Inlands Wetlands Commission Minutes 03/26/2013


MINUTES
REGULAR MEETING
OLD LYME INLAND WETLANDS AND WATERCOURSES COMMISSION
TUESDAY, MARCH 26, 2013

PRESENT WERE:  Chairman DiCamillo, Janet Bechtel and Linda Krulikowski.

Due to the fact there was not a quorum at 7:00 the Chairman altered the agenda.

NEW BUSINESS

13-7 MATT & TARA WARD – 23 CROSS LANE – INSTALL A 27’ ROUND POOL WITH A 14 X 18 DECK, EXTEND EXISTING PATIO WITH WALKWAY TO DECK STAIRS AND DRIVEWAY.

Applicant, Matt Ward explained the proposal which is to install a 27’ round above ground pool along with a deck.   Ward explained he still has silt fencing in place from his prior permits.  He noted the shed has been relocated as requested by the commission.  DiCamillo asked how far the pool would be located from the wetlands.  Ward stated it would be approximately 18 ft.  and noted the location of the pool has been staked for the commission.  

The commission agreed to set a site walk for Wednesday, April 10, 2013 at 5:30 p.m.

BIG GREEN OUTDOOR, LLC – 218 SHORE ROAD – REQUEST FOR FINDING OF NO JURISDICTION

Joe Wren, Professional Engineer presented the request for a finding of no jurisdiction on behalf of the applicant Big Green Outdoor, LLC (former Cherrystones Property).   Wren noted the footprint will remain the same, except for an entry vestibule on the eastern side which will be added, as well as two paver patios located on the east and west side of the building.  He further stated that the entire pavement on the site will be removed.  He noted the only new asphalt will be for the two entrances into the site and for the handicapped parking spaces.  He stated all the rest will either be a crushed decorative stone or crushed seashells.   

Wren presented the commission with a schematic drawing as well of the site which shows the distances to the wetlands.  He stated the closest distance is to the northwest which is tidal and is over 342 feet from the property line and to the northeast which is over 508 feet.  Wren also noted they will be adding a lot of trees and landscaping to the area.  DiCamillo stated he felt it would be an upgrade.  

Commission member Evan Griswold arrived at 7:26 p.m.

Wren summarized the presentation again for Mr. Griswold.  Griswold stated it seemed that the net impervious surface is being reduced.  Wren stated the coverage was going from 40,400 sq. ft down to 12,700 sq. ft.   

Janet Bechtel made a motion to approve the request for a finding of no jurisdiction on Big Green Outdoor, LLC.  Evan Griswold seconded the motion.  The motion passed unanimously.  



OLD BUSINESS

13-2 OLD LYME LAND TRUST – 132 FOUR MILE RIVER ROAD – STAIRWAY STRUCTURE AND WALKWAY ACROSS THE WETLANDS

DiCamillo stated the commission visited the site on Saturday, March 23, 2013 and noted at that time the commission had no additional questions.  He also noted the commission informed the applicant he did not need to attend the meeting tonight.  

Griswold expressed concern that during the construction of the trails (switchbacks) on the steep slopes that it is stipulated that there be some erosion control in the event of any rain storms.  Bechtel stated they were very specific that they were not going to be doing a surface.  She said in some of the locations they would be installing a railing for safety purposes.  

Evan Griswold made a motion to approve the application as submitted.  Janet Bechtel seconded the motion.  The motion passed unanimously.

13-3 DENNIS HALLAHAN – 3 LITTLEFIELD LANE – REPLACE EXISTING PROPANE TANK WITH NEW LARGER TANK

DiCamillo stated the commission visited the site on Saturday, March 23, 2013.  He also noted at that time the commission informed the applicant he did not need to attend the meeting tonight.  

Janet Bechtel made a motion to approve the application as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

13-4  ROBERT O’LEARY – OAK LAND DEVELOPMENT – 59 SEA SPRAY- TEAR DOWN EXISTING HOUSE DESTROYED BY HURRICANE SANDY AND CONSTRUCT A NEW HOUSE

Bob Doane was present on behalf of the owners of 59 Sea Spray.   He stated the proposal is to replace the house and construct a new house at Elevation 13.   He noted as result of this the house will end up being approximately 2 to 2 ½ feet closer to the wetlands in order to comply with the zoning regulations.  
Doane noted for the record they will not be placing fill on the site.  He stated the grade will remain the same because he is doing a garage underneath and in order to do that the grade will need to remain the same.  Griswold asked if it was technically a garage.  Doane stated it will have concrete walls to Elevation 9 with flood vents all the way around as required.   

Krulikowski asked how much over flow comes from the stream in the rear.  Doane noted that this is the lowest property on Sea Spray therefore as the sound builds up it floods back into the swale.   

Griswold asked what happens to the septic systems when it floods with water.  Doane stated it’s not unlike any system below elevation 9.  It has already been tested.  He stated there will be saturation of the soil.  He noted that there will also be a significant amount of dilution.  Doane  further stated the sludge will stay in the tank.   He also noted it is a relatively new code compliant system.  

Doane also asked if steps were allowed in the setback.  Brown clarified that uncovered steps are allowed in any setbacks.  Doane drew preliminary locations of the uncovered steps on the plan for the commission to see.

He also noted he does not yet have architectural plans.  He stated the outdoor steps would allow safe access and egress at the site if flooding should occur.  

DiCamillo asked if the shed was going to remain on the site.  Doane  stated the property owners store mostly beach chairs and other related items in the shed.  He said a concern was lawnmower, gasoline, fertilizers.   Doane stated the commission could request that these items be kept on a shelf above flood elevation and the shed be anchored.  

Bechtel stated she would be hard pressed to believe that if flood Elevation is 13’ that they will be lifting a lawn mower over their head.   Bechtel stated she felt the existing shed should be restricted to the storage of beach chairs and umbrellas and not for any other landscaping and yard items.  

Janet Bechtel made a motion to approve the application as submitted with conditions that the existing shed only be used for storage of beach related items and all other yard materials be stored and elevated in the garage.  Evan Griswold seconded the motion.  The motion passed unanimously.

Evan Griswold made a motion to approve the minutes as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED MARCH 23, 2013

Janet Bechtel drafted the minutes and noted that the builder accompanied Bob Doane on the site walk but she did not know his name.  Mr. Doane clarified that the builder was Robert O’Leary.  Evan Griswold noted that the minutes were labeled “agenda”  at the top rather than minutes.  

Evan Griswold made a motion to approve the minutes with the noted corrections and additions.  Linda Krulikowski seconded the motion.  The motion passed unanimously.
