INLAND WETLANDS AND WATERCOURSES COMMISSION
SPECIAL MEETING
SEPTEMBER 9, 2009



PRESENT WERE:  Janet Bechtel, Chair, Sabine O’Donnell, Dave McCulloch and Skip DiCamillo.  Also present were: Attorney Mark Block, Ann Brown and Kim Groves.

LORDS WOODS SUBDIVISION – 24 LORDS MEADOW LANE – DISCUSSION REGARDING REMOVAL OF CEASE AND DESIST ORDER

Bechtel called the meeting to order at 5:37 p.m.

Bechtel verified that the commission members had reviewed the correspondence to the commission from Tom Metcalf.  Bechtel stated that she concurred with both letters dated September 3, 2009 and September 4, 2009.  She also noted she agreed with his recommendation that a maintenance bond be retained by the town to cover any unforeseen deficiencies in the future.  Bechtel reported after walking the site she was pleased with the work that had been completed.  She noted that the level spreader looked good, the parking spaces had been installed as well as the wooden guardrail and the area seems to have sprouted nicely.

She stated she had specifically asked Mr. Metcalf, prior to drafting his letter to the commission, if he felt the level spreader needed further plantings.  She stated that Metcalf didn’t feel it was necessary and neither did she after visiting the site.  She further stated if in the Spring the commission determines the site conditions have changed they could revisit the issue at that time.  

Bechtel stated she reviewed the items outlined in the Cease and Desist Order and felt all the issues had been satisfied.  Brown noted that the town has not yet been reimbursed fully by Dr. Awwa for the engineering reviews that have been done at the site.  Brown stated she spoke with Attorney Block prior to the meeting and he would see that those fees get paid by early next week.

DiCamillo asked if the town had been reimbursed for the initial clearing that was done at the site.  Bechtel stated there had been a $75,000 reimbursement to the Open Space Committee for the clearing on their particular property.

O’Donnell asked if the parking spaces would remain a gravel surface.  Attorney Block stated that the Open Space Committee requested a gravel surface.  O’Donnell also asked when the hay bales and silt fencing would be removed from the area.  Bechtel stated they will eventually be removed but stated she would like them to remain to make sure the work that was recently completed doesn’t scour down the hillside.

Bechtel made a motion to lift the Cease and Desist Order on the Lords Woods Subdivision.  Skip DiCamillo seconded the motion.  The motion passed unanimously.

Brown noted that the Cease and Desist Order was recorded on the land records and therefore a release needed to be filed.  Block agreed to forward release language to the commission.
