MINUTES OF REGULAR MEETING DATED FEBRUARY 5, 2015
Evan Griswold made a motion to approve the Regular Meeting Minutes dated February 5, 2015 as submitted. Tim Rollins seconded the motion. The motion passed unanimously.
MINUTES OF SITE WALK MEETING DATED FEBRUARY 21, 2015
This item has been tabled until the March meeting.
NEW BUSINESS
14-28 ALL PRO AUTOMOTIVE – GRAYBILL PROPERTIES – 151 BOSTON POST ROAD – RELOCATIONOF EXISTING COMMERCIAL USE TO A NEW BUILDING ON THE SAME PREMISES WITHIN 100’ OF THE REGULATED AREA
DiCamillo stated the presentation will take place at the March meeting. He noted that a meeting was held between Tom Metcalf, Keith Rosenfeld, Anthony Hendriks, Ryan McEvoy and John Sieviec to discuss and review Tom Metcalf’s initial comments. He stated as a result of that meeting Tom Metcalf indicated in his letter to the commission dated February 21, 2015 that revised plans would be forthcoming but not prior to tonight’s meeting. He recommended that the commission determine if the “activity may have a significant impact on the wetlands” thus requiring a public hearing pursuant to Section 9.1 of the IWWC Regulations. He also suggested the commission consider making a site inspection to view the site conditions. The commission agreed they would like to walk the site. DiCamillo
stated he felt there was significant impact and a hearing should be held.
Bechtel made a motion to hold a public hearing on this application. Bechtel stated she was in agreement with the impact but asked about the timing of the application. Groves stated the application was received at the January 27, 2015 meeting. Groves stated it is generally a good idea to walk the site prior to the opening of the public hearing. Bechtel stated she would
prefer to walk the site after the presentation. Bechtel stated she would like a more complete application and some of the issues addressed or resolved prior to proceeding. Bechtel stated this item has been on the agenda for several months and the clock is ticking. She stated she would like to have a more complete application prior to starting the hearing process. DiCamillo stated he thought the applicant would be willing to extend the dates. Griswold stated the commission has not received any new information.
Janet Bechtel suggested the commission deny the application for lack of sufficient information and when the information is all pulled together and this commission will have the necessary information it needs to review the application.
Bechtel withdrew her previous motion.
Janet Bechtel made a motion to deny the application without prejudice due to a lack of sufficient information. Dave McCulloch seconded the motion. The motion passed unanimously.
Evan Griswold stated the application has come in pieces and feels it is important to have a complete application in order for this commission to make an informed decision.
DiCamillo also mentioned that he has been told there are a large number of cars parked in an area where they are not permitted to be parked.
14-31 TOWN OF OLD LYME – 166 BOSTON POST ROAD – IMPROVE AND ENLARGE EXISTING DOCKS ON ROGERS LAKE
Paul Gianquinto, Co –Chairman of the Boathouse Hains Park Improvement Committee was present to discuss the proposal. He stated a portion of the Steep Grant was to improve the docks that are currently down at the boathouse. He stated there are presently three wooden docks. One is used for coach launches, and 10 x 60 wood dock that is anchored to a bulk head on the shore and further to the east there is a smaller dock approximately 8 x 40. He stated there are two proposed docks approximately 10 x 60 made up of 10’ x 7.5’ foot sections. He noted each section is about 350 lbs. He stated the west dock (middle dock) will be anchored in exactly the same position and attached to the bulk head which currently exists.
The east dock does not have a concrete bulkhead and there are no plans to install one. He said the proposal is two do the same thing with a ramp attached to the dock and land on the shore.
He stated they would like to install the docks in time for the Spring rowing season. He further stated to prolong the life of the docks they will be removed at the end of each rowing season.
DiCamillo asked if there would be any impact to the shore. Gianquinto stated the west dock would have no impact as it is anchored to the wall which does not change at all. Gianquinto also stated they are considering reusing some of the sections that are in better condition to replace the sections in the coach launch dock.
The commission agreed to set a site walk for Saturday, March 21, 2015 at 8:30 a.m.
OLD BUSINESS
14-26 – CONSTANCE AYARS – 107 BOSTON POST ROAD – MODIFICATION TO PREVIOUSLY APPROVED SITE PLAN. MODIFICATION IS TO INSTALL AN AERATOR WITHIN THE EXISTING POND IN ORDER TO ADD OXYGEN TO THE POND
Mike Harkin, Professional Engineer was present to discuss the application. He noted the commission walked the site. Harkin provided the commission with pictures of the pond that was approved by the commission two years ago.
The commission reviewed the site plan showing the aerator on the pond as well as a picture of the proposed aerator to be used to the site. Harkin stated it is a plastic unit with no oils associated with it and noted it can stay in the water all year round. He stated it has an electric cable that runs the 1 horsepower aerator which will require some trenching into the house.
Griswold asked if there was a filter on the aerator that would keep aquatic life from being sucked up. Harkins stated Richard Snarski visited the site and stated the aquatic life is very low. Griswold stated he was concerned about the micro-organisms that are swimming in the pond. He asked if any water testing was done. Harkin stated no water testing is done on the pond. Harkin further stated the aerators do have a small screen.
Bechtel asked if the applicant is proposing to light the aerator. DiCamillo stated they indicated it would not be lit.
Janet Bechtel made a motion to approve the application of Constance Ayars modification to install an aerator within the existing pond with the condition it not be lit. Evan Griswold seconded the motion. The motion passed unanimously.
14-29 – PETER AND CONSTANCE ROSS – 37 BROWNS LANE – PROPOSAL TO ADD BREEZEWAY MUDROOM, GARAGE AND BREAKFAST AREA. THE GARAGE AND BREEZEWAY IS WITHIN THE REGULATED AREA.
Jerry Karpuska was present on behalf of the Ross Application. The commission tabled setting a site walk last month due to the fact they felt the plan was deficient. Mr. Karpuska updated the plan and noted for the record that this was the plan that was used for the prior approval of that site for the construction of a garage that was never built. Karpuska explained he would be doing the design work for the addition. The commission reviewed the updated plan and clarified the distances to the wetlands from the proposed work. The commissions agreed to set a site walk for Saturday, March 21, 2015 at 9:15 a.m.
14-30 – RICHARD BATTALINO – 240-1 SHORE ROAD – PROPOSED ADDITION TO EXISTING SELF STORAGE BUILDING 100 X 25 LOCATED INSIDE OF FENCE WITHIN REVIEW ZONE.
Mr. Battalino was presented to discuss his proposal for the site. He explained the addition to the commission. The commission asked Mr. Battalino to update his existing site plan to accurately reflect exactly what he is proposing for the site. The updates should include where the storage doors will open, the location of the silt fence as well as any stockpile materials from creating the slabs for the addition. They also requested any items that are shown on the plan that were not currently on the site be removed such as the dumpster.
Battalino agreed to update the plan and attend the March meeting.
