NOVEMBER 25, 2008
PRESENT WERE: Janet Bechtel, Robb Linde, Sabine O’Donnell, Don Willis, Skip DiCamillo and Evan Griswold.
MINUTES OF SITE WALK MEETING SEPTEMBER 13, 2008
Sabine O’Donnell made a motion to approve the minutes as submitted. Don Willis seconded the motion. The motion passed unanimously.
MINUTES OF MEETING DATED OCTOBER 28, 2008
O’Donnell asked that the final option on the Babasul application that was presented by the applicant “Option E” be inserted into the text on Page 3. O’Donnell also noted that the text does not indicate that a 15” buffer is now required as opposed to the 3’ buffer shown on the plan. Bechtel stated that prior discussion indicated that the commission would like to have a 15’ buffer, but not requiring a 15’ buffer. O’Donnell asked if the commission would at least express their desire of having a 15’ buffer. Discussion ensued. Robb Linde suggested that the approval of the minutes be postponed. O’Donnell agreed to listen to the tape to verify the wording of the commission.
Bechtel tabled any action on the meeting minutes until the January meeting.

Bechtel made a motion to approve the minutes as submitted. Robb Linde seconded the motion. The motion passed unanimously.

Evan Griswold made a motion to approve the calendar. Robb Linde seconded the motion. The motion passed unanimously.

NEW BUSINESS
08-22 – PETER & MICHELLE BASS – 16 HEFLON FARM ROAD – PROPOSAL TO INSTALL A 12 X 16 SHED.
Mr. Bass was present at the meeting to discuss the proposal with the commission. Bechtel noted that there are two locations shown on the map for placement of the proposed shed. Bechtel stated that the applicant had discussed this proposal with Ann Brown and chose to submit an application to the commission in an attempt to move this along. The commission agreed to set a site walk for Saturday, December 6th at 8:30 a.m. and will consider this application for an Administrative Permit
Application of the United States Department of Interior, U.S. Geological Survey Connecticut Water Science Center – 109 Four Mile River Road – Installation of monitoring equipment on the upstream of I-95.
The commission received a letter dated November 24, 2008 from John Mullaney, U.S. Department of Interior, informing them that the U.S. Geological Survey is in the process of beginning a study, in cooperation with the Federal Highway Administration, on the effects of road deicing on water quality along I-95 corridor between the Connecticut and Thames River. The purpose of the study is to provide information on the effects of highway runoff related to road deicing on the chloride concentrations and loads of the receiving streams.
Bechtel stated they have chosen four sites for their monitoring along the I-95 corridor and study area, one of which includes property located at 109 Four Mile River Road (the town landfill). Bechtel stated that each site will have water quality data collected continuously using a sensor and noted that they state no soils will be disturbed nor the river bottom in this installation. She stated the sensor will be bolted next to a boulder near the old bridge abutment and the pipe will have a locking cover. She further noted if this commission determines a permit is necessary they have a requested a waiver of all fees because they are a Federal Agency.
Robb Linde made a motion to grant Ann Brown permission to issue an administrative permit and waive the application fee. Evan Griswold seconded the motion. The motion passed unanimously.
PUBLIC HEARING
08-14 – BEDRI & DANIEL BABASULI – 20 GRASSY HILL ROAD – PROPOSED DRIVEWAY CONSTRUCTION TO PROVIDE OFF ROAD PARKING AND SEPTIC SYSTEM REPAIR.

Mr. Hendriks submitted a letter to the commission dated November 21, 2008 formally withdrawing the application because the applicant failed to send notices to the owners within 100 feet of the subject site which is required in the regulations for a public hearing.
The commission agreed to re-receive the application and set a new public hearing for their January 27, 2008 meeting.
Mr. Rowley asked the commission to transfer the fee from the prior application. The commission discussed the advertising costs of the prior application that were paid. Mr. Rowley agreed to pay the advertising costs for the prior application and the fee for the second advertising for the new application. The commission also agreed to forward the plan to Mr. Metcalf for his review and Rowley stated he would drop the plans off himself.
Linde also reminded the applicant that he requested some sort of certification that indicates that the applicant is qualified to build this project. Rowley noted that he would be submitting photographs of prior projects constructed by the applicant. Linde noted he would like the photographs to include a project that is of similar sensitivity as the one proposed.
08-15 – PRAMOD R. MINEXIBAN P.W. PATEL – 268 SHORE ROAD – PROPOSED RETAIL FACILITY AND ASSOCIATED PARKING
Bechtel noted the commission received a letter from Mr. Hendriks, agent for the applicant, withdrawing the application and resubmitting. Bechtel noted that Mr. Metcalf has reviewed this plan and submitted comments to the commission dated November 6, 2008. She noted it was her understanding that revisions were to be made to the plans and submitted back to Mr. Metcalf for his review. Rowley indicated he did receive Mr. Metcalf’s comments and has addressed many of the issues but the revised plans have not yet been forwarded to Mr. Metcalf. Mr. Rowley noted that Mr. Metcalf requested a meeting to discuss the drainage report, however that has not happened at this point.
Rowley noted he would be forwarding revised plans to Mr. Metcalf for his review. The commission also noted that the dumpster location has not been changed as discussed at both the site walk meeting and prior regular meeting.

OTHER BUSINESS
FMTM – SHOW CAUSE HEARING
Bechtel noted that there has been no submission of an as-built. She further stated there has been no activity at the site. Bechtel suggested the commission visit the site on December 6th, 2008 at 9:30 a.m. to review the E & S controls before winter.
REGULATION REWRITE
Bechtel noted that the commission has received an email from Mark Branse containing his comments on the regulation rewrite. Bechtel suggested that his revisions be put into the proposed draft regulations so all the information would be in one place. The commission agreed to set up a workshop in January with Attorney Branse to discuss revisions to the regulations. O’Donnell asked for clarification on the definition of horizontal and lateral. McCulloch explained the issue as it relates to maps.
LORDS WOODS SUBDIVISION ENFORCEMENT
Bechtel reported that there is no updated information. Bechtel also noted that Don Fortunato visited the site and felt it was re-vegetating nicely.
ENFORCEMENT ACTIONS
The commission agreed to walk the site next to Coffee’s on Boston Post Road in an effort to follow up on a wetlands complaint. McCulloch agreed to provide Kim Grove’s an address of the site.
McCulloch also suggested that the enforcement actions be placed first on the agenda prior to new business.
13 Rogers Lake Trail – Linde expressed concern on the scope of the project. Kim Groves agreed to make copies of the site plan for the commission. Bechtel requested that Ann Brown visit the site and review the map prior to December 6th, 2008.
