OLD LYME ZONING COMMISSION
MINUTES OF PUBLIC HEARING
Monday, November 10, 2008
The Old Lyme Zoning Commission held a Public Hearing on Monday, November 10, 2008 at 7:31 p.m. in the Auditorium of Memorial Town Hall. Members present were Tom Risom (Chairman) Jane Cable (Vice Chairman), Jane Marsh (Secretary), John Johnson, and Patrick Looney. Also present was Ann Brown, Zoning Enforcement Officer.
1. Special Permit Application to convert two-family dwelling to a single-family dwelling and enclose the upper and lower existing porches, 12 Old Colony Road, Gregg F. Neely, applicant.
Attorney Paul Gozzi and Gregg Neely were present to explain the application. Ms. Marsh noted the new exhibits. Attorney Gozzi noted that the applicant was before the Commission in October and the Public Hearing was continued so that they could produce an A-2 Survey. He explained that they would like to convert a two-family home to a single-family home and enclose the upper and lower existing porches, resulting in 120 square feet of living space on the first floor and 250 square feet on the second floor. Attorney Gozzi stated that the existing roof is 22’ and the new roof will be at 24’, the maximum allowed. He indicated that the footprint will not change, but the impact on the land will be lessened because of the conversion from two-family to single-family and the reduction in
bedrooms from 4 to 3.
Attorney Gozzi stated that the application for Special Permit is coming under Section 9.4 of the Zoning Regulations which allows for modification to a nonconforming structure to achieve improvement. He noted that they believe they are not creating nonconformities in the renovation. Mr. Neely pointed out that the second floor porch is already enclosed which is evident in the photographs. He noted that the first floor porch in the front of the house will remain open.
No one present spoke in favor of or against the application. Hearing no further comments, Chairman Risom asked for a motion to close the Public Hearing.
A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to close the Public Hearing for this item.
2. Site Plan Modification Application to revise parking, 1 McCurdy Road, Church of Christ the King, applicant.
Chairman Risom noted that this Public Hearing was continued from the October 15, 2008 Regular Meeting. Janet Sturgis was present to represent Christ the King Church. Chairman Risom noted that the question to be answered this evening was to the drainage. Ms. Sturgis stated that she has had several conversations with Tony Hendriks and Lee Rowley. She noted that they discussed the issue with Mr. Metcalf and as a result of all that there is no reason to question the capacity of the drainage system. Ms. Brown stated that Mr. Metcalf suggested that the Commission determine whether they would like to see more landscaping in the front. Ms. Sturgis stated that they plan to put a few bushes at the entrance to finish it off. She noted that there are bushes on one side and a berm with
plantings on the other side, along with some existing trees.
No one present spoke in favor of or against the application. Hearing no further comments, Chairman Risom asked for a motion to close the Public Hearing.
A motion was made by Jane Marsh, seconded by Jane Cable and voted unanimously to close the Public Hearing for this item.
At 7:50 p.m., Chairman Risom adjourned the Public Hearing.
