OLD LYME ZONING COMMISSION
MINUTES OF PUBLIC HEARING
Wednesday, October 11, 2006


The Old Lyme Zoning Commission held its Public Hearing on Wednesday, October 11, 2006 at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Members present were Ted Kiritsis (Chairman), Jane Marsh (Secretary), Jane Cable, John Johnson and Steve Ames (Alternate, seated for Tom Risom).   

Chairman Kiritsis called the Public Hearing to order at 7:31 p.m.  

1.      Special Exception Application/Site Plan Modification Application to     construct a 40’ x 60’ building to house dewatering equipment, 1 Gouvna Hill     Road, The Gouvna Group LLC, applicant.  

The Public Hearing for this application was continued from the September 11, 2006 Regular Meeting.  Ms. Marsh read the list of exhibits received since that hearing.  She read Exhibit K, referral response from Tom Metcalf indicating that a septage receiving facility requires permit approval from the CT DEP and suggesting that a copy of this permit approval be submitted to the Town by the applicant.  Ms. Marsh noted that Exhibit L is a letter from the State of CT DEP, approving the permit application for this septage receiving facility.

Ms. Brown stated that there was one tank proposed that was in the setback and it has been corrected on the latest site plan.  Chairman Kiritsis questioned whether Ms. Brown has visited the site.  Ms. Brown stated that there are some existing structures in the setback and are shown on the site plan; she noted that they are not violations as they have been there a long time.

Chairman Kiritsis questioned whether membrane structures are permitted.  Ms. Brown indicated that they are.  Chairman Kiritsis questioned whether it is in the Regulations.  Ms. Brown replied that it is not.  Chairman Kiritsis stated that when the Commission clarifies a Regulations they should take pencil to paper and incorporate the change, not just make a clarification in their own minds.  Ms. Brown stated that the Commission determined that membrane buildings are not Quonset Huts.  Chairman Kiritsis stated that they should be defined in the Regulations.  Ms. Brown noted that membrane structures meet the definition of a structure and she does not think they need to be described more specifically.

Mr. Yuknat stated that the definition of a structure is vague.  He indicated that he has an old school bus filled with stuff that has been there for twenty years.  Mr. Yuknat questioned whether this is a structure.  He indicated that he has buried tanks and questioned whether they are considered structures.  Ms. Marsh indicated that buried tanks are structures.  She noted that these things would be grandfathered because they have been there for twenty years.

No one present spoke in favor of the application.  Hearing no further comments, Chairman Kiritsis asked for a motion to adjourn.

A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to close the Public Hearing for the Special Exception Modification Application to construct a 40’ x 60’ building to house dewatering equipment, 1 Gouvna Hill Road, the Gouvna Group LLC, applicant.

A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to adjourn the Public Hearing at 7:45 p.m.
