INLAND WETLANDS AND WATERCOURSES COMMISSION
REGULAR MEETING
FEBRUARY 22, 2011


PRESENT WERE:  Chairman Robb Linde, Janet Bechtel, Dave McCulloch and Linda Krulikowski.

MINUTES OF MEETING DATED JANUARY 25, 2011

Dave McCulloch made a motion to approve the minutes as submitted.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED FEBRUARY 12, 2011

Janet Bechtel made a motion to approve the minutes as submitted.  Dave McCulloch seconded the motion.  The motion passed unanimously.

NEW BUSINESS

REQUEST FOR FINDING OF NO JURISDICTION – 62 BUTTONBALL ROAD.

The commission reviewed the plan that showed the division of the two parcels.  Brown stated the proposed building is 100’ away from the tidal wetlands as required by the Zoning Regulations.  She also noted that a silt fence backed up with hay bales in shown on the plan as well as a stockpile location.  She also noted there was a narrative provided on the second sheet that explains the proposed work.  

Janet Bechtel made a motion that the commission has made a finding of no jurisdiction on the application of 62 Buttonball Road.  Linda Krulikowski seconded the motion.  The motion passed unanimously.

11-1 JOSEPH AND TAMMY MCARAW – 23 TALCOTT FARM ROAD – REMOVE DEAD AND DANGEROUS TREES, ANY OF WHICH HAVE FAILING LIMBS.

Robb Linde stated that three of the commission members walked the site on February 12, 2011.  Bechtel stated that the site walk minutes reflect where the commission stood on

the property.  She stated that Mr. McAraw marked all the trees that he wanted removed.  She noted that she requested that a dead cedar be kept as she felt there was no reason to remove the tree.  McAraw removed the marking from that tree and agreed to keep it.  

Janet Bechtel made a motion to approve the application of Joseph and Tammy McAraw at 23 Talcott Farm Road with the condition that the cedar tree remain.  Dave McCulloch seconded the motion.

DISCUSSION:

Bechtel noted for the record that the commission did tell the applicant that there are other dead trees on the property and when they come down in the wetland they are free to pick up brush and debris in the wetland, but none of the other trees are impinging on the house or threatening anything.

The motion passed unanimously.

11- 2 THOMAS KUNKLER – 7 SANDALWOOD LANE – ADDITION WITHIN 100’ OF THE REGULATED AREA

Adam Pietrowicz, Builder for the proposed addition reviewed the plot plan with the commission.  He also provided a copy of the Zoning Compliance permit issued by Marilyn Ozols in 2000 for the 10 x 16 storage shed on the property.  It was noted that the 2000 permit did not require an application to the Inland Wetlands Commission at that time.  

Linde asked what the ground cover was between the shed and the wetland area.  Pietrowicz said there is a tree line and lawn in the area around the shed.  McCulloch stated there was no buffer area and it might be a good idea to protect that area.  Linde stated he would like to see a buffer which would consist of a no mow area, or ground cover (pachysandra, vinca or something of the like) between the shed and the wetland area to provide some additional protection.  Pietrowicz stated that would not be a problem.   Bechtel also agreed that a buffer would be a good idea.  Bechtel sketched the buffer area on the drawing.  Brown stated that she would send a copy of the map delineating the area with the permit.  

Robb Linde made a motion to approve the application with the stipulation that a buffer be maintained either through a low mow once or twice year or through installation of appropriate ground cover between the shed and the wetlands as drawn on the plan.  Bechtel seconded the motion.  The motion passed unanimously.

11-3 MATT WARD – 23 CROSS LANE – GRADING AND DRAINAGE WITHIN 100’ OF THE REGULATED AREA.

The commission agreed to set a second site walk for Thursday, March 17th at 5:15 p.m.

11-5 NANCY MANVILLE – 31 SILL LANE – ADDITION WITHIN 100’ OF THE REGULATED ZONE

Dave Tiffany reported that the application had received Zoning Board of Appeals approval.  He further stated during their review of the application they felt it would be more architecturally appropriate with if the addition was a bit larger.  Therefore the final dimensions of the addition is 9’ x 12’ which is a foot and a half  bigger on each side.  

Janet Bechtel made a motion to approve the application as submitted with the slightly larger addition.  Krulikowski seconded the motion.  The motion passed unanimously.  

OTHER BUSINESS

CORRESPONDENCE

McCulloch stated that the Town Report provides a description of what the Flood and Erosion Control Board propose to do and some of that proposal has to do with the rearranging of stream drainage.  He expressed concern that they have not requested any input from the Inland Wetlands Commission.  Brown stated she has not yet seen the plan but she would inquire.

PROPOSED BILL NO. 244

McCulloch presented a Proposed Bill No. 244 - An Act Authorizing municipalities to ban and regulate the use of lawn care pesticides.  He also suggested that members express their opinion.  

CCM CONFERENCE

Robb Linde reported that he attended the Connecticut Conference of Municipalities for Municipal Meetings: Understanding Parliamentary Procedures.  He stated the one issue that was stressed was that email that is sent amongst a quorum of commission members

is considered a meeting if its purpose is to discuss or act upon a matter that our commission has authority or advisory power.  Therefore he reminded the commission that comments should be limited on emails especially pertaining to issues that we regulate.  

Bechtel made a motion to adjourn, Krulikowski seconded.  Motion passed unanimously.
