REGULAR MEETING
INLAND WETLANDS AND WATERCOURSES COMMISSION
TUESDAY, MAY 28, 2013


PRESENT WERE:  Janet Bechtel, Skip DiCamillo, Dave McCulloch, Linda Krulikowski, Tim Rollins , Evan Griswold,  Stanley Kolber, and Christian Tompkins.   

MINUTES

MINUTES OF REGULAR MEETING DATED APRIL 23, 2013

Linda Krulikowski made a motion to approve the minutes as submitted.  Tim Rollins seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED MAY 8, 2013

Dave McCulloch made a motion to approve the minutes as submitted.  Linda Krulikowski seconded the motion.  The motion passed.  Stanley Kolber abstained.

NEW BUSINESS

13-9  SUSAN LAIRES – 30 BROWNS LANE – INSTALLATION OF A PROPANE TANK

This application remains incomplete and unable to be acted upon at this time.

13-13  LUIS & ALICIA CASTANHO – 52 GORTON AVENUE – TEAR DOWN EXISTING SINGLE FAMILY DWELLING AND REBUILD INCLUDING  SEPTIC SYSTEM WITHIN THE REGULATED AREA.

Geri Deveaux of Deveaux Architect presented the proposal on behalf of the applicants Luis & Alicia Castanho.   Deveaux noted the property is located in Old Colony Beach.  She noted there is presently a 4 bedroom house on the site.   She stated a large portion of the property is located within the regulated area as well as being in a flood zone.  The proposal is to tear down the house and rebuild the structure with an expanded footprint including a deck, screen porch and septic.  Deveaux presented photographs of the site and the adjoining properties to the commission.  

Deveaux stated the house will be elevated on an enclosed pier system except for the screen porch and the deck will be open piers.

The commission agreed to set a site walk for Wednesday, June 19th, 2013 at 5:45 p.m.

Brown asked the commission if they had considered holding a public hearing on this project.  The commission decided to visit the site prior to making a decision.

13-14 – GREG FAUCHER – 97 SILL LANE – CONSTRUCTION OF A NEW 3 BEDROOM HOME WITH ATTACHED GARAGE AND ASSOCIATED IMPROVEMENTS INCLUDING DRIVEWAY/SEPTIC SYSTEM AND WELL.

Joe Wren, Professional Engineer was present on behalf of the applicant Greg Faucher.  He stated the proposal is to construct a single family home on the 2 acre parcel which abuts the Old Lyme Land Trust property.   Wren stated the existing property is a meadow and along the stream there is some heavy brush growth.  He noted Richard Snarski, Soil Scientist has evaluated the property and identified 9 or 10 exotic invasive species which are taking over the buffer along the stream.  Wren noted there is a removal and replanting plan as part of the application which is delineated on the plan.  He further noted there is an existing drive on the site which is proposed to be extended to the house site.  He noted the drive would be a stone base.   Wren also pointed out the silt fence location as well as the stockpile areas on the site.  

Brown noted that the commission had previously issued an approval for a house on this site.  

Wren noted the house was oriented on the site  for the back to face the southerly direction to maximize energy savings.  DiCamillo asked if that could be changed.   Wren stated it could be turned but you would lose the solar gain.

Wren also noted that there are two foot bridges located on the property.  He  stated that since the properties will be under separate ownership Mr. Faucher is proposing to remove the bridges which will provide for better flow.  

The commission agreed to set a site walk for Wednesday, June 19th, 2013 at 6:15 p.m.  DiCamillo asked that both the house and driveway area be staked at the site.  

13-15 RONALD RICHARDELL – 8 SHORT HILLS ROAD – RELOCATE DRIVEWAY

Ron Richardell explained his proposal to relocate the driveway on his property.  The commission agreed to set a site walk for Wednesday, June 19th, 2103 at 6:45 p.m.
Mr. Richardell agreed to stake out the proposed gravel driveway.

OLD BUSINESS

13-7  MATT & TARA WARD – 23 CROSS LANE – INSTALL A 27’ ROUND ABOVE GROUND POOL WITH A 14 X 18 DECK, EXTEND EXISTING PATIOWITH WALKWAY TO DECK STAIRS AND DRIVEWAY.

Mr. Ward was present to address some of the concerns and questions raised by the commission at the last meeting that he was unable to attend due to his work schedule.  He explained he would be using chlorine in the pool and there would be no discharge.   He noted there would be a self-locking  gate at the top of the steps.  He also noted an alarm would be installed in the pool.  

Janet Bechtel made a motion to approve the application as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.  

13-10  STANLEY KOLBER & CHRISTINA CLAYTON – 25 TALCOTT FARM ROAD – REMOVAL CAUSED BY STORM DAMAGE CONSISTING OF DOWNED AND BROKEN TREES

Stanley Kolber recused himself  from the application.

Christina Clayton explained they have a proposal to do some work on their property that was caused by Hurricane Sandy and the following winter storms.   She noted most of the damage is in the review area.  She stated the proposal is to cut up some of the wooded materials which will be left on the property in piles.  She noted there would be some smaller branches that would be taken off the property and chipped with a wood chipper.   She further stated that no machinery would be located on the property it would all be hand carried to the chipper.  

Evan Griswold suggested the larger material be piled first and so on and the brush be piled on top.
Clayton stated they would be happy to do that.

Evan Griswold made a motion to approve the application.  Dave McCulloch seconded the motion.  The motion passed unanimously.

13-11 THOMAS A. MUCKLE – 15 LEDGEWOOD DRIVE – REPAIR AN EXISTING RETAINING WALL.  

Mr. Muckle was not present at the meeting.    The commission noted that some of the members had visited the site.   DiCamillo expressed concern that a formal map had not been submitted.  McCulloch stated he had seen a computer generated drawing of the proposal.  Groves noted that she did not have a copy in the file other than the hand drawing submitted with the application.

DiCamillo stated the proposal is to remove the wood timbers and replace them with stone.   Kim Groves read into the record a written statement from Mr. Muckle of how the retaining wall would be replaced. (Copy attached)

Griswold stated he was generally in favor of taking out wood and replacing it with stone.  Brown noted that when the stones are installed one side will be wet and the other side with be dry.  She noted it is

located right at the water’s edge where it currently exists.  Rollins asked if the wall could be set back.  Brown stated it could but the water is actually flowing water and it would probably continue to erode the bank.  

Krulikowski asked the height of the wall.  McCulloch stated it would be 2 feet.  

The commission discussed that there is no buffer existing and the applicant is replacing like for like but using stone.  Brown stated his intention is to repair.  McCulloch noted that he has a very small lawn area.

Dave McCulloch made a motion to approve the application as submitted.  Linda Krulikowski seconded the motion.  The motion passed.  Stanley Kolber abstained.

 APPLICATION TO CONSTRUCT A DWELLING IN LYME

Brown reported that she had obtained a copy of the Inland Wetlands Application from the Town of Lyme for the application of Dave Adams to construct a single family home at the end of Hunter Trail in Lyme.   She noted after reviewing the application it was determined the property was entirely in the Town of Lyme.

UPDATE ON WORK AT ROGERS LAKE

Brown noted she had visited the site and the work has now been completed and the site is stable and mats have been installed in the lake.
