REGULAR MEETING

1.  Convene Meeting; announcement of voting members.

Present and voting:  Jane Cable, Chair, Gil Soucie, Vice Chair, Jane Marsh, Secretary, Alan Todd, Paul Orzel

Also present:  Harvey Gemme, Alternate and Keith Rosenfeld, Land Use Coordinator

Absent:  None

PUBLIC HEARING:   None

REGULAR MEETING:

1.  Petition for Amendment of Old Lyme Zoning Regulations to repeal Sections 4.4.6.5f(i) and (ii).  That repeal will have the effect of changing Section 4.4.6.6c because 4.4.6.6c references Paragraph 4.4.6.5f of the Old Lyme Zoning Regulations. Petitioners Scott Boulanger and Kathleen Boulanger.

A Motion was made by P. Orzel, seconded by J. Marsh to modify and replace Sections 4.4.6.5f(i) and (ii) as follows:

4.4.6.5.f (ii)  Any portion or part of a public or community sewage disposal system, including sewage treatment facilities, septage lagoons, and sewage pumping stations (except public or community sewage pumping stations and associated infrastructure and piping proposed and developed by municipal or quasi-municipal applicants subject to Consent Orders with the State of Connecticut Department of Energy and Environmental Protection which system shall obtain a Special Permit and is designed in accordance with the special standards of Section 13B.4.17), the exposure to high velocity flood waters or the inundation of those designated or provided which could result in contamination of public or private potable water sources or the release of untreated sewage into the water bodies or onto the land areas of the Town of extended interruption of sewage disposal service.

4.4.6.5.f (iii)   Any portion or part of an electrical utility system, including
generating facilities (except backup generators and associated utilities for sewage pumping stations when allowed by Special Permit immediately above), transformer substations, and high voltage transmission lines, the exposure to high velocity flood waters or the inundation of which could result in an extended interruption of electric service; and,

13B.4.17   Special Standards – Sewage Pumping Station in Coastal High Hazard Area.  
Sewage pumping stations and transmission lines in a Coastal High Hazard Area (see Section 4.4.3.f) shall be resilient to flooding, Sea Level Rise (SLR), and increased rainfall intensity associated with climate change, and shall comply with design criteria in the latest version of following technical resources, as amended.

  • Technical Resource 16 (TR-16) by the New England Interstate Water Pollution Control Commission (NEIWPCC), Revised 2016 (as amended).  Vulnerable electrical components shall be designed for installation at an elevation of the 1 percent chance flood plus a minimum of 36-inches, the recommended design elevation for critical centralized pump station components pursuant to Section 1.2.1.h.  Design pumping station in accordance with Chapters 1,3,10,13.
  • Protecting Building Utility Systems From Flood Damage; Principles and Practices for the Design and Construction of Flood Resistant Building Utility Systems FEMA P-348, Edition 2 / February 2017 (as amended).  Design pumping station in accordance with Chapter 5.0 – Mitigation Measures for Non-Residential Buildings.
  • Further consideration or accommodation for wave action and coastal erosion should be made as necessary, based on current Connecticut Institute for Resilience and Climate Adaptation (CIRCA) recommendations from studies conducted for Long Island Sound, as applicable.  
                
                d.   System shall provide a series of check-valves to ensure no back-ups into homes in case
                              of        catastrophic system failures.

2.  New Business – Special Permit Application and Municipal Coastal Site Plan Review Application for an Enlargement/Extension of an existing single family dwelling in an R-10 District where there is no new nonconformity and no increase in an existing nonconformity, meeting FEMA standards in the Zone AE located at 33 Massachusetts Road, Jonathan Gibbs, Architect, applicant, Francis and Kathryn McCarthy, owners – Receive and set a Public Hearing

A Motion was made by P. Orzel, seconded by G. Soucie to Receive and set a Public Hearing date for May 13, 2019 at 7:30 p.m. in the Meeting Hall for the Special Permit Application and Municipal Coastal Site Plan Review Application for an Enlargement/Extension of an existing single family dwelling in an R-10 District where there is no new nonconformity and no increase in an existing nonconformity, meeting FEMA standards in the Zone AE located at 33 Massachusetts Road.  No discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, G. Soucie, A. Todd, P. Orzel  In opposition:  None   Abstaining:  None  The Motion carried 5-0-0

4. Approval of Minutes   –   Minutes of the March 11, 2019 Regular Meeting

A Motion was made by J. Marsh, seconded by A. Todd to approve the Minutes of the March 11, 2019 Public Hearing and Regular Meeting with the following change:  Public Hearing Minutes, first page, second full paragraph, “He noted that Old Lyme Shores is currently a participant in a consent decree . . .” not “descent” decree.  And Regular Meeting Minutes, Item No. 3 it was Ms. Cable, not Ms. Marsh.  No further discussion and a vote was taken.  In favor:  J. Cable, J. Marsh, A. Todd, H. Gemme  In opposition:  None   Abstaining:  None  The Motion carried 4-0-0
