REGULAR MEETING
INLAND WETLANDS AND WATERCOURSES COMMISSION
TUESDAY, APRIL 23, 2013


PRESENT WERE:  Janet Bechtel, Skip DiCamillo, Dave McCulloch, Linda Krulikowski, Tim Rollins and Evan Griswold.   

MINUTES

MINUTES OF REGULAR MEETING DATED MARCH 23, 2013

Dave McCulloch made a motion to approve the minutes as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED APRIL 10, 2013

Janet Bechtel made a motion to approve the minutes as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

NEW BUSINESS

13-9  SUSAN LAIRES – 30 BROWNS LANE – INSTALLATION OF A PROPANE TANK

This application was incomplete and unable to be acted upon at this time.

13-10 STANLEY KOLBER & CHRISTINA CLAYTON – 25 TALCOTT FARM ROAD – REMOVAL CAUSED BY STORM DAMAGE CONSISTING OF DOWNED AND BROKEN TREES

Mr. Kolber explained his proposal to the commission.  He noted the work proposed was damage caused by Hurricane Sandy and the following winter storms.   He presented photographs as well as a site plan and oriented the commission to the area.  He stated the stuff that has been blowing down is 99 percent hemlocks which are dead, diseased or dying.   He stated over the years they have just left the stuff but since Sandy it looks like a graveyard for trees so they would like to pick up some of it.  He noted that no heavy equipment would be brought into the woods and stated only hand tools would be used.  He stated that the smaller material would be chipped out at the road and removed from the site.  

DiCamillo asked how many trees were involved in the clearing.  Kolber stated he really had no idea.  He further stated it was just downed trees and noted there are many snags left.  

The commission agreed to set a site walk for Wednesday, May 8, 2013 at 5:30 p.m.

OLD BUSINESS

13-7  MATT & TARA WARD – 23 CROSS LANE – INSTALL A 27’ ROUND ABOVE GROUND POOL WITH A 14 X 18 DECK, EXTEND EXISTING PATIOWITH WALKWAY TO DECK STAIRS AND DRIVEWAY.

DiCamillo stated he asked the applicant to attend the meeting.  

Dave McCulloch made a motion to approve the application.  Evan Griswold seconded the motion.

DISCUSSION:

Griswold asked about the pipe on the property.  It was determined it was a communal well.  Griswold stated that an above ground pool is not going to create too much havoc certainly not like an in ground pool but he would like to move it further away from the wetlands and more to the rear off the house.  

Krulikowski stated the commission spent a lot of time discussing the proposal and she felt the amount of disruption was minimal and the site was fairly level.   She stated she felt the installation of silt fencing would be sufficient.

DiCamillo also noted there was a berm on the property.   McCulloch also noted there was a buffer.  McCulloch and Krulikowski both felt the relocation of the pool was taking a large portion of the yard away.  

McCulloch suggested a fence be placed behind the pool if the commission was concerned.  Brown stated she didn’t feel there would be much activity in the area behind the pool.   

Bechtel stated she didn’t feel there would be a ton of impact but felt any approval would have to be conditional upon the removal of the silt fencing from his previous application and the new silt fence be backed with hay bales.  

Brown noted that you are permitted by right to do yard things in the wetlands and this is all out the wetlands.  

Griswold stated if they relocated the pool it would be an additional 10 feet away from the wetlands.  

McCulloch stated he would like to know the chemistry of the water and how it will be changed.  Griswold stated that some pools are now salt water and not chlorine based and also noted there are other products on the market such as bacquacil.  Krulikowski stated that once an above ground pool is filled it is not emptied.  She further stated that the water is trucked in from companies.

DiCamillo stated it appears the commission still has questions.   The commission tabled any action on this application until the May 28th meeting.

The commission withdrew their previous motion.

CHRISTIAN TOMPKINS

Chairman Dicamillo introduced Christian to the commission and noted he would like to serve as an alternate on the commission.

Christian Tompkins stated he was currently a sophomore in college at Central Connecticut State University as a Planning Major.  He noted he has lived in Old Lyme since he was 5 years old and has been interested in wildlife and nature.  He stated he would like to get some practical experience in Land Use.  
The commissions agreed to inform the Board of Selectmen that they would love to have him join the commission.  They also invited Christian to attend the site walk.

ROGERS LAKE

Linda Krulikowski expressed concern about the activity going on at Haines Park by Rogers Lake.  She noted the commission issued a recent approval which included a bench being dedicated to Fred Holth.  Griswold noted he has seen the bench.   Krulikowski asked Ann Brown to inspect the area because she was concerned the activity was being done without any silt fencing in place and there in run off into the lake.  Brown stated part of the project included trying to kill the fragmities.  Krulikwoski stated that no mats have been installed in the water either.

APPLICATION TO CONSTRUCT A DWELLING IN LYME.

Kim Groves read a letter from Dave Adams into the record.  The letter explained that he and his wife were  proposing to construct a single family dwelling at the end of Hunter Trail.  He further stated he currently had submitted an application to the Lyme Inland Wetlands Commission.  He also noted due to the proximity of the parcel to Old Lyme he was required to provide notification to the town.    Krulikowski expressed concern about the project and as to whether a portion of the property was located in the Town of Old Lyme.  Brown agreed to contact the Town of Old Lyme to retain a copy of the application and determine the exact location of the proposed project.  

SILL LANE

DiCamillo expressed concern about a project the commission recently approved at 17 Sill Lane.  Brown agreed to visit the site.
