OLD LYME INLAND WETLANDS AND WATERCOURSES COMMISSION
REGULAR MEETING
JANUARY 26, 2016


PRESENT WERE:   Skip DiCamillo,  Dave McCulloch,, Evan Griswold, Tom Machnik, and Tim Rollins.
Also present were: Kim Groves and Keith Rosenfeld.

MINUTES

MINUTES OF REGULAR MEETING DATED NOVEMBER 17, 2015

Tim Rollins made a motion to approve the Regular Meeting Minutes dated November 24, 2015.   Tom Machnik seconded the motion.   The motion passed unanimously.

MINUTES OF SITE WALK MEETING DATED NOVEMBER 21, 2015

Evan Griswold made a motion to approve the Site Walk Meeting Minutes dated November 21, 2015.  Tom Machnik seconded the motion.   The motion passed unanimously.

OLD BUSINESS

15-16  MARK REEVES BUILDER – 13 BOGGY HOLE ROAD – CONSTRUCT A 24 X 60 FT. ADDITION TO AN EXISTING HOUSE.

Mark Reeves, Contractor  stated the commission walked the site on November 21, 2015.  He noted as requested he had staked the location of  the proposed improvement and the wetland  flags were in place to show the extent of affected areas.  

Reeves submitted plans revised which includes both a silt fence and stockpile location and identifies  the location of down spouts.   

DiCamillo noted the site is very flat.  Rosenfeld stated all work is proposed within the 100’ upland review area.   He further stated the closest edge of the proposed improvements is 51 ft.  Rosenfeld stated he did not feel there were any short term impacts anticipated by the proposed construction or long term impacts due to the addition.  

Griswold stated even though the area is flat he would recommend a vegetative buffer  between the addition and the wetland.  He felt this would prevent lawn creeping closer to the wetland and suggested the buffer only be mowed once a year.  Griswold suggested this be added to the stipulation of approval.

Reeves stated he felt the addition of a buffer would be acceptable to the property owner.  Griswold stated the buffer should have enough vegetation whether it consists of  taller grass or shrubs that would capture anything prior to running  down into the wetlands.

Evan Griswold made a motion to approve the application as submitted with the addition of a 25’ low maintenance vegetative buffer  from the wetland boundary  and it only be mowed once or twice a year.     Dave McCulloch seconded the motion.  The motion passed unanimously.

15-17 DAVID LONG – 126 WHIPPOORWILL ROAD – 1ST FLOOR ADDITION TO EXISTING HOME AND GARAGE ADDITION.

The commission visited the site and identified the location of the proposed addition.   It was noted that the  location of the pond and its associate upland review area was delineated by Richard Gates, Licensed Land Surveyor.  Rosenfeld stated  that the  closest edge of the proposed improvements to the wetlands is 71 ft.

Rosenfeld stated that the  excess fill that will be removed from the addition be placed outside the upland review area or disposed.  

Tom Machnik made a motion to approve the application with  the stipulation with the addition of a low maintenance  25’  vegetative buffer  and that any excavated material be placed outside the review area.  Dave McCulloch seconded the motion.   The motion passed unanimously.   

NEW BUSINESS

HAINS PARK BOAT HOUSE – MODIFICATION TO PERMIT – 166 BOSTON POST ROAD

The commission reviewed the revised site plan of the Boat House dated December 16, 2015.  

Paul Gianquinto, Co Chairman of  the Boat House/Hains Park Improvement Committee was present to discuss the modifications to the plan since July 2014.  He stated the size of the boathouse has been reduced from 7,808 sf. To 6,057 sf.  and the second floor has been eliminated and the plan is to reuse the existing foundation.   He further stated the footprint of the building has grown slightly but the building has become 2 ft. narrower but has increased  in length between 3 ft. and 8 ft.  

Gianquinto reviewed the color coded site plan with the commission.   He stated the building has been expanded in length to the west  towards Town Woods Road, away from the lake.   The 40’ x 80 ft. basketball court will now be located to the east side of the driveway therefore eliminating the need to remove any trees.  He stated additional areas of  honeycomb style  (plastic) reinforced turf will be added to the site which  increases the amount of pervious surface at the site.   He stated this area will accommodate additional overflow parking  as needed for events held a few  times a year.   

Gianquinto stated the existing drainage will have an added swale with rip-rap to help bring the water around the north side of the boat house that allows for surface storm water to be better absorbed into the ground.   

DiCamillo asked if the committee had considered moving the boathouse further away from Rogers Lake.  Gianquinto stated the further away you move it the farther the boats have to be carried.   He further stated by using the existing  foundation  there will be  less development, disturbance, and excavation and thus creating  less potential impacts to the Lake.

Griswold stated the construction of the basketball court will require additional work and wondered if additional protection will be provided from the construction site.    Gianquinto explained there is a separate plan for Soil and Erosion Control which outlines the limits of disturbance and shows the silt fence and stockpiling locations.   Rosenfeld stated he would review the plans and also noted that this plan will also go to the Zoning Commission for a full a Special Permit review of which a complete  Soil and Erosion Plan is required.  

Griswold  clarified that the 2nd floor will be eliminated and the existing foundation will be reused  but noted the footprint is  still increasing slightly.

Evan Griswold made a motion to approve the Modification to the Permit at 166 Boston Post Road as submitted.  Tom Machnik seconded the motion.  

DISCUSSION:

Griswold stated since the basketball court is being moved and there is now nothing between the court and the lake he wondered if some sort of swale should be installed to protect runoff from the court.   
Griswold suggested providing a gentle swale between the court and the lake.  DiCamillo asked if that would be a hazard to people playing on the court.   Machnik  stated he did not encourage the placement of  a drainage swale in the area of a lot of foot  traffic.  He further stated  that  he felt it had the potential to not hold  grass and  become a mud hole.  

The motion passed unanimously.       

ENFORCEMENT OFFICER REPORT

Boggy Hole Road

The commission discussed some issues and concerns that have been raised about the number of trucks traveling into the site that may be depositing materials.   Rosenfeld noted a Zoning Cease and Desist Order  was sent to the property own regarding the fill.   

No action was taken.   

Beaver  Dam on Sill Lane

The commission discussed the Beaver Dam located on Sill Lane.   There have been reports of flooding in that area on various properties.   It was noted the beavers have been trapped and removed.   The CT DEEP is concerned about Mill Brook and its capabilities as a fish run.  

Rosenfeld stated that Stanley Kolber raised the issue that any of this work being done with the dam requires permitting at the local level what has not been acquired.

Rosenfeld provided an outline to the commission of his research on the local jurisdiction.    He provided all of his contact information and stated after several conversations he was told that no local decisions were needed  in order to start, carry on and/or complete this project.   

Stanley Kolber was present at the meeting and stated he believed that the local Inland Wetland Agency/Commission should have been notified and referred to a manual regarding Beavers in Connecticut.    Kolber also said he contacted the DEEP and the person on the phone indicated that the state was under the obligation to get permits at the local level.  

DiCamillo agreed to contact Attorney Cassella with regard to this issue and determine if local permits are or are not required.   

WHIPPOORWILL  ROAD

McCulloch  asked if Rosenfeld would be visiting the site.   Rosenfeld stated he would visit the site prior to the next meeting.
