johnson, seconded by T. Risom, to leave the Executive Session. A vote was taken and those present came out of Executive Session at 7:30 pm. No action had been taken.
IV. Adjournment
A Motion to adjourn was made by J. Johnson, seconded by T. Risom and the October 18, 2010 Special Meeting was adjourned at 7:33 p.m.
